By the impugned<br \/>\ncommunication dated 31.12.1998, GIDC ordered the petitioner to evict<br \/>\nthe said plot, within ten days.\n<\/p>\n<p id=\"p_1\">2.\t\tThis Court, on<br \/>\n11.01.1999, while issuing notice, granted ad-interim-relief in terms<br \/>\nof Para-16(B) and thereby protected the possession of the petitioner.<br \/>\nThereafter, on 26.07.2000, while issuing rule and confirming the<br \/>\nad-interim-relief granted previously, it was provided that the<br \/>\npetitioner shall pay balance amount towards the price of the plot,<br \/>\non, or before 30.09.2000.\n<\/p>\n<p id=\"p_2\">3.\t\tI have heard learned<br \/>\nCounsel for the parties.\n<\/p>\n<p id=\"p_3\">4.\t\tIt appears that the<br \/>\nprime concern of the GIDC is that the petitioner, at the relevant<br \/>\npoint of time, did not pay the full price of the plot. During the<br \/>\npendency of the petition, therefore, substantial amount has remained<br \/>\noutstanding, which was legally due and payable. The learned Counsel<br \/>\nfor the GIDC relied on Affidavit-in-Rejoinder dated 11.11.2009, filed<br \/>\nby one Shri. V.K. Patel, Regional Manager, GIDC, in which it is<br \/>\nstated that, as on 31.10.2009, the petitioner has to pay<br \/>\nRs.3,75,094\/-.\n<\/p>\n<p id=\"p_4\">5.\t\tThe learned Counsel<br \/>\nfor the petitioner submitted that the petitioner is ready and willing<br \/>\nto pay all the legal dues.  However, GIDC never supplied to the<br \/>\npetitioner, the calculations for arriving at the said figure.  He,<br \/>\nhowever, did not dispute that some amount is due and payable to the<br \/>\npetitioner.\n<\/p>\n<p id=\"p_5\">6.\t\tIt is not in dispute<br \/>\nthat the petitioner has established a small-scale industry, on the<br \/>\nsaid plot, way back in the year 1993, which is functioning till date.\n<\/p>\n<p id=\"p_6\">7.\t\tUnder the<br \/>\ncircumstances, the impugned communication dated 31.12.1998 is set<br \/>\naside. This petition is DISPOSED of, with the following<br \/>\ndirections:\n<\/p>\n<p id=\"p_7\">(1)\t\tThe petitioner<br \/>\nshall deposit a sum of RS.2,00,000\/-(TWO LACS), latest<br \/>\nby 31ST DECEMBER, 2010<br \/>\nwith the GIDC.  The GIDC, by the said date, shall SUPPLY<br \/>\nto the petitioner, the CALCULATIONS of the outstanding<br \/>\ndues with interest.\n<\/p>\n<p id=\"p_8\">(2)\t\tWithin TWO<br \/>\nMONTHS, from the date of receipt of such calculations, the<br \/>\npetitioner shall DEPOSIT with the GIDC,  the reaming<br \/>\namount, after giving a credit of Rs.2,00,000\/-(Two Lacs), if he has<br \/>\nalready deposited the same with the GIDC.\n<\/p>\n<p id=\"p_9\">8.\t\tIt is clarified<br \/>\nthat, even if the petitioner has any DISPUTE about such<br \/>\ncalculations supplied by the GIDC, and though, it will be open for<br \/>\nhim to raise OBJECTIONS with the GIDC and to take legal<br \/>\nrecourse thereafter, in the first instance, he shall make FULL<br \/>\nDEPOSIT, even under protest.
