SANKARAN, J.\n                     ---------------------------\n                   W.P(C).No.37518 of 2008\n                -------------------------------------\n              Dated this the 17th day of June, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner holds a regular permit to operate stage<\/p>\n<p>carriage service on the route Attukal- Parottukonam Sivan Kovil<\/p>\n<p>junction. He applied to the Regional Transport Authority for<\/p>\n<p>variation of the permit, as per Exhibit P1 application. The<\/p>\n<p>variation requested for was to extend the route up to Maruthoor<\/p>\n<p>Kadavu, so that the vehicle can operate from Maruthoor Kadavu-<\/p>\n<p>to Attukal-Parottukonam Sivan Kovil junction. A deviation was<\/p>\n<p>also requested for.\n<\/p>\n<p>     2.    Exhibit P1 application was considered in the meeting of<\/p>\n<p>the Regional Transport Authority held on 18\/4\/2008.           The<\/p>\n<p>decision rendered reads as follows:\n<\/p>\n<blockquote><p>          &#8220;The proposed varying areas are well served<br \/>\n      KSRTC and other private services. Also the proposed<br \/>\n      curtailment will adversely effect the passengers of that<br \/>\n      area.\n<\/p><\/blockquote>\n<blockquote><p>           As per KMV Rule 145(R) RTA can allow the<br \/>\n      variation or extension only when<\/p>\n<\/blockquote>\n<blockquote><p>        i) New circumstances have arisen since the route<br \/>\n           was decided, such as the construction of bridge<br \/>\n           or road;\n<\/p><\/blockquote>\n<p>W.P(C).No.37518\/2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>         ii) The transport requirements of the area to be<br \/>\n            served were overlooked or have changed.\n<\/p>\n<p>            This is also not established. Hence rejected.&#8221;<\/p>\n<p>     3.     Aggrieved by the decision of the Regional Transport<\/p>\n<p>Authority, the petitioner filed an appeal as M.V.A.A. No.365 of<\/p>\n<p>2008 before the State Transport Appellate Tribunal, Ernakulam.<\/p>\n<p>The Appellate Tribunal dismissed the appeal by the judgment<\/p>\n<p>dated 30\/08\/2008, which is under challenge in this Writ Petition.<\/p>\n<p>     4.     Before the Appellate Tribunal, the petitioner did not<\/p>\n<p>press the request for deviation of the route. However, the request<\/p>\n<p>for variation and extension was pressed. The Appellate Tribunal<\/p>\n<p>held that taking into account the convenience of the travelling<\/p>\n<p>public, the rejection of the request for variation was justified. It<\/p>\n<p>was also found by the authorities below that the proposed<\/p>\n<p>varying areas are well served by KSRTC and other private<\/p>\n<p>services.\n<\/p>\n<p>     5.     Rule 145(6) of the Kerala Motor Vehicles Rules,1989<\/p>\n<p>provides that;\n<\/p>\n<p>            The Transport Authorities shall, in deciding whether to<br \/>\n     vary or extend a route, have regard to the following matters,<\/p>\n<p>W.P(C).No.37518\/2008<br \/>\n<span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>      namely:-\n<\/p>\n<p>      (i)new circumstances have arisen since the route was decided,<br \/>\n         such as the construction of a bridge, or road:<\/p>\n<p>      (ii)the transport requirements of the area to be served were<br \/>\n          overlooked or have changed.\n<\/p>\n<p>      6.     It is submitted by the learned counsel for the<\/p>\n<p>petitioner that clauses (i) and (ii) of Sub-rule (6) are illustrative<\/p>\n<p>and that for variation or extension, other circumstances also<\/p>\n<p>could be taken note of. The counsel relied on the judgment in<\/p>\n<p>W.A. No.152 of 1992 in support of the contention.<\/p>\n<p>      7.     It is not established by the petitioner that clauses (i)<\/p>\n<p>and (ii) of Sub-rule (6) of Rule 145 of the Kerala Motor Vehicles<\/p>\n<p>Rules are made out in the case on hand. No other circumstance<\/p>\n<p>justifying the variation or extension of the route is also<\/p>\n<p>established in the case. On the other hand, the clear finding by<\/p>\n<p>the Regional Transport Authority is that the proposed varying<\/p>\n<p>areas are well served by K.S.R.T.C and other private services.<\/p>\n<p>The Appellate Tribunal rightly held that taking into account the<\/p>\n<p>convenience of the travelling public, it is not necessary or<\/p>\n<p>expedient to vary or extend the route as sought for by the<\/p>\n<p>petitioner.\n<\/p>\n<p>W.P(C).No.37518\/2008<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>      8.    The findings rendered by the authorities below are<\/p>\n<p>findings of fact. No circumstance is made out to interfere with the<\/p>\n<p>concurrent findings of fact, which       normally would not be<\/p>\n<p>interfered with in a proceeding under Article 226 of the<\/p>\n<p>Constitution of India. I am of the view that the order passed by<\/p>\n<p>the Regional Transport Authority and the judgment rendered by<\/p>\n<p>the Appellate Tribunal are legal and proper.<\/p>\n<p>      For the aforesaid reasons, the Writ Petition is dismissed.<\/p>\n<p>                                     K.T.
