Ms Harsha Dewani, learned A.G.P. waives<br \/>\n     service of notice of rule on behalf of respondent no.1.<br \/>\n     Mr.   H.S.Munshaw, learned Counsel waives service of<br \/>\n     notice of rule on behalf of respondent no.2.\n<\/p>\n<p id=\"p_11\">     At the request of learned Advocates appearing for<br \/>\n     the parties, the petition is heard today.<br \/>\n By means of filing this petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<br \/>\n226<\/a> of the Constitution, the petitioner has prayed to<br \/>\nissue an appropriate writ or order directing the District<br \/>\nDevelopment Officer,Kheda District Panchayat at Nadiad to<br \/>\nexercise powers under section 59 ofthe Gujarat Panchayats<br \/>\nAct,1993 and to pass final order in accordance with law<br \/>\nin the interest of justice.\n<\/p>\n<p id=\"p_12\">From the averments made in the petition, it is<br \/>\nevident that in Special Civil Application no.  8079\/96<br \/>\ndecided by the Court (Coram: M.S.Parikh,J.) on October<br \/>\n23,1996 following direction was given :-\n<\/p>\n<p id=\"p_13\">&#8220;The grievance in this petition is about delay in<br \/>\nproceeding    u\/s.59(1)   of   the   Gujarat   Panchayats<br \/>\nAct,1993.It is expected that the said proceedings are<br \/>\nexpeditiously heard and decided.      However, except to<br \/>\nobserve so, no indulgence can be shown.<br \/>\nIn view of above      observation,Mr.D.M.Thakkar,<br \/>\nlearned advocate for the petitioner seeks to withdraw<br \/>\nthis petition.Permission to withdraw granted.     Disposed<br \/>\nof accordingly. No order as to costs.&#8221;\n<\/p>\n<p id=\"p_14\">Mr.D.M.Thakkar,   learned   Counsel    for    the<br \/>\npetitioner has stated at the bar that though hearing is<br \/>\nconcluded, respondent no.2 has not passed any orders. It<br \/>\nis not in dispute that respondent no.2 has not passed any<br \/>\norders on the application dated August 17,1996.     Under<br \/>\nthe circumstances, prayer made in the petition deserves<br \/>\nto be granted.\n<\/p>\n<p id=\"p_15\">For the foregoing reasons, the petition partly<br \/>\nsucceeds.   Respondentno.2 is directed to pass final<br \/>\norders in accordance with law as early as possible and<br \/>\nlatest within ten days from the date of receipt of the<br \/>\norder. Office is directed to send copy of this order to<br \/>\nrespondent no.2 immediately. It will also be open to the<br \/>\npetitioner to produce a copy of this order before<br \/>\nrespondent no.2 for necessary compliance.
