Heard Mr. S. S. Nanda, learned counsel for the
\nappellant as well as Mr. K. S. Johal, learned counsel for
\nthe respondents.\n<\/p>\n
2. This Letters Patent Appeal registers a challenge to
\nthe judgment and order dated 16.11.2010 passed by
\n2<\/span>
\nthe Writ Court in OWP no. 235\/2010 by which the
\nlearned Single Judge disposed of the writ petition
\npreferred by the appellant as the writ petitioner
\nupholding the order of Jammu and Kashmir Special
\nTribunal, Jammu (for short the Tribunal), whereby
\nrespondent Nos. 1 & 2 herein (hereinafter referred to
\nas the respondents) were given liberty to use their
\nhouses for commercial purposes.\n<\/p>\n
3. The factual matrix of the case, in brief, is that the
\nrespondents, being husband and wife respectively, are
\nthe owners of plot of land being No. 69 adjoining to B.
\nC. Road, Jammu, which is bifurcated in two parts, one
\npart is 2915 sq. ft. in area, when the other part covers
\nan area of 2773 sq. ft. In the year 2003, the
\nrespondents, with an object to construct the residential
\nhouses, applied for grant of building permission from
\nthe appellant, for which sanction was accorded vide
\ntwo orders dated 16.8.2003 and 28.7.2004
\nrespectively.\n<\/p>\n
4. The respondents raised the construction in
\nrespective portions in the year 2003 and 2004 strictly
\nin accordance with the building permission.\n<\/p>\n
3<\/span><\/p>\n
5. Master Plan 2021 has been brought into force by
\nthe Government vide Order No. 263 dated 9.8.2004,
\nwhich permits the use of land at B. C. Road both for
\nresidential and commercial purposes.\n<\/p>\n
6. In pursuance of Master Plan 2021, with a view to
\nrun the commercial activities in their respective houses,
\nthe respondents submitted an application to the
\nappellant on 7.4.2006 for grant of permission. When
\nappellant did not respond for three years to the said
\napplication, the respondents initiated a writ proceeding,
\nbeing OWP no. 560\/2009 along with CMP no. 741\/2001
\nin this Court wherein directions to the appellant were
\nsought to grant permission to the respondents for using
\ntheir residential houses for commercial purposes in
\nterms of new Master Plan.\n<\/p>\n
7. The learned Single Judge by its order dated
\n21.5.2009, passed in the CMP above mentioned,
\ndirected the appellant to take a decision on the said
\napplication filed by the respondents within a timeframe
\nof four weeks.\n<\/p>\n
8. For facility of reference, interim order dated
\n21.5.2009 is quoted hereunder:-\n<\/p>\n
4<\/span><\/p>\n
Notice and appearance as
\nabove.\n<\/p>\n
It seems that the petitioners
\nhave under No: 263 dated 9.8.2004
\nfiled an application before the
\nCommissioner, Municipal Corporation,
\nJammu for grant of
\npermission for using raised
\nconstruction for commercial
\npurposes. No decision thereon has
\nbeen taken till date. The
\nrespondent, Municipal Corporation
\nshall take decision on the said
\napplication within four weeks. Result
\nbe communicated to the petitioner.
\nFurther completion of the
\nconstruction in terms of the earlier
\napproved site plan is not opposed
\nbut shall be raised strictly in
\naccordance with the approved plan,
\nif not otherwise barred and shall be
\nunder the close supervision of the
\nMunicipal Officers so that no
\ndeviation from the actual plan is
\nmade by the petitioner. Objections,
\nif any, within the notice period.\n<\/p>\n
9. In compliance of the said direction, while taking
\ndecision on the application of the respondents, the
\nappellant by its order dated 15.7.2009 rejected the
\nprayer of the respondents, who sought permission for
\nuse of their residential premises for commercial
\nactivities and in rejecting such prayer, the appellant
\nrecorded the reasoning as under:-\n<\/p>\n
5<\/span><\/p>\n
Whereas the application of S.\n<\/p>\n
Darshan Singh and Smt. Manjeet
\nKour for raising construction for
\ncommercial purpose has been
\nconsidered in terms of directions of
\nthe Honble High Court and the
\nsame has been found as, without
\nmerits due to the reason that the
\nbuilding raised for commercial
\npurposes necessarily should
\nhave adequate space for parking
\nof vehicles which in the instant
\ncase does not exist, as the said
\napplicants have not kept
\nprovisions of parking of the
\nvehicles required in the
\nproposed Building.(emphasis
\nsupplied) More so the cases of
\nBuilding Permissions for commercial
\npurposes which are bound to
\ngenerate additional, traffic as per
\nthe existing rules need to be
\nreferred to UTEIC for ensuring that
\nsuch of the areas which are already
\novercrowded do not further hamper
\nthe traffic movement and effect the
\nconvenience of general public
\nadversely. The instant case of
\nbuilding permission is located at
\nB. C. Road Highway near Rehari
\nCrossing which is already
\ncongested and overcrowded,
\n(emphasis supplied) as such, the
\npermission for converting residential
\nbuilding to commercial use cannot
\nbe considered without sufficient
\nprovision of parking in the proposed
\nconstruction.\n<\/p>\n
10. Aggrieved by the above action of appellant, the
\nrespondents again approached the Tribunal.\n<\/p>\n
6<\/span><\/p>\n
11. The Tribunal by its order dated 31.12.2009
\ndisposed of the appeal filed by the respondents by
\npassing a well reasoned order. The Tribunal exclusively
\ndealt with the entire factual scenario and found that the
\nappellant was not justified in refusing permission for the
\nuse of plot in question for commercial purposes on the
\ngrounds of lack of space for Car parking as well as B. C.
\nRoad adjoining to the Plot in question being already
\ncongested and overcrowded. Consequently, the Tribunal
\nobserved that the respondents were at liberty to use
\ntheir houses for commercial purposes.\n<\/p>\n
12. The findings of the Tribunal is being assailed by
\nthe appellant in the Writ Court by initiating the instant
\nwrit proceedings.\n<\/p>\n
13. The learned Single Judge, while affirming the
\nTribunals findings, held that the appellant failed to
\nconsider the availability of the space for parking of Cars
\nwhich was primary reason for rejecting the permission
\nfor the purpose of commercial use of the plot in
\nquestion. Agreeing with the views expressed by the
\nTribunal and having scrupulously examined the core
\n7<\/span>
\nissue of space requirement for car parking, the learned
\nSingle Judge held as under:-\n<\/p>\n
The learned Tribunal has correctly
\nappreciated the matter and while
\nreferring to Master Plan of 2021 and
\nGovt. order No. 263 dated 9.8.2004, has
\ndealt with the objection of the petitioner
\nvis-`-vis lack of space for parking and
\nhas opined that at page 97 of the Master
\nPlan 2021, for an area of 1999 sft, there
\nshall be parking area for 1 = cars. On
\nthe said analogy learned Tribunal has
\nopined that as per sanction plan,
\nrespondent No. 1 (petitioner No. 1<\/span>
\ntherein) has a total area of 2915 sft and
\nafter covering the area under building,
\nthe open area remains 1457.9 sft, thus
\nthere is a space for parking 4.5 cars and
\nin the case of respondent No. 2<\/span>
\n(petitioner No. 2 therein), there is an
\nopen area of 1291 sft, so a space for
\nparking 4 cars. The learned Tribunal
\nwhile noticing the said details, has
\nobserved that the petitioners have not
\nconsidered the matter in its right
\nperspective.\n<\/p>\n
Learned counsel for the petitioner,
\nwhen confronted with the stated position,
\ncould not convince the Court as to how
\nthe authorities took decision about the
\nlack of space for car parking. Therefore,
\nthe order passed by the learned Tribunal
\nimpugned to the extent leaving the
\nrespondents at liberty to use their houses
\nfor commercial purposes as permissible
\nunder Master Plan 2021, cannot be
\ninterfered with.\n<\/p>\n
14. Having meticulously scrutinised the material
\nplaced before us including the impugned judgment and
\n8<\/span>
\norders of the Tribunal as well as of the Writ Court, it is
\nseen that the appellant rejected the prayer of the
\nrespondents for granting permission for use of the land
\nin question basically on two grounds: (a) there was no
\nadequate space for parking of vehicles as required for
\nusing the building for commercial purpose; and (b) B.
\nC. Road, by the side of which building in question did
\nsituate, was already congested and overcrowded.\n<\/p>\n
15. From close scrutiny of the order of the Tribunal
\ndated 31.12.2009 and the impugned judgment and
\norder dated 16.11.2010, it is abundantly clear that the
\nWrit Court wholly concurred with the findings of the
\nTribunal which having thoroughly examined the records
\nincluding the new Master Plan 2021, unmistakably held
\nthat there was no space constraint as regards the
\nparking of vehicles taking into account the space area
\nof the plot in question owned and possessed by the
\nrespondents observing further that since the B. C. Road
\nwas declared to be a commercial area under the new
\nMaster Plan, permission for use of the building in the
\narea for commercial use, could not be refused.\n<\/p>\n
9<\/span><\/p>\n
16. Situated thus, we are of the firm opinion that
\nsince, ex facie, it is a matter of concurrent finding of
\nfacts of both the Tribunal as well as of the Writ Court,
\nthere is no justification for this Writ Appellate Court to
\ninterfere with the same.\n<\/p>\n
17. The Supreme Court in a case of Kewal Krishan
\nGupta v. Jammu and Kashmir Special Tribunal and
\nothers<\/a>, reported in AIR 2005 SC 2578, relying on the
\nview taken by High Powered Body, in paragraph 15, it
\nwas clearly held that the commercial activities could be
\npermitted alongside the B. C. Road. In that case, a
\nquestion arose as to whether commercial activities could
\nbe permitted by the side of the B.C. Road which was
\nshown as residential zone in the Master Plan. Paragraph
\n4 and relevant portion of paragraph 15 of the cited case
\nwould be necessary to be noticed:
\n4. It is the case of the
\nappellant that although B. C. Road
\nwas shown as residential zone in the
\nMaster Plan, factually and
\npredominantly, most of the
\nproperties situated at B. C. Road
\nwere being used for commercial
\npurposes. The buildings on the said
\nroad used for commercial purposes
\nbelonged not only to private
\nparties, but also consisted of several
\nGovernment offices as well as banks
\n10<\/span>
\nand public sector undertakings. In
\nthe appeal memo, the appellant has
\nnamed a large number such
\ncommercial entities, which were
\nusing buildings along the B. C. Road
\nat the time of lease deed was
\nentered into.\n<\/p>\n
15. ..It was precisely for this
\nreason that the High Powered body
\ntook the view that commercial
\nactivities could be permitted at
\nselected points along the said road
\nand opined B.C. Road is totally
\ncommercial at present and to thrust
\nresidential activity on the area
\nwould be putting cart before the
\nhorse. In areas like B. C. Road
\nwhenever there is an application for
\ngrant of B.P. the applicant submits a
\nplan for residential purposes where
\nin fact he has commercial activity in
\nmind. This results in loss of revenue
\nto the Jammu Municipality
\n\/J.D.A.\/J&K. Housing Board together
\nwith hassle of unauthorized
\nconstructions, it was, therefore,
\ndecided in the meeting to come-up
\nwith a proposal where areas like
\nB.C. Road would be identified so
\nthat the same is submitted to the
\nGovernment for issuing necessary
\nmodification in the land use as
\nenvisaged in the Master Plan
\napproved by the Government in
\n1978.\n<\/p>\n
18. This Court in a case of Building Operation
\nAuthority v. Smt. Jyoti Singh, (OWP no. 778\/05
\ndisposed of on 22.4.2006), relying on Kewal Krishan
\nGuptas case (supra), categorically held that B. C.\n<\/p>\n
11<\/span><\/p>\n
Road, by the side of which the plot in question situated,
\nwas declared to be a commercial area under the new
\nMaster Plan.\n<\/p>\n
19. Having regard to the above judicial decisions as
\nwell as upon careful consideration of the facts and
\ncircumstances of the case in its totality, we find no
\nplausible or cogent reason to demolish the concurrent
\nfindings of the Writ Court as well of the Tribunal.\n<\/p>\n
20. The appeal stands dismissed.\n<\/p>\n
21. There shall be no order as to costs.
