Heard Shri Pankaj Kumar Sinha,<\/p>\n<p>                  learned counsel for the petitioner. Today<\/p>\n<p>                  again,     none   appeared    on   behalf      of   the<\/p>\n<p>                  respondent\/Patna Municipal Corporation.<\/p>\n<p>                             On earlier occasion also, none had<\/p>\n<p>                  appeared          on     behalf           of        the<\/p>\n<p>                  respondent\/Municipal         Corporation       despite<\/p>\n<p>                  the fact that copy of the writ petition was<\/p>\n<p>                  already served on learned counsel for the<\/p>\n<p>                  respondent\/Patna Municipality before filing<\/p>\n<p>                  of the writ petition. It is further evident<\/p>\n<p>                  from order dated 29.9.2011 that since on<\/p>\n<p>                  28.9.2011, none appeared on behalf of the<\/p>\n<p>                  respondent\/Municipal Corporation, the case<\/p>\n<p>                  was passed over for the day.\n<\/p>\n<p>                             Learned counsel for the petitioner<\/p>\n<p>                  submits that he had personally informed the<\/p>\n<p>                  learned            counsel          for             the<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>respondent\/Municipal                       Corporation.               Even<\/p>\n<p>then,    he    had        not    appeared              on    29.9.2011.<\/p>\n<p>Similarly, today none appeared on behalf of<\/p>\n<p>the respondent\/Patna Municipal Corporation.<\/p>\n<p>          The        petitioner,                 who        retired     on<\/p>\n<p>31.5.2011       as    Assistant                (Legal       Cell)     from<\/p>\n<p>Head    Office,       Patna          Municipal          Corporation,<\/p>\n<p>Patna,        has     prayed              for      directing           the<\/p>\n<p>respondents          to    make           payment       of     all    his<\/p>\n<p>retiral dues. It was submitted that till<\/p>\n<p>date,     nothing          has            been        paid     to      the<\/p>\n<p>petitioner. After retirement, since payment<\/p>\n<p>was     not     made,           it        was     submitted           that<\/p>\n<p>petitioner           filed           representation                 before<\/p>\n<p>respondent          no.2\/The          Commissioner-cum-Chief<\/p>\n<p>Executive            Officer,                  Patna          Municipal<\/p>\n<p>Corporation               for              making              payment,<\/p>\n<p>particularly on the ground that he was in<\/p>\n<p>urgent    need        of        money           for     his     medical<\/p>\n<p>treatment and also it was alleged that in<\/p>\n<p>similarly      circumstances,                   payment       was     made<\/p>\n<p>to one another employee.\n<\/p>\n<pre>          In         view            of         the         facts      and\n\ncircumstances,            particularly                the    fact     that\n\nnone     had        appeared              on     behalf        of     the\n\n<\/pre>\n<p>respondents, the court has got no option<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>        but to decide the matter on the basis of<\/p>\n<p>        materials      available      on    the    record.
