{"id":253892,"date":"2010-07-07T00:00:00","date_gmt":"2010-07-06T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/sujata-pathak-vs-the-state-of-madhya-pradesh-on-7-july-2010"},"modified":"2014-11-07T08:07:40","modified_gmt":"2014-11-07T02:37:40","slug":"sujata-pathak-vs-the-state-of-madhya-pradesh-on-7-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/sujata-pathak-vs-the-state-of-madhya-pradesh-on-7-july-2010","title":{"rendered":"Sujata Pathak vs The State Of Madhya Pradesh on 7 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Sujata Pathak vs The State Of Madhya Pradesh on 7 July, 2010<\/div>\n<pre id=\"pre_1\">07.07.2010.\n      Shri Narendra Sharma for the petitioner.\n      Shri Puneet Shroti, Panel Lawyer, for the respondents on<\/pre>\n<p id=\"p_1\">advance notice.\n<\/p>\n<p id=\"p_1\">      Challenging the order-dated 15.6.2010 by which the<br \/>\npetitioner, a lady ANM, has been transferred from Primary Health<br \/>\nCentre, Pandukhedi (Sukhtawa) to Primary Health Centre Khoksar<br \/>\n(Dolariya) in the District of Hoshangabad.\n<\/p>\n<p id=\"p_2\">      Contending that the transfer is contrary to the transfer policy<br \/>\nof the State Government, petitioner has been elected as President of<br \/>\nan employees union and, therefore, for two consecutive sessions<br \/>\nshe cannot be transferred as per the policy &#8211; Annexure P\/6 dated<br \/>\n20.4.2010, petitioner seeks interference into the matter. The only<br \/>\nground canvassed at the time of hearing was the aforesaid breach of<br \/>\npolicy condition.\n<\/p>\n<p id=\"p_3\">      Shri Puneet Shroti, learned counsel for the respondents,<br \/>\ninvites my attention to the policy in question and points out that<br \/>\nunder the policy and Clause 9.21 thereof, immunity from transfer is<br \/>\nonly granted to such office bearers, who hold the post of President<br \/>\nand Secretary of a State Level or District Level Union and not a<br \/>\nBlock or Tehsil Level Union of which the petitioner is an office<br \/>\nbearer. Accordingly contending that the policy in question is not<br \/>\nbreached in the case of the petitioner, Shri Shroti prays for<br \/>\ndismissal of this petition.\n<\/p>\n<p id=\"p_4\">      Having heard learned counsel for the parties and on a perusal<br \/>\nof Clause 9.21 of the policy, it is clear that immunity from transfer<br \/>\nis available to recognized Unions, which have been granted benefit<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                      2<\/span><\/p>\n<p>of correspondence with the State Government and office bearers of<br \/>\nsuch a Union holding post in the State or District Level Committee<br \/>\nare only granted exemption. There is nothing in this circular to<br \/>\nindicate that persons like the petitioner, who are office bearers of a<br \/>\nTehsil or Block Level Unit of the Union, are also protected.
