I \"  ,\n\nThis MFA coming on for hearing' this day,\"-.l:thel\"VCourE'.o:A  \n\ndelivered the following:\n\nJvneuewrl\n\nThis appeal is  the 'elaimantlseeking\nenhancement of  'by.l\"l*:bhallenging the\njudgment   C No.250 \/ 2006\n\ndated        Ikaichur.\n  of the case are that, on\n\nl.5.2_0(_)5,  V_elai;*:1a:::_t Yellappa along with Abdul Ma\ufb01d\n\n-' v ,.uwerelp1%.or:eedingHfro'i'i1IManvi to Raiehur on Motor Cycle\n\n and Abdul Majid was riding\n\nthe'--~..rnotor:tiyole and Yellappa was the pillion rider. At\n\n wleboutll pm. when they were near 7111 mile cross of\n\nI  Raiel'1ur -- Lingasugur road, 181 respondent drove the\n\n  ~~-tempo trax bearing No.KA--36\/M-866 from Raichur side\n\n from the opposite direction and dashed against the\nmotor Cycle. Conteending that he had suffered\n\n2%-\n\n:1\u00bb\n\n\n\nperrlianent disability on aceotlnt. of the accidental\n\ninjuries, the claimant Yeliapag filed the claim \n\nseeking compensation on various heads.\n\n3. On service of notice, the~.\u00bbinsurance'-:coii'i~petnyt.v \nappeared and contested the matter. \n\nrivai pleadings, the tribunaiifreirned the  * L'\n\nfor its consideration: \n\n[U\n\n\"U  \n\n(iii)\n\nWhether the  due to rash\nand   KA--36 A\/I-866\n  of the motorcycle\nby..:\u00a3;?Ivqir}\u00a73i;ifzts'~tr:t;r1s\u00e9\u00a7f\"c5r\"eoth?\n\n  had driving licence?\n\n\\rVheVther* ciainiants had SL\u00a7[f\u20acT\u20acd injuries in the\n\nE  ' said accident?\n\n claimants are entitled for\n\n'-cempensation? If so, how much and from\n\n. who m?\n\n TV)\n\n'What order or award?\n\n4. in support of his case, claimant examined\n\nhimself as\n\nPW1 and one Dr.Harish Murthy  PW3 and\n\nSi\nX',\n\n\n\n   \n\n_ 4 AL\nAbdul Majid as PW2 and got marked exhibits P1 to P14,\n\nwhile t.he respondents let in evidence of RW1. On the\nbasis of the material on record, the tribunal awarded\n\ncompensation of Rs.73,000\/~, but however, deducted\n\n50% of the aforesaid compensation on the grourid.l:'tha--t'\n\nAbdul Majid, rider of the vehicle on which   *\n\nwas pillion rider had contributed~'t'o the   it\n\nthereby a sum of Rs.36,500\/-- only__  inteAre~sVt \n\nrate of 6% per annum was awarded. Beingaggiiiel\ufb01ed by V\n\nthe said judgment arid.\/._awar.dl, has preferred\n\nthis ap_peal\u00a7' w _ Raf' 3\n pl  counsel for the appellant\nand , learned ._:Vcou'ns\"el 'Thor the respondent\/ insurance\n\n 'contended on behalf of the appellant that\n\nthe\"\u00ab\u00ab..tribuna~1lwas not right in deducting 50% of the\n\n._c..o7&lt;nperis.ation in the compensation awarded towards\n\nll  &quot;contributory negligence of the rider of the vehicle when\n\n  fact, the claimant was neither the rider nor the owner\n\nof the vehicle, but he was a pilliori rider. He further\ncontends that the award of compensation on various\n\n*2\u00bb\n\n,.y-\n\n\n\nheads are on the lower side and that no award has been\n\nmade on the head &#039;loss of future earning capaci_t.y&#039;l_i\u00bb~a:n.d\n\ntherefore, this is a fit case where Compensa.tir\u00a7)_nl&#039;hVas.. _\n\nbe enhanced.   \n\n7. Per contra, supporting \n\naward, counsel for the insuran;(:eV_co1npaIiyVVsiulhrn1vts..that\nthe same does not eall  &#039;i&#039;nter.f.erer1._ee_\ufb01\u00a7in this\nappeal. A l V l\n8. Hav11}g.}lc:ard on both the\nsides, the   Wconsideration:\n{il    justified in deducting\n  awarded to the\n ground that the rider of the\n   which claimant was proceeding\nV &#039;  rider was negligent?\ndfii) ,.__v&#039;Whlether the claimant is entitled to additional\n\n Compensation&#039;?\n\n  From the material on record it is evident that\n\n   tribunal has held that the rider of the motor cycle\n\nnamely Abdul Majid and the driver of the tempo trax\n\nbearing No.KA--36\/M-866 were equally negligent in\nas\n\n\n\nM6-\n\ncontributing to the accident, therefore, negligence has\n\nbeen apportioried 50% on them. However, the \n\nfailed to notice that the claimant\/ appellant  _\n\nrider. Therefore, merely because he...was the&quot;pillion;=ride1i_ \n\nand did not in any way contribL1te&#039;1.to1th*e 11eg1i&#039;ge&#039;1:ce,l&#039;0&#039;thef.i\n\ntribunal could not hatred-.,::de_ducAt&#039;ed  \ncompensation awardedgto  reaso,11,,,.that he\nwas proceeding as a  motor cycle.\nTherefore,  dfeducting 50% of\nthe compeIi\u00a7slati&#039;0._n&#039; lb\ufb01\u00e9lllvrexiersed in this appeal\nand   lis_lla&quot;r1swered in favour of the\n\nappellant,&#039; *\n\n,1-0. As faras th-e compensation is concerned, it is\n\nl&quot;seVe&#039;r1lEff*o1r1f._&#039;theHl ttttt &quot;material on record that the\n\n had sustained fracture of shaft of\n\nfeniur   thigh, he was admitted to Bhandari\n\n0&#039; _ai1o,spital&#039;&quot;at Raichur where he was in the hospital for\n\n.0  about three months and he underwent surgery and nail\n\n &quot;&quot;vVas inserted.
