Masoodi, learned counsel for the petitioner. Shri<br \/>\nD.K. Upadhyay, Chief Standing Counsel appears for the State<br \/>\nrespondents.\n<\/p>\n<p id=\"p_2\">The petitioner is serving as Forest Range Officer in the State<br \/>\nForest Department. By the impugned transfer order dated<br \/>\n18.1.2010 he has been transferred from Barabanki-1, where he<br \/>\nwas awaiting posting to Obera Forest Division as Asstt.<br \/>\nManagement Unit Officer (Anusravan &amp; Mulyankan), JICA<br \/>\nPariyojana.\n<\/p>\n<p id=\"p_3\">It is contended by Shri A.R. Masoodi that in similar writ petition<br \/>\nthis Court passed an order directing the respondents to decide the<br \/>\nrepresentation. He would further submit that since the project is<br \/>\nfunded by Japanese Bank for International cooperation (JBIC), the<br \/>\npetitioner has been transferred to a foreign service or in any case<br \/>\non deputation, without complying with the rules and obtaining his<br \/>\nconsent. He submits that since the petitioner is being sent to be<br \/>\nworked in a project run by the society funded by Japanese Bank<br \/>\nfor International Cooperation, the transfer cannot be treated to be<br \/>\nsimple transfer. The petitioner is being sent on deputation, for<br \/>\nwhich his consent was required. He has also relied upon the order<br \/>\npassed by the Chief Conservator of Forest dated 30th July, 2008 in<br \/>\nwhich it was provided that options be invited from Forest Range<br \/>\nOfficer, Deputy Forest Ranger and Forester to be posted in the<br \/>\nproject.\n<\/p>\n<p id=\"p_4\">Learned Standing Counsel has clarified that in the present case the<br \/>\ntransfer of the petitioner cannot be treated as deputation. The U.P.<br \/>\nParticipatory Forest Management and Poverty Alleviation Project<br \/>\nprovides for two different units namely, the Project Management<br \/>\nUnit and the Divisional Management Unit. The Project<br \/>\nManagement Unit is managed and supervised by a society, of<br \/>\nwhich the Governing Body includes Principal Secretary, Forest<br \/>\n and Chief Conservator of Forest as Chairman and Vice Chairman<br \/>\nand other official members including one member nominated by<br \/>\nthe non-governmental organisation. The Divisional Management<br \/>\nUnit comprises of the officers of the Forest Department. The<br \/>\nDivisional Management Unit is to be created within the office of<br \/>\nthe Divisional Forest Officer (DFO). It is not an extension unit or<br \/>\nsubordinate office of PMU and is not registered as autonomous<br \/>\nbody. It is a devoted project management office within the UPFD<br \/>\nat the divisional level.\n<\/p>\n<p id=\"p_5\">Learned counsel for the petitioner would submit that so far there is<br \/>\nno infrastructure in the project and that the area of operation of the<br \/>\npetitioner&#8217;s work has been increased from a range to a division.\n<\/p>\n<p id=\"p_6\">From the facts placed on record and the submission made by the<br \/>\nChief Standing Counsel we find that the petitioner has been<br \/>\ntransferred to Divisional Management Unit of the project to be<br \/>\nmanned by the officers of the Forest Department. It is a routine<br \/>\ntransfer within the cadre in which question of area of operation<br \/>\nand the infrastructure is not a ground on which the Court may<br \/>\ninterfere. The petitioner has not been sent outside the State Forest<br \/>\nDepartment or his own cadre.\n<\/p>\n<p id=\"p_7\">The State Government has exclusive powers to transfer its officers<br \/>\nas for its own policies, rules and guidelines.\n<\/p>\n<p id=\"p_8\">We further find that the petitioner has been posted in an ambitious<br \/>\nproject of poverty alleviation in the notified forest areas.
