(ORAL)\n<\/pre>\n<p id=\"p_1\">              Present petition has been filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<\/p>\n<p>Constitution of India for issuance of a writ in the nature of habeas corpus<\/p>\n<p>for release of the detenues mentioned in para 2 of the petition.<\/p>\n<p id=\"p_1\">              Notice of motion was issued. District Magistrate\/ Deputy<\/p>\n<p>Commissioner, Bathinda was directed to enquire into the averments made<\/p>\n<p>in the petition.\n<\/p>\n<p id=\"p_2\">              Written statement by way of short affidavit of Deputy<\/p>\n<p>Commissioner, Bathinda has been filed. Same is taken on record.<\/p>\n<p id=\"p_3\">              Para 2 and 3 of the short affidavit filed by the Deputy<\/p>\n<p>Commissioner, Bathinda read as under:<\/p>\n<blockquote id=\"blockquote_1\"><p>              &#8220;2.   That the Sub-Divisional Magistrate Rampura Phul<br \/>\n       visited the spot. Sh.Rijak Ram and Vijay Kumar owners were<br \/>\n       present at the Brik Kiln. They told the party that the labour<br \/>\n       mentioned in the writ petition is engaged in making kutcha<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Writ Petition No. 207 of 2009                                     2<\/span><\/p>\n<p>      bricks at village Bath. When the party reached village Bath,<br \/>\n      some of the labourers mentioned in the petition were present<br \/>\n      and some had gone to village to purchase ration etc. After<br \/>\n      some time all the members of labour mentioned in the petition<br \/>\n      except Mohinder and Kalu came present.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             3.     That as per report of Sub Divisional Magistrate<br \/>\n      Rampura one Ajay Kumar is the leader of these labourers.<br \/>\n      Ajay Kumar and other members of the labour got their<br \/>\n      statements recorded to the effect that they belong to village<br \/>\n      Sillana, Tehsil Baraut District Bagpat (UP) and are preparing<br \/>\n      bricks for the last two months. They were promised to get<br \/>\n      payment at the rate fixed by the Govt. but lateron there arose<br \/>\n      some dispute between the Brick Kiln owner and the labourers.<br \/>\n      One of their companion left the Brick Kiln and filed the present<br \/>\n      petition. They further stated that they have received full &amp; final<br \/>\n      payment of labour charges and nothing was due to the Brick<br \/>\n      Kiln Owner. Their three companions namely Amar Singh, Kalu<br \/>\n      and Mohinder have already reached the village after leaving<br \/>\n      the Brick Kiln and they also intend to go to their native village.<br \/>\n      They further got recorded that they were never detained by<br \/>\n      any one and they were moving freely for purchasing their<br \/>\n      domestic articles. English version of the statement of Ajay<br \/>\n      Kumar and report of Sub Divisional Magistrate, Rampura is<br \/>\n      annexed as Annexure R-1 and R-2 respectively.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             In view of the averments made in the written statement, no<\/p>\n<p>further directions are called for.
