Appellant was present in person at NIC VC facility<br \/>\nat Visakhapatnam, while the respondents \u2015 represented by<br \/>\nShri T.Venugopal, CAPIO \u2015 were present at the same venue.<br \/>\nCommission conducted the hearing from its New Delhi office.\n<\/p>\n<p id=\"p_1\">2.    Appellant, through his RTI-application dated 30.04.2009, had<br \/>\nmade a series of queries regarding recruitment of Traffic Probationary<br \/>\nOfficers Class-II, T.M. Department of Visakhapatnam Port Trust (VPT).<br \/>\nThese queries were 18 in number.\n<\/p>\n<p id=\"p_2\">3.     CPIO furnished reply to the appellant on 21.05.2009 and his<br \/>\nfirst-appeal was decided on 10.07.2009 by the Appellate Authority,<br \/>\nShri Ajeya Kallam, Chairman, Visakhapatnam Port Trust.\n<\/p>\n<p id=\"p_3\">4.     During the hearing, it was noted that information relating to<br \/>\nitems at Sl.Nos.1, 2 and 4 had been furnished to the appellant. In<br \/>\nrespect of queries at Sl.Nos.3 to 13 (except 4), requested information<br \/>\nwas not supplied, because it was claimed that this was held by the<br \/>\nIndian Institute of Foreign Trade (IIFT), who conducted the examination<br \/>\non behalf of the VPT. According to the CPIO, information relating to<br \/>\nqueries at Sl.Nos.14 to 18 was not provided although it was held on the<br \/>\nfiles and records of the public authority.\n<\/p>\n<p id=\"p_4\">5.     Appellant disputed CPIO&#8217;s claim that information relating to any<br \/>\nof his queries was outside the control of the public authority, i.e. VPT.<br \/>\nHe read out from a communication he had received from the IIFT to the<br \/>\neffect that all records relating to the above examination were<br \/>\ntransferred into the control of the public authority, VPT.\n<\/p>\n<p id=\"p_5\">6.    It is not possible to clearly make out as to who really holds the<br \/>\ninformation. It is equally not possible to decide in the course of this<br \/>\nsecond-appeal as to what parts of the information VPT itself holds as<br \/>\nwell as their disclosure liability under the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. These need to be<br \/>\nAT-31032010-05.doc<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                              Page 1 of 2<\/span><br \/>\n decided de-novo after careful consideration and consultation with both<br \/>\nparties by the Appellate Authority.\n<\/p>\n<p id=\"p_6\">7.    It is accordingly directed that matter be remitted back to the<br \/>\nAppellate Authority, Shri Ajeya Kallam, Chairman, Visakhapatnam Port<br \/>\nTrust for de-novo consideration of this entire request for information<br \/>\nand for a finding about who actually holds the information, i.e. whether<br \/>\nthe information was in the control of the third-party, Indian Institute of<br \/>\nForeign Trade or whether that Institute had transferred the information<br \/>\nalready to the VPT. Appellate Authority should also apply his mind to<br \/>\nthe point as made by the CPIO that a part of the information was<br \/>\navailable with the VPT, but was not disclosed to the appellant. The<br \/>\nreasons for not disclosing the information need to be clearly brought<br \/>\nout and if the requested information was not covered by any of the<br \/>\nexemption-Sections of the RTI Act, a decision for its disclosure be<br \/>\ntaken.\n<\/p>\n<p id=\"p_7\">8.    Matter is accordingly remitted back to the Appellate Authority<br \/>\nwith the direction that he shall allow a hearing to the appellant as well<br \/>\nas the CPIO and the holders-of-the-information (and if necessary IIFT)<br \/>\nand take a fresh decision regarding disclosure obligation of the<br \/>\nrequested information after de-novo consideration.\n<\/p>\n<p id=\"p_8\">9.     Appeal disposed of with these directions.\n<\/p>\n<p id=\"p_9\">10.
