That appeal is preferred from<br \/>\nthe order dated 05.08.2010 of Joint Charity Commissioner, whereby<br \/>\nconditional permission to sell the property of the Trust to the<br \/>\npetitioner herein is granted. Learned counsel for the petitioner<br \/>\nsubmitted that, even as the petitioner does not propose to sell away,<br \/>\nalienate or transfer possession of the immovable property in the near<br \/>\nfuture, the impugned order to maintain status quo could come<br \/>\nin the way of development of the land, resulting into unnecessary<br \/>\nloss. Therefore, the petition is moved to set aside the impugned<br \/>\norder, but in fact only the order to maintain status quo was sought<br \/>\nto be modified so as to permit development of the land, which is<br \/>\nbought by the petitioner after making full payment exceeding Rs.76<br \/>\nlakhs.\n<\/p>\n<p id=\"p_1\">2.\tIt<br \/>\nwas fairly conceded that, apparently, the impugned order was only<br \/>\nadmitting the appeal and the order to maintain status quo was<br \/>\nrestricted to the date on which another order is made.  Therefore, it<br \/>\nis open for the petitioner to make appropriate application to the<br \/>\nTribunal either for expeditious hearing of the appeal itself or, if<br \/>\nit is not feasible, to make a fresh suitable order modifying the<br \/>\nimpugned order. As and when such application is made, it will have to<br \/>\nbe duly considered by the Tribunal and the Tribunal may make<br \/>\nappropriate order in accordance with law after affording to the<br \/>\nparties opportunity of being heard. Under such circumstances, it is<br \/>\nneither necessary nor in the interest of justice to entertain the<br \/>\npresent petition in spite of appropriate alternative remedy being<br \/>\navailable to the petitioner.
