Justice S.SIRI JAGAN\n\n Dated :16\/08\/2010\n\n O R D E R\n                             S.SIRI JAGAN, J.\n                     ==================\n                       W.P.(C).No. 23535 of 2010\n                     ==================\n               Dated this the 16th day of August, 2010.\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The petitioner is a Residents&#8217; Association.            They are<\/p>\n<p>aggrieved      by    the    construction   of   a    culvert  in the<\/p>\n<p>Sasthamangalam-Vellayambalam road in Trivandrum for the<\/p>\n<p>process of widening the said road. Their grievance is that the<\/p>\n<p>Chief Engineer has given Ext.P7 recommendation in the matter of<\/p>\n<p>construction of that culvert, which has been given a go-by in the<\/p>\n<p>matter. Petitioner therefore seeks the following reliefs:-<\/p>\n<blockquote id=\"blockquote_1\"><p>         i)to issue a writ of mandamus directing the 3rd<br \/>\n         respondent to issue necessary directions to the 1st<br \/>\n         respondent to forebear from constructing a culvert<br \/>\n         across    the Sasthamangalam-Vellayambalam road, in<br \/>\n         order to collect water from the southern and northern<br \/>\n         sides of the road and to flow out the water through the<br \/>\n         channel on the northern side of the road;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     ii) to declare that the 1st respondent has not been<br \/>\n         conferred with the authority to change the existing<br \/>\n         drainage system, used for draining out water from the<br \/>\n         drains    on  either  side  of   the  Sasthamangalam-<br \/>\n         Vellayambalam road;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     iii)to issue a writ of mandamus directing the respondent 2<br \/>\n         and 4 to take necessary action so as to ensure that the<br \/>\n         low   lying  areas   on  the   northern   side  of  the<br \/>\n         Sasthamangalam -Vellayambalam road does not get in<br \/>\n         undated due to overflow of water from the channel<br \/>\n         carrying the water from the main drain on the side of<br \/>\n         the   Sasthamangalam-Vellayambalam       road,  to  the<br \/>\n         Killiyar thodu;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>         and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C).No. 23535 of 2010              2<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>        iv)to grant such other reliefs as this Honourable Court may<br \/>\n            deem fit in the circumstances of this case.<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">        2. The learned Government Pleader and the learned counsel<\/p>\n<p>for the first respondent submits that the matter is now pending<\/p>\n<p>before the 3rd respondent for finalisation pursuant to Ext.P9 and,<\/p>\n<p>therefore, it is only appropriate that the 3rd respondent takes a<\/p>\n<p>final decision in the matter.\n<\/p>\n<p id=\"p_3\">        Having heard both sides , I dispose of this writ petition with<\/p>\n<p>a direction to 3rd respondent to take final decision in the matter<\/p>\n<p>pursuant to Ext.P9 expeditiously.
