No.35603 of 2011\n                 Munna Kumar, son of Sri Motilal Chauhan, resident of village-Barahni, P.S.-\n                 Siwan (Mufassil), District-Siwan.                  ...........Petitioner.\n                                          Versus\n                 The State of Bihar                                 ..........Opp. Party.\n                                        -----------\n<\/pre>\n<p id=\"p_1\">2   21.10.2011                   Heard learned counsel for the petitioner and learned<\/p>\n<p>                       counsel appearing on behalf of the State.\n<\/p>\n<p id=\"p_1\">                                 The petitioner apprehends his arrest in connection with a<\/p>\n<p>                       case in which cognizance has been taken for the offence punishable<\/p>\n<p>                       under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Section 323<\/a>, <a href=\"\/doc\/1101188\/\" id=\"a_1\">379<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_2\">498A<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> of the Indian Penal Code and<\/p>\n<p>                       <a href=\"\/doc\/751411\/\" id=\"a_4\">Sections 3<\/a> and <a href=\"\/doc\/1023340\/\" id=\"a_5\">4<\/a> of the Dowry Prohibition Act.\n<\/p>\n<p id=\"p_2\">                                 It is stated that there is no truth behind the allegation of<\/p>\n<p>                       subjecting the complainant to any sort of cruelty for non-<\/p>\n<p>                       fulfillment of demand of dowry. As a matter of fact the<\/p>\n<p>                       complainant was never willing to live with the petitioner. She left<\/p>\n<p>                       her matrimonial house only three days after the marriage without<\/p>\n<p>                       informing anyone. The petitioner and his family members were<\/p>\n<p>                       under serious threat due to the alleged incident. Subsequently, his<\/p>\n<p>                       uncle informed that that complainant is residing at Delhi with her<\/p>\n<p>                       brother. An information regarding the same was given to the<\/p>\n<p>                       concerned police station in Delhi. The police recovered the<\/p>\n<p>                       complainant and took her statement. In support to the aforesaid<\/p>\n<p>                       contention Annexure-2 &amp; 3 has been brought on record.<\/p>\n<p id=\"p_3\">                                 Considering the aforesaid facts and circumstances of the<\/p>\n<p>                       case, let the petitioner, namely Munna Kumar in the event of his<\/p>\n<p>                       arrest or surrender before the Court below within a period of four<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>          weeks from the date of receipt\/communication of this order, be<\/p>\n<p>          released on bail on furnishing bail bonds of Rs. 5,000\/- (Five<\/p>\n<p>          thousand only) with two sureties of the like amount each to the<\/p>\n<p>          satisfaction of the learned Sub-Divisional Judicial Magistrate,<\/p>\n<p>          Saran at Chapra in connection with Complaint Case No. 2160 of<\/p>\n<p>          2010 subject to the conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_6\">Section 438(2)<\/a><\/p>\n<p>          Cr.
