Justice R.BASANT\n\n Dated :15\/01\/2007\n\n O R D E R\n                                     R.BASANT, J\n\n                           ------------------------------------\n\n                            Crl.M.C.No.3638 of 2006\n\n                          -------------------------------------\n\n                   Dated this the  15th day of January, 2007\n\n\n                                         ORDER\n<\/pre>\n<p id=\"p_1\">       The 1st  petitioner is the accused in a prosecution under <a href=\"\/doc\/1868826\/\" id=\"a_1\">Section<\/p>\n<p>498<\/a> A I.P.C.  Initially allegations were raised against accused 2, 3 &amp; 4<\/p>\n<p>also.     But   it   is   submitted   that   the   final   report   has   been   filed   only<\/p>\n<p>against the 1st  petitioner.   Investigation was conducted by the police.<\/p>\n<p>Final report has already been filed.  Cognizance has been taken by the<\/p>\n<p>learned   Magistrate.     The   1st  petitioner   has   entered   appearance   and<\/p>\n<p>has been enlarged on bail also.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.      The   1st  petitioner   wanted   the   proceedings   against   him   to<\/p>\n<p>be   quashed   on   the   assertion   that   the   disputes   have   been   settled<\/p>\n<p>between the parties.   The 2nd  respondent\/the defacto complainant\/the<\/p>\n<p>divorced wife of the 1st  petitioner has not entered appearance before<\/p>\n<p>this  Court,   nor   has   the   composition   been   reported   to   this   Court.     In<\/p>\n<p>these   circumstances,   I   must   assume   that   there   is   no   harmonious<\/p>\n<p>settlement of the disputes between the indictee\/the 1st  petitioner and<\/p>\n<p>the   2nd  respondent\/the   defacto   complainant.     The   offence   under<\/p>\n<p><a href=\"\/doc\/1868826\/\" id=\"a_1\">Section   498<\/a>   A   I.P.C   is   not   compoundable.     Of   course,   invoking   the<\/p>\n<p>dictum in  <a href=\"\/doc\/469138\/\" id=\"a_2\">B.S.Joshy v. State of Haryana<\/a>  [A.I.R (2003) SC 1386], in<\/p>\n<p>an   appropriate   case,   proceedings   can   be   quashed.     But   when   the<\/p>\n<p>defacto   complainant   has   not   settled   and   compromised   the   disputes,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.3638 of 2006                      2<\/span><\/p>\n<p>there can be no question of invoking the dictum in <a href=\"\/doc\/469138\/\" id=\"a_3\">B.S.Joshy v. State<\/p>\n<p>of Haryana<\/a> also.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.      The 1st  petitioner has a further grievance that because of<\/p>\n<p>the   pendency   of   the   prosecution,   he     is   not   able   to   get   his   passport<\/p>\n<p>renewed.    Sufficient time  was   granted to enable  the 1st  petitioner to<\/p>\n<p>file a joint compromise statement along with the 2nd  respondent.   But<\/p>\n<p>those   opportunities   could   not   be   availed   of   by   the   1st  petitioner.     In<\/p>\n<p>these   circumstances,   there   can   be   no   question   of   powers   under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_4\">Section   482<\/a>   Cr.P.C   being  invoked.     This   Crl.M.C  deserves   to   be  and<\/p>\n<p>does hereby dismissed.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">       4.      The   learned   counsel   for   the   petitioners   finally   prays   that<\/p>\n<p>there may  be a direction to the learned Magistrate to dispose of  the<\/p>\n<p>case   against   the   1st    petitioner   as   expeditiously   as   possible.     The   1st<\/p>\n<p>petitioner&#8217;s   interest   do   suffer   because   of   his   inability   to   get   his<\/p>\n<p>passport renewed.   In fact, the matter  has  been settled also and the<\/p>\n<p>2nd  respondent,   if   she   is   summoned   to   appear   before   the   court   in<\/p>\n<p>criminal case, will be forced to reveal the settlement\/composition, it is<\/p>\n<p>urged.     There   may   be   a   direction   for   expeditious   disposal   of<\/p>\n<p>C.C.NO.145   of   2006   pending   before   the   learned   Chief   Judicial<\/p>\n<p>Magistrate, Trivandrum.   I am satisfied, that such a direction can be<\/p>\n<p>issued   in   the   peculiar   facts   and   circumstances   of   this   case.     The<\/p>\n<p>learned   Magistrate   shall   dispose   of   the   case   within   a   period   of   3<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.3638 of 2006              3<\/span><\/p>\n<p>months from the date on which a  copy of this order is placed before<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">         5.
