Justice ANTONY DOMINIC\n\n Dated :27\/06\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J\n                      = = = = = = = = = = = = = = = =\n                          O.P.No.4371 OF 2003\n                         = = = = = = = = = = = = =\n                  Dated this the 27th day of June, 2008.\n\n                             J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The claim of the petitioner is for payment of certain<\/p>\n<p>amounts due from the 2nd respondent. In view of the nature of<\/p>\n<p>the dispute that is raised, it is not be possible to resolve the<\/p>\n<p>factual controversy involved.          In my view, the appropriate<\/p>\n<p>remedy for the petitioner is to file a suit for recovery in a regular<\/p>\n<p>civil court.\n<\/p>\n<p id=\"p_1\">      Learned counsel for the petitioner points out that this writ<\/p>\n<p>petition was filed in the year 2003, and that the period of<\/p>\n<p>pendency of this case should be excluded for counting limitation.<\/p>\n<p>Taking note of the submission as above, I direct that the period<\/p>\n<p>of pendency of the writ petition will be appropriately taken into<\/p>\n<p>account for the purpose of limitation, if a proper application is<\/p>\n<p>made by the petitioner.\n<\/p>\n<p id=\"p_2\">      With this clarification, this writ petition is closed.<\/p>\n<p id=\"p_3\">                                              ANTONY DOMINIC, JUDGE<\/p>\n<p>bkn\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Joshy Varghese vs State Of Kerala on 27 June, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM OP.No. 4371 of 2003(U) 1.
