RAMKUMAR, J.\n                 = = = = = = = = = = = = =\n                   Crl.M.C.No. 765 of 2008\n                = = = = = = = = = = = = = =\n           Dated this the 12th day of March, 2008\n\n                             ORDER\n<\/pre>\n<p id=\"p_1\">     The petitioner, who is the accused in crime No. 367 of 2006<\/p>\n<p>of Manjeshwar Police Station for offences punishable under<\/p>\n<p>Sections 380 and 381 r\/w <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of the Indian Penal Code<\/p>\n<p>and now pending before the Judicial First Class Magistrate,<\/p>\n<p>Kasaragod as C.C. No. 213 of 2007, seeks to quash Annexure-A4<\/p>\n<p>charge sheet and all further proceedings before the Magistrate.<\/p>\n<p id=\"p_1\">     2. According to the petitioner, the original complaint lodged<\/p>\n<p>by the de facto complainant not only arrayed the petitioner as<\/p>\n<p>the 2nd accused but also made allegations against accused Nos. 1<\/p>\n<p>and 3 besides alleging the commission of an offence punishable<\/p>\n<p>under <a href=\"\/doc\/436339\/\" id=\"a_1\">Section 381<\/a> IPC. But the police after investigation deleted<\/p>\n<p>accused Nos. 1 and 3 and placing the petitioner alone for trial<\/p>\n<p>after substituting <a href=\"\/doc\/436339\/\" id=\"a_2\">Section 381<\/a> IPC with <a href=\"\/doc\/1873755\/\" id=\"a_3\">Section 457<\/a> IPC.       No<\/p>\n<p>reasons have been given by the Investigating Agency as to why<\/p>\n<p>they have deleted accused Nos. 1 and 3 from the array of the<\/p>\n<p>accused.\n<\/p>\n<p id=\"p_2\">Crl.M.C.No. 765\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   2<\/span><\/p>\n<p id=\"p_3\">      3. If, as a matter of fact, the petitioner has a grievance<\/p>\n<p>that there has been no proper investigation in the case, the<\/p>\n<p>petitioner can move the trial court under <a href=\"\/doc\/274924\/\" id=\"a_4\">Section 173(8)<\/a> Cr.P.C<\/p>\n<p>and in the event of that court being convinced about the<\/p>\n<p>grievance of the petitioner, that court can order further<\/p>\n<p>investigation under <a href=\"\/doc\/274924\/\" id=\"a_5\">Section 173(8)<\/a> Cr.P.C. Reserving this right of<\/p>\n<p>the petitioner, this Crl.M.C is dismissed.<\/p>\n<p id=\"p_4\">                                        V.
