Justice P.N.RAVINDRAN\n\n Dated :21\/05\/2010\n\n O R D E R\n              J.Chelameswar, C.J. &amp; P.N.Ravindran, J.\n                  ------------------------------------------\n                          W.A.No.630 of 2010\n                  ------------------------------------------\n                Dated this the 21st day of May, 2010\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">J.Chelameswar, C.J.\n<\/p>\n<p id=\"p_1\">            This writ appeal is preferred by the unsuccessful<\/p>\n<p>petitioner in W.P.(C) No.6224 of 2010-C dated 15th March, 2010.<\/p>\n<p id=\"p_2\">            2. The appellant herein availed a loan from the first<\/p>\n<p>respondent Bank and failed to repay the instalments as agreed upon.<\/p>\n<p>Consequentially steps were taken by the respondents for causing<\/p>\n<p>sale of the mortgaged property under the provisions of the<\/p>\n<p>Securitisation  and Reconstruction of             Financial Assets and<\/p>\n<p><a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>, 2002.<\/p>\n<p id=\"p_3\">            3. The appellant had earlier approached this Court by<\/p>\n<p>way of a writ petition which culminated ultimately in W.A.No.64 of<\/p>\n<p>2009. By the said judgment the appellant was directed to repay the<\/p>\n<p>amount outstanding to the Bank in certain instalments, details of<\/p>\n<p>W.A.No.630 of 2010\n<\/p>\n<p id=\"p_4\">                                  &#8211; 2 &#8211;\n<\/p>\n<p id=\"p_5\">which are not necessary for the present purpose.                 By the<\/p>\n<p>judgment under appeal, the learned Judge recorded a finding<\/p>\n<p>that the appellant could not even take advantage of the<\/p>\n<p>abovementioned judgment in W.A.No.64 of 2009 and pay the<\/p>\n<p>amount in accordance with the directions of this Court.<\/p>\n<p id=\"p_6\">            4. In the abovementioned background, the property<\/p>\n<p>of the appellant was auctioned on 20th April, 2009 and the sale<\/p>\n<p>was registered on 23rd December, 2009.<\/p>\n<p id=\"p_7\">            5.    The instant writ petition was filed on 22nd<\/p>\n<p>February, 2010 with two innocuous prayers which read as<\/p>\n<p>follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                  &#8220;a) Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction directing the<\/p>\n<p>           respondent bank to return the documents belonging to<\/p>\n<p>           the petitioner, which is deposited by the petitioner as a<\/p>\n<p>           security to the loan number 30050719410 availed by<\/p>\n<p>           him.<\/p><\/blockquote>\n<p id=\"p_8\">\n<p id=\"p_9\">                  b) Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction directing the<\/p>\n<p>           respondent bank to consider and pass appropriate<\/p>\n<p>W.A.No.630 of 2010\n<\/p>\n<p id=\"p_10\">                                &#8211; 3 &#8211;\n<\/p>\n<p id=\"p_11\">           orders on Ext.P9 representation filed by the petitioner<\/p>\n<p>           before the bank.&#8221;\n<\/p>\n<p id=\"p_12\">            6.    Apart from the various reasons assigned for<\/p>\n<p>dismissing the writ petition, the learned Judge by the judgment<\/p>\n<p>under appeal in paragraph 5 has recorded a finding that the<\/p>\n<p>successful purchaser of the appellant&#8217;s property is not made a<\/p>\n<p>party to the writ petition.  The learned Judge recorded a further<\/p>\n<p>finding that the explanation offered by the appellant for such<\/p>\n<p>non-joinder of necessary party is not acceptable to the Court. It<\/p>\n<p>appears from the records that the Bank had informed the<\/p>\n<p>appellant by letter dated 10.7.2009 that the property which is the<\/p>\n<p>subject matter of dispute in the instant proceedings was<\/p>\n<p>auctioned on 20th April, 2009. By the said letter, the appellant<\/p>\n<p>herein was given a further opportunity to make remittance of the<\/p>\n<p>amount outstanding for a period of 15 days from the date of the<\/p>\n<p>notice with a caution that the property would be registered in the<\/p>\n<p>name of the successful bidder Mr.V.V.Paul without further<\/p>\n<p>notice. Relevant portion of the said letter reads as follows:<\/p>\n<p>W.A.No.630 of 2010\n<\/p>\n<p id=\"p_13\">                                  &#8211; 4 &#8211;\n<\/p>\n<p id=\"p_14\">                  &#8220;With reference to your above letter, kindly<\/p>\n<p>            refer to our letter No.RBO KKD:228-16-19 dated<\/p>\n<p>            08.05.2009.   As you have not complied with the<\/p>\n<p>            orders of the Honourable High Court of Kerala,<\/p>\n<p>            Ernakulam, in the suit Nos.WP(C) No.37416\/2008<\/p>\n<p>            and WA No.64\/2009, the property mortgaged to us<\/p>\n<p>            was auctioned on 20.04.2009 and the property will be<\/p>\n<p>            registered in the name of the bidder very soon.<\/p>\n<p>            Hence, we cannot permit the time sought by you for<\/p>\n<p>            closing the account and if the entire amount is not<\/p>\n<p>            paid within 15 days of this notice the property will be<\/p>\n<p>            registered in the name of the bidder Mr.V.V.Paul,<\/p>\n<p>            without further notice.&#8221;\n<\/p>\n<p id=\"p_15\">            7. The said letter was in the custody of the appellant<\/p>\n<p>on the date of filing of the writ petition. In fact, this letter was<\/p>\n<p>produced as Ext.P7 in the writ petition. In the circumstances,<\/p>\n<p>the explanation offered by the appellant that he was not aware of<\/p>\n<p>either the sale or the information regarding the successful bidder<\/p>\n<p>was rightly rejected by the learned Judge. We do not see any<\/p>\n<p>reason to interfere with the judgment under appeal. On the other<\/p>\n<p>hand, we are of the opinion that the instant litigation is a sheer<\/p>\n<p>W.A.No.630 of 2010\n<\/p>\n<p id=\"p_16\">                              &#8211; 5 &#8211;\n<\/p>\n<p id=\"p_17\">abuse of the process of the court.
