Respondents.\n\n                                     -----------\n<\/pre>\n<p>3.     16.8.2010             Heard counsel for the petitioner, counsel for the<\/p>\n<p>                    State as also counsel for the University.<\/p>\n<p>                             The prayer of the petitioner in this writ petition<\/p>\n<p>                    reads as follows:-\n<\/p>\n<blockquote><p>                                       &#8220;(a) For quashing the letter bearing<br \/>\n                             Memo No. 8330-34\/C dated 28.6.2002 issued<br \/>\n                             by Respondent no. 5 by which the pay<br \/>\n                             fixation of the petitioner has been made in the<br \/>\n                             pay scale of Rs.975 to 1540 with effect from<br \/>\n                             7.1.1994 without considering the objection of<br \/>\n                             the petitioner and for quashing vide letter No.<br \/>\n                             8122-65\/2126 dated 8.7.2000 by which the<br \/>\n                             pay scale of the petitioner was fixed in the<br \/>\n                             scale of Rs.975-1540.<\/p><\/blockquote>\n<p>                                       (b) For issuance of an appropriate<br \/>\n<span class=\"hidden_text\">                    -2-<\/span><\/p>\n<p>         writ commanding the respondents for<br \/>\n         payment of salary of the petitioner in the pay<br \/>\n         scale of rS.1500-2750 on the basis of Vth. Pay<br \/>\n         Revision replacement scale of rs.785-1210 in<br \/>\n         which scale the petitioner was appointed and<br \/>\n         consider his case for adjustment on the<br \/>\n         sanctioned vacant post of office Assistant on<br \/>\n         which post, he is working since his initial<br \/>\n         appointment and he holds full qualification<br \/>\n         for the same.\n<\/p>\n<p>                   (C) For directing the respondents in<br \/>\n         the alternative to fix his pay in the scale of<br \/>\n         Rs.1200 to 1800 from the date of his<br \/>\n         appointment on the compassionate ground if<br \/>\n         Govt. letter No. 14\/M\/1-0202\/94-1326<br \/>\n         (Annexure-11) dated 21.8.1995 is found to be<br \/>\n         applicable in the case of petitioner.&#8221;\n<\/p>\n<p>         Learned counsel for the petitioner would submit<\/p>\n<p>that true it is that the petitioner was appointed on<\/p>\n<p>compassionate ground on the post of routine clerk by the<\/p>\n<p>University but then there has been an apparent anomaly by<\/p>\n<p>way of pay fixation when the 5th Pay Revision Committee<\/p>\n<p>report was sought to be implemented by the University. He<\/p>\n<p>would explain that the petitioner was drawing his salary in<\/p>\n<p>the pay scale of Rs.785-1210 but in the revised pay scale his<\/p>\n<p>salary was fixed in the pay scale of Rs.975-1540. According<\/p>\n<p>to counsel for the petitioner this was revised pay scale of Rs.<\/p>\n<p>535-765\/- and the petitioner was entitled for revision of his<\/p>\n<p>salary in the pay scale of Rs.1500-2750\/-.<br \/>\n<span class=\"hidden_text\">                      -3-<\/span><\/p>\n<p>           The issue, in fact, was quite simple inasmuch as all<\/p>\n<p>that was to be seen as to what the Government notification<\/p>\n<p>had provided while fixing pay-scale of the post of routine<\/p>\n<p>clerk which was earlier being paid salary in the pay scale of<\/p>\n<p>Rs.785-1210. This job could have been done either by the<\/p>\n<p>State Government or by the University or by both by<\/p>\n<p>providing the notification in their counter affidavit but then<\/p>\n<p>such has been no longer the practice because this writ<\/p>\n<p>petition after being filed on 25.2.2004 and despite order<\/p>\n<p>dated 18.1.2006 is still awaiting the filing of the counter<\/p>\n<p>affidavit. It has taken four years for this case to have its turn<\/p>\n<p>again and now when this case has been placed for final<\/p>\n<p>disposal in the year 2010 there is again same usual prayer of<\/p>\n<p>adjourning the case for enabling the respondents to file<\/p>\n<p>counter affidavit. This can no longer be continued much less<\/p>\n<p>allowed.\n<\/p>\n<p>           This Court, therefore, would direct both the State<\/p>\n<p>Government and the University to consider the grievance of<\/p>\n<p>the petitioner and pass a reasoned order with regard to<\/p>\n<p>entitlement of the petitioner for grant of pay-scale of<\/p>\n<p>Rs.1500-2750\/-. It is made clear that the petitioner will be<br \/>\n<span class=\"hidden_text\">                   -4-<\/span><\/p>\n<p>only entitled for payment of the pay scale of        post of<\/p>\n<p>Routine Clerk as was revised by the State Government for<\/p>\n<p>the university employees from time to time. The<\/p>\n<p>petitioner,however, would not be given any higher scale of<\/p>\n<p>pay because the Principal of the College had chosen to take<\/p>\n<p>some work of post of accountant, cashier or Assistant from<\/p>\n<p>the petitoner. The petitioner&#8217;s right therefore would only<\/p>\n<p>flow from his order of appointment which as noted above,<\/p>\n<p>has been made on the post of routine clerk.<\/p>\n<p>        While deciding the case of the petitioner, the<\/p>\n<p>University and the Government must examine the plea of<\/p>\n<p>the petitioner that in other Universities Routine Clerks have<\/p>\n<p>already been given the pay scale of Rs.1500-2750 or none<\/p>\n<p>has been subjected to same fixation of pay to which the<\/p>\n<p>petitioner or other Routine Clerks by virtue of being an<\/p>\n<p>employee of Lalit Narain Mithila University was fixed in<\/p>\n<p>the pay-scale of Rs.975-1540\/-.\n<\/p>\n<p>        In order to expedite the matter, this Court would<\/p>\n<p>give liberty to the petitioner to file his self-contained<\/p>\n<p>representation addressed to the Registrar of Lalit Narain<\/p>\n<p>Mithila University and the Registrar on receipt of such<br \/>\n<span class=\"hidden_text\">                       -5-<\/span><\/p>\n<p>representation will examine the case of the petitioner and if<\/p>\n<p>he finds that anomaly in the pay fixation of the petitioner<\/p>\n<p>was on account of fault on the part of the University<\/p>\n<p>officials, he would direct for its correction, but then if he<\/p>\n<p>would find that the petitioner&#8217;s pay scale of Rs.975-1540\/-<\/p>\n<p>was in consonance with the government decision, he would<\/p>\n<p>refer the case of the petitioner with his comments to the<\/p>\n<p>Director Higher Education who then would take a final<\/p>\n<p>decision keeping in view the practice which has been<\/p>\n<p>followed in other universities. It would be however open for<\/p>\n<p>the Director, Higher Education to either grant the petitioner<\/p>\n<p>the same pay-scale which is being given to the counter part<\/p>\n<p>Routine Clerks in the other Universities or reduce the pay<\/p>\n<p>scale of all the Routine Clerk given higher pay-scale despite<\/p>\n<p>the government notification of paying the salary of the post<\/p>\n<p>of routine clerk in the pay-scale of Rs.975 to 1540 w.e.f.<\/p>\n<p>1.1.1986. A clear decision in the case of the petitioner either<\/p>\n<p>by the University or by the State Government or by both of<\/p>\n<p>them must be taken strictly in accordance with law within a<\/p>\n<p>period of six months from the date of receipt\/production of a<\/p>\n<p>copy of this order.\n<\/p>\n<p><span class=\"hidden_text\">                               -6-<\/span><\/p>\n<p>                   In the event, the petitioner is found entitled to<\/p>\n<p>          monetary benefit; the payment thereof must also be paid to<\/p>\n<p>          him in next three months from passing of such order.
