BASANT, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                  Crl.M.C.No. 4967 of 2008\n                 - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 19th day of December, 2008\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">      The petitioner faces indictment in a prosecution under the<\/p>\n<p>provisions of the <a href=\"\/doc\/1136195\/\" id=\"a_1\">Copyright Act<\/a>. Cognizance has been taken on<\/p>\n<p>the basis of the final report submitted after due investigation.<\/p>\n<p>She has entered appearance through counsel before the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p id=\"p_1\">      2. The petitioner has come to this court now with a prayer<\/p>\n<p>that the prosecution launched against her may be quashed<\/p>\n<p>invoking the extra ordinary inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section<\/p>\n<p>482<\/a> Cr.P.C. According to her, the allegations against her are<\/p>\n<p>groundless and she does not deserve to stand the trauma of a<\/p>\n<p>protracted trial.\n<\/p>\n<p id=\"p_2\">      3.   An indictee facing undeserved criminal prosecution<\/p>\n<p>against her can certainly claim premature termination of such<\/p>\n<p>proceedings under law. Normally and ordinarily such premature<\/p>\n<p>termination can be claimed by invoking the ordinary provisions<a href=\"\/doc\/445276\/\" id=\"a_2\"><\/p>\n<p>of the Code<\/a>. In an appropriate case where the interests of justice<\/p>\n<p>Crl.M.C.No. 4967 of 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>compellingly demand such course, this Court does of course have the<\/p>\n<p>extra ordinary    inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> Cr.P.C. to<\/p>\n<p>prematurely terminate such proceedings. But such invocation of the<\/p>\n<p>extra ordinary inherent jurisdiction cannot be done as a matter of<\/p>\n<p>course. Sufficient, satisfactory, compelling and exceptional reasons<\/p>\n<p>must be shown to exist justifying the invocation of the powers under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_4\">Section 482<\/a> Cr.P.C. In all other cases parties need only be relegated<\/p>\n<p>to claim premature termination by discharge. In a warrant offence in<\/p>\n<p>which cognizance has been taken on the basis of the final report<\/p>\n<p>submitted by the police, such premature termination can be claimed by<\/p>\n<p>discharge under <a href=\"\/doc\/897083\/\" id=\"a_5\">Section 239<\/a> Cr.P.C. This, I am satisfied, is a fit case<\/p>\n<p>where the petitioner must be relegated to seek premature termination<\/p>\n<p>by resort to the provisions of <a href=\"\/doc\/897083\/\" id=\"a_6\">Section 239<\/a> Cr.P.C.<\/p>\n<p id=\"p_3\">      4.    The learned counsel for the petitioner submits that<\/p>\n<p>unnecessary hardship and inconvenience will result if           personal<\/p>\n<p>presence of the petitioner, a woman, were to be insisted till the plea of<\/p>\n<p>discharge is considered under <a href=\"\/doc\/897083\/\" id=\"a_7\">Section 239<\/a> Cr.P.C. I am satisfied that<\/p>\n<p>appropriate directions can be issued.\n<\/p>\n<p id=\"p_4\">Crl.M.C.No. 4967 of 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      3<\/span><\/p>\n<p id=\"p_5\">      5. This Crl.M.C. is dismissed without any fetter on the right of<\/p>\n<p>the petitioner to claim discharge under <a href=\"\/doc\/897083\/\" id=\"a_8\">Section 239<\/a> Cr.P.C. It is<\/p>\n<p>further directed that until the plea of discharge is considered and a<\/p>\n<p>decision taken,      personal presence of the petitioner shall not be<\/p>\n<p>insisted, if she is represented by a counsel.<\/p>\n<p id=\"p_6\">      6. Hand over the order.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                             (R.
