Katni by which an\napplication filed by the petitioner under <a href=\"\/doc\/487818\/\" id=\"a_1\">Section         65<\/a> of the\nEvidence Act, was rejected.\n(2)    The facts of the case are that the petitioner sought\npermission of the trial Court to produce secondary evidence in\nrespect of mutual partition deed. Copy of which is available on\nrecord. It is alleged by the petitioner that it is a forged and\nfabricated document and the original is in possession of\ndefendant no.1. As the defendant no.1 had not produced original\npartition deed, the petitioner moved an application on 15.5.2009\nto permit the petitioner to adduce secondary evidence in respect\nof mutual partition deed. The trial Court rejected the prayer.\n(3)    From the perusal of this document which is on record, it\nappears that this partition deed relates to partition of various\nimmovable properties including house property, certain lands and\na well. The document on stamp of Rs.10\/- is an unregistered\ndocument. The document was not on proper stamp. A question\nwhether a document which is not          on proper stamp can be\npermitted to be proved by secondary evidence came up for\nconsideration before the Apex Court in <a href=\"\/doc\/1142196\/\" id=\"a_1\">Jupudi Kesava Rao vs.\nPulavarthi Venkata Subbarao and others<\/a>(1971)1 SCC 545, in\nwhich the apex Court considering the question held thus:\n        \"13. The first limb of <a href=\"\/doc\/1034981\/\" id=\"a_2\">Section 35<\/a> clearly shuts out\n        from evidence any instrument chargeable with\n        duty unless it is duly stamped. The second limb of\n        it which relates to acting upon the instrument will\n        obviously shut out any secondary evidence of\n        such instrument, for allowing such evidence to be\n        let in when the original admittedly chargeable with\n        duty was not stamped or insufficiently stamped,\n                  WP No.5341\/2010\n\n\nBadri Prasad                   Ram Kripal and others\n\n\n\n\nwould be tantamount to the document being acted\nupon by the person having by law or authority to\nreceive evidence. Proviso (a) is only applicable\nwhen the original instrument is actually before the\nCourt of law and the deficiency in stamp with\npenalty is paid by the party seeking to rely upon\nthe document. Clearly secondary evidence either\nby way of oral evidence of the contents of the\nunstamped document or the copy of it covered by\n<a href=\"\/doc\/1456410\/\" id=\"a_3\">Section 63<\/a> of the Indian Evidence Act would not\nfulfil the requirements of the proviso which enjoins\nupon the authority to receive nothing in\nevidence .except the instrument itself. <a href=\"\/doc\/494844\/\" id=\"a_4\">Section 25<\/a>\nis not concerned with any copy of an instrument\nand a party can only be allowed to rely on a\ndocument which is an instrument for the purpose\nof <a href=\"\/doc\/1034981\/\" id=\"a_5\">Section 35<\/a>. \"Instrument\" is defined in <a href=\"\/doc\/1893993\/\" id=\"a_6\">Section\n2(14)<\/a> as including every document by which any\nright or liability is, or purports to be created,\ntransferred, limited, extended, extinguished or\nrecorded. There is no scope for inclusion of a copy\nof a document as an instrument for the purpose of\nthe <a href=\"\/doc\/74910796\/\" id=\"a_7\">Stamp Act<\/a>.\n\n 14. If <a href=\"\/doc\/1034981\/\" id=\"a_8\">Section 35<\/a> only deals with original\n instruments and not copies <a href=\"\/doc\/1730374\/\" id=\"a_9\">Section 36<\/a> cannot be\n so interpreted as to allow secondary evidence of\n an instrument to have its benefit. The words \"an\n instrument\" in <a href=\"\/doc\/1730374\/\" id=\"a_10\">Section 36<\/a> must have the same\n meaning as that in <a href=\"\/doc\/1034981\/\" id=\"a_11\">Section 35<\/a>. The legislature\n only relented from the strict provisions of <a href=\"\/doc\/1034981\/\" id=\"a_12\">Section\n 35<\/a> in cases where the original instrument was\n admitted in evidence without objection at the initial\n stage of a suit or proceeding. In other words,\n although the objection is based on the\n insufficiency of the stamp affixed to the document,\n a party who has a right to object to the reception\n of it must do so when the document is first\n tendered. Once the time for raising objection to\n the admission of the documentary evidence is\n passed, no objection based on the same ground\n can be raised at a later stage. But this in no way\n extends the applicability of <a href=\"\/doc\/1730374\/\" id=\"a_13\">Section 36<\/a> to\n secondary evidence adduced or sought to be\n adduced in proof           of the contents of a\n document which is unstamped or insufficiently\n stamped.\n                                 WP No.5341\/2010\n\n\n              Badri Prasad                    Ram Kripal and others\n\n\n\n\n               15. The above is our view on the question of\n               admissibility of secondary evidence of a\n               document which is unstamped or insufficiently\n               stamped, as if the matter were res integra. It may\n               be noted, however, that the course of decisions in\n               India in the Indian High Courts, barring one or two\n               exceptions, have consistently taken the same\n               view.\"\n      (4)    In view of the settled position by the Apex Court in Jupudi\n      Kesava Rao (supra), there is no iota of doubt that photo copy of\n      a document which is on insufficient stamp cannot be impounded\n      and secondary evidence of such document cannot be permitted.\n      In view of the aforesaid,the trial Court has not committed any error\n      of jurisdiction in rejecting the application filed under <a href=\"\/doc\/487818\/\" id=\"a_14\">Section 65<\/a> of\n      the Evidence Act.
