SHTROHAN THAKUR @ ROHAN THAKUR, SON OF ALTE AMIR THAKUR\n    BOTH RESIDENT OF VILLAGE SRIPUR, POLICE STATION BARIYARPUR,\n    DISTRICT SARAN\n    ....................................................................................PETITIONERS\n                                VERSUS\n                          THE STATE OF BIHAR\n                                 ********\n<\/pre>\n<p id=\"p_1\">2      28\/07\/2011              Heard Counsel for the petitioners and the<\/p>\n<p>                    A.P.P. appearing on behalf of the State.<\/p>\n<p id=\"p_1\">                               This application has been filed against the<\/p>\n<p>                    order dated 10.06.2008 passed in Bariyarpur Police<\/p>\n<p>                    Station Case No. 51 of 2000 (Sessions Trial No. 58 of<\/p>\n<p>                    2000 by which the Additional Sessions Judge, Fast<\/p>\n<p>                    Track Court No. I, Saran at Chapra has refused to<\/p>\n<p>                    discharge the petitioners for the offences alleged to have<\/p>\n<p>                    been committed under <a href=\"\/doc\/140515\/\" id=\"a_1\">Section 313<\/a>, <a href=\"\/doc\/1317800\/\" id=\"a_1\">314<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_2\">201<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_3\">120B<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_4\">34<\/a><\/p>\n<p>                    of the Indian Penal Code.\n<\/p>\n<p id=\"p_2\">                               The allegation is that Binda Thakur had<\/p>\n<p>                    illicit relationship with Jonhi Kumari, as a result of<\/p>\n<p>                    which she became pregnant. It is said that Binda<\/p>\n<p>                    Kumari got the lady aborted which resulted in the death<\/p>\n<p>                    of Jonhi Kumari.\n<\/p>\n<p id=\"p_3\">                               Another case being Baniyapur Police Station<\/p>\n<p>                    Case No. 60 of 2000 was instituted by the brother of the<\/p>\n<p>                    deceased lady, in which it is alleged that the informant<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           2<\/span><\/p>\n<p>        of Baniyapur Police Station Case No. 51 of 2000, who is<\/p>\n<p>        also the Chowkidar, took a sum of Rs. 2,000\/- for<\/p>\n<p>        allowing the informant to burn the dead body of his<\/p>\n<p>        sister.\n<\/p>\n<p id=\"p_4\">                   It is submitted on behalf of the petitioners<\/p>\n<p>        that the informant i.e. the brother of Jonhi Kumari has<\/p>\n<p>        stated that the deceased died due to stomach pain.<\/p>\n<p id=\"p_5\">                   This fact may be brought to the notice of the<\/p>\n<p>        Court below during the trial of the case. At this stage, I<\/p>\n<p>        do not find any reason to interfere with the order<\/p>\n<p>        impugned. This application is accordingly dismissed.<\/p>\n<p id=\"p_6\">                   This Court however observes that Baniyapur<\/p>\n<p>        Police Station Case No. 60 of 2000 should be expedited<\/p>\n<p>        and if possible, committed. If it is committed, the<\/p>\n<p>        charges should be framed within a period of three<\/p>\n<p>        months from the date of commitment, and after<\/p>\n<p>        commitment, both the cases may be heard side by side,<\/p>\n<p>        provided that there is no legal impediment in expediting<\/p>\n<p>        Baniyapur Police Station Case No. 60 of 2000.<\/p>\n<p id=\"p_7\">                   This application is disposed of with the<\/p>\n<p>        aforesaid observations and directions.<\/p>\n<pre id=\"pre_1\">Anand                                         (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bhrigu Thakur &amp; Anr vs State Of Bihar on 28 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
