No.6687 of 2010<\/p>\n<p>                          This application under <a href=\"\/doc\/100581\/\" id=\"a_1\">section 5<\/a> of the<br \/>\n                Limitation Act is filed by the appellant for condonation<br \/>\n                of delay of 25 days occurred in filing the above Letters<br \/>\n                Patent Appeal.\n<\/p>\n<p id=\"p_1\">                          Learned advocate Ms. G. Nisha appears for the<br \/>\n                respondent no.1 and learned advocate Mr. Alok<br \/>\n                K.Choudhary appears for the respondent nos.2 to 5. They<br \/>\n                have no objection if delay is condoned.\n<\/p>\n<p id=\"p_2\">                          On the facts and in the circumstances of the<br \/>\n                case, the delay is condoned.\n<\/p>\n<p id=\"p_3\">                          Interlocutory Application stands disposed of.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                            2<\/span><\/p>\n<p id=\"p_4\">                    LPA. No.1185 of 2010<br \/>\n                    Heard the learned advocates.\n<\/p>\n<p id=\"p_5\">                    Feeling aggrieved by the order dated 11th May<br \/>\n         2010 made by the learned Single Judge in above CWJC.<br \/>\n         No.15776 of 2009, the writ petitioner has preferred this<br \/>\n         Appeal under Clause 10 of the Letters Patent.\n<\/p>\n<p id=\"p_6\">                    The appellant is a trader, who had applied to<br \/>\n         the State Bank of India for a loan. It is the complaint of<br \/>\n         the appellant that though he had applied for a loan as<br \/>\n         early as in the year 2007, loan papers were not processed<br \/>\n         by the Bank.\n<\/p>\n<p id=\"p_7\">                    The Bank contested the writ petition and filed<br \/>\n         the counter affidavit. It is stated that the title of the<br \/>\n         property that was offered by the appellant for mortgage<br \/>\n         was not clear inasmuch as the appellant had already<br \/>\n         borrowed     a loan on that property from the Punjab<br \/>\n         National Bank by creating charge over that property.<br \/>\n         The appellant was a defaulter of the Punjab National<br \/>\n         Bank.\n<\/p>\n<p id=\"p_8\">                    The learned Single Judge has held that the<br \/>\n         appellant had no enforceable right to borrow         loan.<br \/>\n         Accordingly, the writ petition has been dismissed.\n<\/p>\n<p id=\"p_9\">                    We agree with the learned Single Judge. The<br \/>\n         Appeal is dismissed in limine.\n<\/p>\n<p id=\"p_10\">                                 ( R. M.
