INCOME TAX REFERENCE No. 140 of 1988<br \/>\n          MR BB NAIK with MR MANISH R BHATT for Petitioner No. 1<br \/>\n<span class=\"hidden_text\" id=\"span_1\">          MR RK PATEL for Respondent No. 1<\/span><\/p>\n<p id=\"p_8\">     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              CORAM : MR.JUSTICE M.S.SHAH<br \/>\n                                 and<br \/>\n                      MR.JUSTICE D.A.MEHTA<\/p>\n<p>     Date of decision: 01\/11\/2001<\/p>\n<p>ORAL JUDGEMENT<br \/>\n               (Per : MR.JUSTICE M.S.SHAH)<br \/>\nIn this reference at the instance of the revenue,<br \/>\nthe Income Tax Appellate Tribunal, Ahmedabad has referred<br \/>\nthe following question for our opinion in respect of<br \/>\nassessment year 1980-81:-\n<\/p><\/blockquote>\n<p id=\"p_9\"> &#8220;Whether, the income of Rs.6290\/- from the firm<br \/>\n        of M\/s.    Nilam Industries and Weigh Bridge was<br \/>\n        assessable in the hands of K.S.      Lokhandwala<br \/>\n        Family Trust and not including in the income of<br \/>\n        the assessee?&#8221;\n<\/p>\n<p id=\"p_10\">2.We have heard Mr BB Naik learned counsel for the<br \/>\nrevenue and Mr RK Patel learned counsel for the assessee.\n<\/p>\n<p id=\"p_11\">3.In the order giving rise to this reference, the<br \/>\nTribunal has specifically stated that it was following<br \/>\nits order dated 20-9-1983 in Appeal No.2220\/Ahd\/82 and in<br \/>\nthe statement of the case, the Tribunal has further<br \/>\nstated that an elaborate statement of the case for the<br \/>\nassessment year 1976-77 was already drawn up for another<br \/>\nreference.\n<\/p>\n<p id=\"p_12\">4.At the hearing of this reference, Mr BB Naik<br \/>\nlearned counsel for the revenue invited our attention to<br \/>\nthe order dated 13-8-2001 in Income Tax Reference No.202<br \/>\nof 1986 wherein this Court declined to answer the<br \/>\nquestion as the facts on record were not clear.\n<\/p>\n<p id=\"p_13\">5.Following the said decision, in this case also,<br \/>\nwe decline to answer the question referred to us.\n<\/p>\n<p id=\"p_14\">6.The Reference accordingly stands disposed of with<br \/>\nno order as to costs.\n<\/p>\n<p id=\"p_15\">(M.S.
