C.,Chandra Narayan Tripathi\n\nHon'ble Sanjay Misra,J.\n<\/pre>\n<p id=\"p_1\">Heard Sri Indal Singh, learned counsel for the petitioner and<br \/>\nlearned Standing Counsel for the State-respondents.\n<\/p>\n<p id=\"p_1\">The petitioner alleges to be an Assistant Teacher in Science<br \/>\nsubject in Junior High School, Heta Patti, Block Bahariya.<br \/>\nPrimarily, the grievance is against the transfer of the petitioner<br \/>\nfrom Junior High School, Heta Patti, Block Bahariya to Junior<br \/>\nHigh School, Badaura, as also the order dated 17.11.2009<br \/>\n(Annexure-12 to the Writ Petition) whereby the representation of<br \/>\nthe petitioner has been turned down by the Basic Siksha Parishad.<br \/>\nLearned counsel for the petitioner has submitted that under the<br \/>\ninstruction a Junior High School must have one Head Master, one<br \/>\nteacher in language and one teacher in Science subject and further<br \/>\na teacher in Science subject of a Junior High School should not be<br \/>\ntransferred as Head Master of a primary school. The petitioner<br \/>\nalleges violation of the first instruction referred to above by saying<br \/>\nthat upon the transfer of petitioner from Junior High School, Heta<br \/>\nPatti, Block Bahariya to Junior High School, Badaura, the Junior<br \/>\nHigh School, Heta Patti, Block Bahariya, is now left with no<br \/>\nScience teacher, therefore, he ought not to have been transferred.<br \/>\nThe second contention is that one Smt. Sweta Singh was<br \/>\nmentioned in the list dated 31.07.2009 at Serial No.132 to be<br \/>\nposted\/adjusted at Junior High School, Badaura, but by the order<br \/>\ndated 17.08.2009 (Annexure No.5 to the writ petition) the Basic<br \/>\nSiksha Adhikari, Allahabad, has made a correction and placed the<br \/>\npetitioner in place of Smt. Sweta Singh and as such the same is<br \/>\nalso illegal and cannot be upheld.\n<\/p>\n<p id=\"p_2\">Having considered the submission of learned counsel for the<br \/>\npetitioner and upon perusal of the record it appears that in Junior<br \/>\nHigh School, Badaura, there is a Head Master, a teacher in<br \/>\nlanguage subject and the petitioner as teacher for Science subject.<br \/>\nIn the impugned order dated 17.11.2009 it was found that there<br \/>\nwere four teachers working in Junior High School, Heta Patti,<br \/>\nBlock Bahariya, and the petitioner being the senior most having<br \/>\nstayed for the longest period was transferred to Junior High<br \/>\nSchool, Badaura, as Science teacher. Consequently, insofar as the<br \/>\n Junior High School, Badaura, is concerned it has a Head Master, it<br \/>\nhas a teacher in language and it has the petitioner as teacher for<br \/>\nScience subject. The submission that by transferring the petitioner<br \/>\nthe Junior High School at Heta Patti, Block Bahariya, does not<br \/>\nhave a Science teacher is not a ground to interfere in the order of<br \/>\nadjustment of teachers at Junior High School, Badaura.<br \/>\nConsequently, insofar as the above submission is concerned it<br \/>\ncannot help the petitioner in any manner in challenging the<br \/>\nimpugned order as also the order whereby the petitioner had been<br \/>\nadjusted at Junior High School, Badaura.\n<\/p>\n<p id=\"p_3\">Insofar as the other submission of the petitioner that by the order<br \/>\ndated 17.08.2009 correction has been made illegally in the list<br \/>\ndated 31.07.2009 is concerned, this Court finds that Smt. Sweta<br \/>\nSingh was a teacher in language and by the order dated 31.07.2009<br \/>\nshe was sent to Junior High School, Badaura, which then had two<br \/>\nteachers of language and no teacher of Science subject.<br \/>\nConsequently, the list dated 31.07.2009 was corrected by the Basic<br \/>\nSiksha Adhikari by his order dated 17.08.2009 and removed the<br \/>\nsecond language teacher from the Junior High School, Badaura,<br \/>\nand placed the petitioner who is a Science teacher in place of Smt.<br \/>\nSweta Singh. The aforesaid order is in consonance with the<br \/>\ninstructions that every Junior High School must have a Head<br \/>\nMaster, a language teacher and a Science teacher. Consequently,<br \/>\nthe second submission is also merit-less and cannot be upheld.
