Mishra, Advocates  for the<br \/>\nappellant.\n<\/p><\/blockquote>\n<p>Mr. N.P.Midha  and Mr.\tBharat\tSangal,\t Advocates  for\t the<br \/>\nrespondent.\n<\/p>\n<p>\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered:<br \/>\nM.K.MUKHERJEE, J.\n<\/p>\n<p>     The respondent  was tried\tfor  and  convicted  of\t the<br \/>\noffences under\tSection 161  of the  Indian Penal  Code an d<br \/>\n5(2) read with 5(1) (d) of the Prevention of Corruption Act,<br \/>\n1947  by   the\tSpecial\t Judge\t(Vigilance),  Sambalpur\t for<br \/>\naccepting a  sum of  Rs. 500\/- as illegal gratification from<br \/>\nMohd. Ushaman  (P.W.2), an employee of Rourkela Steel Plant.<br \/>\nIn  appeal   preferred\tby  him\t the  High  Court  that\t the<br \/>\nrespondent received  the above\tsum as illegal gratification<br \/>\nand that  the defence  of the  respondent received the above<br \/>\nsum as\tillegal gratification  and that\t t he defence of the<br \/>\nrespondent that\t the above  amount was paid by P.W.2 as loan<br \/>\nwas unbelievable.  Inspite thereof  the High Court set aside<br \/>\nthe convictions\t of the respondent solely on the ground that<br \/>\nthere was  no valid  sanction to  prosecute him.  The  above<br \/>\njudgment is under challenge in this appeal.\n<\/p>\n<p>2.   On perusal\t of the\t impugned judgment  we find that the<br \/>\nHigh Court&#8217;s  attention was  not drawn\tto the provisions of<br \/>\nSection\t 465   of  the\tCode  of  Criminal  Procedure  which<br \/>\nexpressly  lays\t  down,\t inter\t alia,\tthat  any  error  of<br \/>\nirregularity in\t any sanction  for the prosecution shall not<br \/>\nbe a  ground for  reversing an\torder of  conviction by\t the<br \/>\nappellate Court\t unless in  the\t opinion  of  that  Court  a<br \/>\nfailure of  justice has in fact been occasioned thereby. The<br \/>\nsection further\t lays down  that in  determining whether any<br \/>\nerror or  irregularity in  any sanction\t for the prosecution<br \/>\nhas occasioned\ta failure  of justice,\tthe Court shall have<br \/>\nregard to  the fact  whether the  objection could and should<br \/>\nhave been  raised at an earlier stage of the proceedings. In<br \/>\nview of\t the above provisions the High Court was required to<br \/>\ndecide, after  recording a finding that there was some error<br \/>\nor irregularity\t occasioned a failure of justice and further<br \/>\nwhether\t such\tobjection  regarding  the  validity  of\t the<br \/>\nsanction was  raised in\t the trial  Court.  Admittedly,\t the<br \/>\nabove point was not raised in the trial Court nor do we find<br \/>\nanything on  record from which it can be said that the error<br \/>\nor irregularity\t in the sanction (even if we assume that the<br \/>\nfinding of  the High  Court in\tthis regard  is correct) did<br \/>\noccasion any  failure of justice. In that view of the matter<br \/>\nit must be said that the High Court was not at all justified<br \/>\nin acquitting the respondent on the ground that there was no<br \/>\nvalid  sanction\t to  prosecute\thim.  Since  on\t facts,\t the<br \/>\nconcurrent findings  of the Courts below are based on proper<br \/>\nappreciation of evidence and supported by cogent reasons the<br \/>\njudgment of the High Court has got to be reversed.\n<\/p>\n<p>3.   Resultantly,  we  allow  this  appeal,  set  aside\t the<br \/>\nimpugned judgment  and restore\tthe conviction\tand sentence<br \/>\nrecorded against  t he\trespondent by  the trial  Court.
