(Oral)\n<\/pre>\n<p id=\"p_1\">              Ram Gopal has filed this petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> of Code of<br \/>\nCriminal Procedure (for short, <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.) for quashing of FIR No. 170 dated<br \/>\n9.7.2008, under <a href=\"\/doc\/1667388\/\" id=\"a_2\">sections 419<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_3\">420<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_4\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_5\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_6\">471<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_7\">201<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_8\">120-B<\/a> IPC, Police<br \/>\nStation Division No. 5, Ludhiana (Annexure P\/1) lodged by respondent No.<br \/>\n2 Sudesh Kumar Sood.\n<\/p>\n<p id=\"p_1\">              Affidavit of respondent no. 2 complainant filed today in Court<br \/>\nalong with copy of compromise is taken on record.\n<\/p>\n<p id=\"p_2\">              Learned counsel for respondent no. 2, on instructions from<br \/>\nrespondent no. 2, who is also present in person in Court states that parties<br \/>\nhave effected compromise dated 22.7.2009, copy Annexure-X placed today<br \/>\non record and therefore, respondent no. 2 has no objection to the quashing<br \/>\nof the FIR.    Affidavit of respondent no. 2 to the same effect has also been<br \/>\nfiled today in Court.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-20982 of 2008                              -2-<\/span><\/p>\n<p id=\"p_3\">            In appropriate cases, FIR can be quashed on the basis of<br \/>\ncompromise by exercising power under <a href=\"\/doc\/1679850\/\" id=\"a_9\">section 482<\/a> Cr.P.C., even if the<br \/>\noffences are not compoundable. It was so held by Full Bench of this Court<br \/>\nin the case of <a href=\"\/doc\/811682\/\" id=\"a_10\">Kulwinder Singh vs State of Punjab<\/a>, 2007 (3) Law Herald<br \/>\n(Punjab &amp; Haryana) 2225.\n<\/p>\n<p id=\"p_4\">            In the instant case,   the dispute was regarding the property of<br \/>\nbrother of respondent no. 2.    The said dispute has been amicably settled.<br \/>\nThe petitioner has been compensated by paying him Rs 15 lacs.            The<br \/>\npetitioner has given his claim of disputed property and will not claim any<br \/>\nright on the basis of alleged Will of the deceased brother of respondent no.\n<\/p>\n<p id=\"p_5\">2.   It is, accordingly, a fit case in which FIR should be quashed.\n<\/p>\n<p id=\"p_6\">            In view of the aforesaid, the instant petition is allowed and the<br \/>\nimpugned FIR No. 170 dated 9.7.2008, under <a href=\"\/doc\/1667388\/\" id=\"a_11\">sections 419<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_12\">420<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_13\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_14\">468<\/a>,<br \/>\n<a href=\"\/doc\/1466184\/\" id=\"a_15\">471<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_16\">201<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_17\">120-B<\/a> IPC, Police Station Division No. 5, Ludhiana (Annexure<br \/>\nP\/1) is quashed along with all consequential proceedings arising therefrom.<\/p>\n<pre id=\"pre_1\">\n\n\n\n\n                                                       ( L.N.
