Block, Shalimar Bagh,\n                                             Delhi-110088.\n\nRTI application filed on             :   04\/12\/2009\nPIO replied                          :   11\/01\/2010\nFirst appeal filed on                :   27\/01\/2010\nFirst Appellate Authority order      :   18\/02\/2010\nSecond Appeal received on            :   13\/05\/2010\nDate of Notice of Hearing            :   18\/05\/2010\nHearing Held on                      :   16\/06\/2010\n\n             Information Sought:                      Public Information Officer's (PIO) reply:\n\n<\/pre>\n<p id=\"p_1\">i) Reason for the transfer of the Appellant from   The said information is not covered under Section<br \/>\nRPVV Shalimar Bagh to SKV Khajori Khas.            2(f) of RTI ACT, 2005.\n<\/p>\n<p id=\"p_2\">ii) Copy of the notings\/recommendations made       The information falls under Section 8(e) of the<br \/>\nby the Principal, RPVV Shalimar Bagh for the       RTI ACT, 2005 and hence cannot be provided.<br \/>\ntransfer of the Appellant.\n<\/p>\n<p id=\"p_3\">Grounds for the First Appeal:\n<\/p>\n<p id=\"p_4\">Unsatisfactory information provided by the PIO<\/p>\n<p>Order of the First Appellate Authority (FAA):\n<\/p>\n<p id=\"p_5\">The FAA found that the information provided by the PIO was satisfactory and hence disposed off the<br \/>\nAppeal.\n<\/p>\n<p id=\"p_6\">Grounds for the Second Appeal:\n<\/p>\n<p id=\"p_7\">Unsatisfactory information provided the PIO and unfair disposal of the appeal by the FAA.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                            Page 1 of 2<\/span><\/p>\n<p id=\"p_8\"> Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_9\">The following were present:\n<\/p>\n<p id=\"p_10\">Appellant: Ms. Vijita;\n<\/p>\n<p id=\"p_11\">Respondent: Ms. Neena Kumari, Public Information Officer &amp; Dy. Director;\n<\/p>\n<p id=\"p_12\">        The PIO has denied giving the information on query-1 on the ground that the reasons for<br \/>\ntransfer are not information as defined under <a href=\"\/doc\/1516599\/\" id=\"a_1\">Section 2(f)<\/a> of the RTI Act. If there are any reasons on<br \/>\nthe record these must be provided since these form a record held by the public authority. However, if<br \/>\nthere are no reasons on the record this should be stated.\n<\/p>\n<p id=\"p_13\">         The PIO has refused to give information on query-2 claiming that recommend for transfers<br \/>\nfalls in the ambit of <a href=\"\/doc\/1001313\/\" id=\"a_1\">Section 8(1)<\/a> (e) of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. <a href=\"\/doc\/1494553\/\" id=\"a_3\">Section 8(1)(e)<\/a> of the RTI Act exempts,<br \/>\n&#8220;information available to a person in his fiduciary relationship, unless the competent authority is<br \/>\nsatisfied that the larger public interest warrants the disclosure of such information;&#8221;<br \/>\nFor <a href=\"\/doc\/1494553\/\" id=\"a_4\">Section 8(1)(e)<\/a> of the RTI Act to apply there must be a fiduciary relationship and the holder of<br \/>\ninformation must hold the information in his fiduciary capacity. The traditional definition of a<br \/>\nfiduciary is a person who occupies a position of trust in relation to someone else, therefore requiring<br \/>\nhim to act for the latter&#8217;s benefit within the scope of that relationship. In business or law, we generally<br \/>\nmean someone who has specific duties, such as those that attend a particular profession or role, e.g.<br \/>\nfinancial analyst or trustee. The information must be given by the holder of information when there is a<br \/>\nchoice- as when a litigant goes to a particular lawyer, or a patient goes to particular doctor. It is also<br \/>\nnecessary that the principal character of the relationship is the trust placed by the provider of<br \/>\ninformation in the person to whom the information is given. An equally important characteristic for the<br \/>\nrelationship to qualify as a fiduciary relationship is that the provider of information gives the<br \/>\ninformation for using it for the benefit of the giver. All relationships usually have an element of trust,<br \/>\nbut all of them cannot be classified as fiduciary. Only that information can be considered as &#8220;available<br \/>\nto a person in his fiduciary relationship&#8221;, which is available to a person in an explicit relationship of<br \/>\ntrust (typically that of a lawyer, medical practitioner of financial advisor), where the trustee has been<br \/>\ngiven access to the information on the mutual understanding that it is solely to be used for protecting<br \/>\nthe interests or promoting the welfare of the person giving the information, and where the withholding<br \/>\n(or not proactively making public) of such information is not contrary to the law of the land.<br \/>\nIn the instant case the requirements of fiduciary relationship cannot be established. The<br \/>\nRecommendation made by Principal on the basis of which a transfer is made is not given in the<br \/>\nfiduciary capacity since the information is not to be used for the benefit of the principal who gave this.<br \/>\nIn view of this the exemption claimed under <a href=\"\/doc\/1001313\/\" id=\"a_5\">section 8(1)<\/a> (e) by the PIO is struck down.\n<\/p>\n<p id=\"p_14\">Hence the information on query-2 must be supplied to the appellant.
