Nanda, learned counsel for the<br \/>\nappellant as well as Mr. K. S. Johal, learned counsel for<br \/>\nthe respondents.\n<\/p>\n<p id=\"p_2\">2. This Letters Patent Appeal registers a challenge to<br \/>\nthe judgment and order dated 16.11.2010 passed by<br \/>\n<span class=\"hidden_text\" id=\"span_1\">2<\/span><br \/>\nthe Writ Court in OWP no. 235\/2010 by which the<br \/>\nlearned Single Judge disposed of the writ petition<br \/>\npreferred by the appellant as the writ petitioner<br \/>\nupholding the order of Jammu and Kashmir Special<br \/>\nTribunal, Jammu (for short the Tribunal), whereby<br \/>\nrespondent Nos. 1 &amp; 2 herein (hereinafter referred to<br \/>\nas the respondents) were given liberty to use their<br \/>\nhouses for commercial purposes.\n<\/p>\n<p id=\"p_3\">3. The factual matrix of the case, in brief, is that the<br \/>\nrespondents, being husband and wife respectively, are<br \/>\nthe owners of plot of land being No. 69 adjoining to B.<br \/>\nC. Road, Jammu, which is bifurcated in two parts, one<br \/>\npart is 2915 sq. ft. in area, when the other part covers<br \/>\nan area of 2773 sq. ft. In the year 2003, the<br \/>\nrespondents, with an object to construct the residential<br \/>\nhouses, applied for grant of building permission from<br \/>\nthe appellant, for which sanction was accorded vide<br \/>\ntwo orders dated 16.8.2003 and 28.7.2004<br \/>\nrespectively.\n<\/p>\n<p id=\"p_4\">4. The respondents raised the construction in<br \/>\nrespective portions in the year 2003 and 2004 strictly<br \/>\nin accordance with the building permission.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">3<\/span><\/p>\n<p id=\"p_5\">5. Master Plan 2021 has been brought into force by<br \/>\nthe Government vide Order No. 263 dated 9.8.2004,<br \/>\nwhich permits the use of land at B. C. Road both for<br \/>\nresidential and commercial purposes.\n<\/p>\n<p id=\"p_6\">6. In pursuance of Master Plan 2021, with a view to<br \/>\nrun the commercial activities in their respective houses,<br \/>\nthe respondents submitted an application to the<br \/>\nappellant on 7.4.2006 for grant of permission. When<br \/>\nappellant did not respond for three years to the said<br \/>\napplication, the respondents initiated a writ proceeding,<br \/>\nbeing OWP no. 560\/2009 along with CMP no. 741\/2001<br \/>\nin this Court wherein directions to the appellant were<br \/>\nsought to grant permission to the respondents for using<br \/>\ntheir residential houses for commercial purposes in<br \/>\nterms of new Master Plan.\n<\/p>\n<p id=\"p_7\">7. The learned Single Judge by its order dated<br \/>\n21.5.2009, passed in the CMP above mentioned,<br \/>\ndirected the appellant to take a decision on the said<br \/>\napplication filed by the respondents within a timeframe<br \/>\nof four weeks.\n<\/p>\n<p id=\"p_8\">8. For facility of reference, interim order dated<br \/>\n21.5.2009 is quoted hereunder:-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">4<\/span><\/p>\n<p id=\"p_9\">Notice and appearance as<br \/>\nabove.\n<\/p>\n<p id=\"p_10\">It seems that the petitioners<br \/>\nhave under No: 263 dated 9.8.2004<br \/>\nfiled an application before the<br \/>\nCommissioner, Municipal Corporation,<br \/>\nJammu for grant of<br \/>\npermission for using raised<br \/>\nconstruction for commercial<br \/>\npurposes. No decision thereon has<br \/>\nbeen taken till date. The<br \/>\nrespondent, Municipal Corporation<br \/>\nshall take decision on the said<br \/>\napplication within four weeks. Result<br \/>\nbe communicated to the petitioner.<br \/>\nFurther completion of the<br \/>\nconstruction in terms of the earlier<br \/>\napproved site plan is not opposed<br \/>\nbut shall be raised strictly in<br \/>\naccordance with the approved plan,<br \/>\nif not otherwise barred and shall be<br \/>\nunder the close supervision of the<br \/>\nMunicipal Officers so that no<br \/>\ndeviation from the actual plan is<br \/>\nmade by the petitioner. Objections,<br \/>\nif any, within the notice period.\n<\/p>\n<p id=\"p_11\">9. In compliance of the said direction, while taking<br \/>\ndecision on the application of the respondents, the<br \/>\nappellant by its order dated 15.7.2009 rejected the<br \/>\nprayer of the respondents, who sought permission for<br \/>\nuse of their residential premises for commercial<br \/>\nactivities and in rejecting such prayer, the appellant<br \/>\nrecorded the reasoning as under:-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">5<\/span><\/p>\n<p id=\"p_12\">Whereas the application of S.\n<\/p>\n<p id=\"p_13\">Darshan Singh and Smt. Manjeet<br \/>\nKour for raising construction for<br \/>\ncommercial purpose has been<br \/>\nconsidered in terms of directions of<br \/>\nthe Honble High Court and the<br \/>\nsame has been found as, without<br \/>\nmerits due to the reason that the<br \/>\nbuilding raised for commercial<br \/>\npurposes necessarily should<br \/>\nhave adequate space for parking<br \/>\nof vehicles which in the instant<br \/>\ncase does not exist, as the said<br \/>\napplicants have not kept<br \/>\nprovisions of parking of the<br \/>\nvehicles required in the<br \/>\nproposed Building.(emphasis<br \/>\nsupplied) More so the cases of<br \/>\nBuilding Permissions for commercial<br \/>\npurposes which are bound to<br \/>\ngenerate additional, traffic as per<br \/>\nthe existing rules need to be<br \/>\nreferred to UTEIC for ensuring that<br \/>\nsuch of the areas which are already<br \/>\novercrowded do not further hamper<br \/>\nthe traffic movement and effect the<br \/>\nconvenience of general public<br \/>\nadversely. The instant case of<br \/>\nbuilding permission is located at<br \/>\nB. C. Road Highway near Rehari<br \/>\nCrossing which is already<br \/>\ncongested and overcrowded,<br \/>\n(emphasis supplied) as such, the<br \/>\npermission for converting residential<br \/>\nbuilding to commercial use cannot<br \/>\nbe considered without sufficient<br \/>\nprovision of parking in the proposed<br \/>\nconstruction.\n<\/p>\n<p id=\"p_14\">10. Aggrieved by the above action of appellant, the<br \/>\nrespondents again approached the Tribunal.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">6<\/span><\/p>\n<p id=\"p_15\">11. The Tribunal by its order dated 31.12.2009<br \/>\ndisposed of the appeal filed by the respondents by<br \/>\npassing a well reasoned order. The Tribunal exclusively<br \/>\ndealt with the entire factual scenario and found that the<br \/>\nappellant was not justified in refusing permission for the<br \/>\nuse of plot in question for commercial purposes on the<br \/>\ngrounds of lack of space for Car parking as well as B. C.<br \/>\nRoad adjoining to the Plot in question being already<br \/>\ncongested and overcrowded. Consequently, the Tribunal<br \/>\nobserved that the respondents were at liberty to use<br \/>\ntheir houses for commercial purposes.\n<\/p>\n<p id=\"p_16\">12. The findings of the Tribunal is being assailed by<br \/>\nthe appellant in the Writ Court by initiating the instant<br \/>\nwrit proceedings.\n<\/p>\n<p id=\"p_17\">13. The learned Single Judge, while affirming the<br \/>\nTribunals findings, held that the appellant failed to<br \/>\nconsider the availability of the space for parking of Cars<br \/>\nwhich was primary reason for rejecting the permission<br \/>\nfor the purpose of commercial use of the plot in<br \/>\nquestion. Agreeing with the views expressed by the<br \/>\nTribunal and having scrupulously examined the core<br \/>\n<span class=\"hidden_text\" id=\"span_5\">7<\/span><br \/>\nissue of space requirement for car parking, the learned<br \/>\nSingle Judge held as under:-\n<\/p>\n<p id=\"p_18\">The learned Tribunal has correctly<br \/>\nappreciated the matter and while<br \/>\nreferring to Master Plan of 2021 and<br \/>\nGovt. order No. 263 dated 9.8.2004, has<br \/>\ndealt with the objection of the petitioner<br \/>\nvis-`-vis lack of space for parking and<br \/>\nhas opined that at page 97 of the Master<br \/>\nPlan 2021, for an area of 1999 sft, there<br \/>\nshall be parking area for 1 = cars. On<br \/>\nthe said analogy learned Tribunal has<br \/>\nopined that as per sanction plan,<br \/>\n<span class=\"hidden_text\" id=\"span_6\">respondent No. 1 (petitioner No. 1<\/span><br \/>\ntherein) has a total area of 2915 sft and<br \/>\nafter covering the area under building,<br \/>\nthe open area remains 1457.9 sft, thus<br \/>\nthere is a space for parking 4.5 cars and<br \/>\n<span class=\"hidden_text\" id=\"span_7\">in the case of respondent No. 2<\/span><br \/>\n(petitioner No. 2 therein), there is an<br \/>\nopen area of 1291 sft, so a space for<br \/>\nparking 4 cars. The learned Tribunal<br \/>\nwhile noticing the said details, has<br \/>\nobserved that the petitioners have not<br \/>\nconsidered the matter in its right<br \/>\nperspective.\n<\/p>\n<p id=\"p_19\">Learned counsel for the petitioner,<br \/>\nwhen confronted with the stated position,<br \/>\ncould not convince the Court as to how<br \/>\nthe authorities took decision about the<br \/>\nlack of space for car parking. Therefore,<br \/>\nthe order passed by the learned Tribunal<br \/>\nimpugned to the extent leaving the<br \/>\nrespondents at liberty to use their houses<br \/>\nfor commercial purposes as permissible<br \/>\nunder Master Plan 2021, cannot be<br \/>\ninterfered with.\n<\/p>\n<p id=\"p_20\">14. Having meticulously scrutinised the material<br \/>\nplaced before us including the impugned judgment and<br \/>\n<span class=\"hidden_text\" id=\"span_8\">8<\/span><br \/>\norders of the Tribunal as well as of the Writ Court, it is<br \/>\nseen that the appellant rejected the prayer of the<br \/>\nrespondents for granting permission for use of the land<br \/>\nin question basically on two grounds: (a) there was no<br \/>\nadequate space for parking of vehicles as required for<br \/>\nusing the building for commercial purpose; and (b) B.<br \/>\nC. Road, by the side of which building in question did<br \/>\nsituate, was already congested and overcrowded.\n<\/p>\n<p id=\"p_21\">15. From close scrutiny of the order of the Tribunal<br \/>\ndated 31.12.2009 and the impugned judgment and<br \/>\norder dated 16.11.2010, it is abundantly clear that the<br \/>\nWrit Court wholly concurred with the findings of the<br \/>\nTribunal which having thoroughly examined the records<br \/>\nincluding the new Master Plan 2021, unmistakably held<br \/>\nthat there was no space constraint as regards the<br \/>\nparking of vehicles taking into account the space area<br \/>\nof the plot in question owned and possessed by the<br \/>\nrespondents observing further that since the B. C. Road<br \/>\nwas declared to be a commercial area under the new<br \/>\nMaster Plan, permission for use of the building in the<br \/>\narea for commercial use, could not be refused.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">9<\/span><\/p>\n<p id=\"p_22\">16. Situated thus, we are of the firm opinion that<br \/>\nsince, ex facie, it is a matter of concurrent finding of<br \/>\nfacts of both the Tribunal as well as of the Writ Court,<br \/>\nthere is no justification for this Writ Appellate Court to<br \/>\ninterfere with the same.\n<\/p>\n<p id=\"p_23\">17. The Supreme Court in a case of <a href=\"\/doc\/1261900\/\" id=\"a_1\">Kewal Krishan<br \/>\nGupta v. Jammu and Kashmir Special Tribunal and<br \/>\nothers<\/a>, reported in AIR 2005 SC 2578, relying on the<br \/>\nview taken by High Powered Body, in paragraph 15, it<br \/>\nwas clearly held that the commercial activities could be<br \/>\npermitted alongside the B. C. Road. In that case, a<br \/>\nquestion arose as to whether commercial activities could<br \/>\nbe permitted by the side of the B.C. Road which was<br \/>\nshown as residential zone in the Master Plan. Paragraph<br \/>\n4 and relevant portion of paragraph 15 of the cited case<br \/>\nwould be necessary to be noticed:<br \/>\n4. It is the case of the<br \/>\nappellant that although B. C. Road<br \/>\nwas shown as residential zone in the<br \/>\nMaster Plan, factually and<br \/>\npredominantly, most of the<br \/>\nproperties situated at B. C. Road<br \/>\nwere being used for commercial<br \/>\npurposes. The buildings on the said<br \/>\nroad used for commercial purposes<br \/>\nbelonged not only to private<br \/>\nparties, but also consisted of several<br \/>\nGovernment offices as well as banks<br \/>\n<span class=\"hidden_text\" id=\"span_10\">10<\/span><br \/>\nand public sector undertakings. In<br \/>\nthe appeal memo, the appellant has<br \/>\nnamed a large number such<br \/>\ncommercial entities, which were<br \/>\nusing buildings along the B. C. Road<br \/>\nat the time of lease deed was<br \/>\nentered into.\n<\/p>\n<p id=\"p_24\">15. ..It was precisely for this<br \/>\nreason that the High Powered body<br \/>\ntook the view that commercial<br \/>\nactivities could be permitted at<br \/>\nselected points along the said road<br \/>\nand opined B.C. Road is totally<br \/>\ncommercial at present and to thrust<br \/>\nresidential activity on the area<br \/>\nwould be putting cart before the<br \/>\nhorse. In areas like B. C. Road<br \/>\nwhenever there is an application for<br \/>\ngrant of B.P. the applicant submits a<br \/>\nplan for residential purposes where<br \/>\nin fact he has commercial activity in<br \/>\nmind. This results in loss of revenue<br \/>\nto the Jammu Municipality<br \/>\n\/J.D.A.\/J&amp;K. Housing Board together<br \/>\nwith hassle of unauthorized<br \/>\nconstructions, it was, therefore,<br \/>\ndecided in the meeting to come-up<br \/>\nwith a proposal where areas like<br \/>\nB.C. Road would be identified so<br \/>\nthat the same is submitted to the<br \/>\nGovernment for issuing necessary<br \/>\nmodification in the land use as<br \/>\nenvisaged in the Master Plan<br \/>\napproved by the Government in<br \/>\n1978.\n<\/p>\n<p id=\"p_25\">18. This Court in a case of Building Operation<br \/>\nAuthority v. Smt. Jyoti Singh, (OWP no. 778\/05<br \/>\ndisposed of on 22.4.2006), relying on Kewal Krishan<br \/>\nGuptas case (supra), categorically held that B. C.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_11\">11<\/span><\/p>\n<p id=\"p_26\">Road, by the side of which the plot in question situated,<br \/>\nwas declared to be a commercial area under the new<br \/>\nMaster Plan.\n<\/p>\n<p id=\"p_27\">19. Having regard to the above judicial decisions as<br \/>\nwell as upon careful consideration of the facts and<br \/>\ncircumstances of the case in its totality, we find no<br \/>\nplausible or cogent reason to demolish the concurrent<br \/>\nfindings of the Writ Court as well of the Tribunal.\n<\/p>\n<p id=\"p_28\">20. The appeal stands dismissed.\n<\/p>\n<p id=\"p_29\">21. There shall be no order as to costs.<br \/>\n(Mansoor Ahmad Mir) (Dr. Aftab H.
