So far as respondent no.5 is concerned, he was owner<br \/>\n\tof the vehicle and his presence would not be required at this stage.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\tpresent appeal arises against the judgement and award passed by the<br \/>\n\tTribunal dated 07.05.2010 in MACP No.58\/09, whereby the Tribunal has<br \/>\n\tawarded compensation of Rs.10,25,000\/- with interest at the rate of<br \/>\n\t8% p.a.<\/p>\n<p>The<br \/>\n\trelevant facts are that on 14.08.2009, when the deceased Rasikbhai<br \/>\n\tHirjibhai was going in luxury bus No.GJ-13B-1217 at about 7.00<br \/>\n\tclock, near village Sokli, the driver lost the control of the bus<br \/>\n\tand the bus was turtled and the deceased Rasikbhai Hirjibhai Patel<br \/>\n\tsustained injury.  Ultimately, he succumbed to the injury. The claim<br \/>\n\tpetition was filed for the compensation of Rs.15,00,000\/- with the<br \/>\n\tTribunal.  The Tribunal proceeded ex parte against the original<br \/>\n\trespondent no.2 Insurance Company appellant herein since after<br \/>\n\tservice of notice, none appeared on its behalf.  Thereafter, the<br \/>\n\tTribunal passed the aforesaid judgement and the award.  It may also<br \/>\n\tbe recorded that as the appellant came to know about the aforesaid<br \/>\n\tex parte judgement and award, it had preferred review application to<br \/>\n\tset aside the ex parte judgement and award and there was delay also<br \/>\n\tin the application for review.  The Tribunal vide order dated<br \/>\n\t01.02.2001, dismissed the said application for condonation of delay<br \/>\n\tin review.  Under the circumstances, the present appeal before this<br \/>\n\tCourt against the judgement and award passed by the tribunal.\n<\/p>\n<p id=\"p_3\">We<br \/>\n\thave heard Mr.Sandeep Shah for the appellant and Mr.Bhut for the<br \/>\n\toriginal claimants who are the main contesting party.\n<\/p>\n<p id=\"p_4\">It<br \/>\n\tis an admitted fact that the appellant insurance company had no<br \/>\n\topportunity to defend the case inasmuch as after the service of the<br \/>\n\tnotice, they could not defend the case.  The explanation submitted<br \/>\n\tis that Ahmedabad Branch was joined as party and the Head Office at<br \/>\n\tChennai was not impleaded as party.  It has also been submitted that<br \/>\n\tHead Office is looking after the court litigation cases and<br \/>\n\ttherefore, as observed earlier, the application for review was<br \/>\n\tfiled, but as there was delay, such delay was not condoned.  Hence,<br \/>\n\tthe appeal.\n<\/p>\n<p id=\"p_5\">Mr.Shah,<br \/>\n\tlearned counsel appearing for the appellant submitted that the<br \/>\n\tappellant is ready to abide by any terms and conditions which may be<br \/>\n\timposed by this Court in the event this Court is inclined to remand<br \/>\n\tthe matter to the Tribunal.\n<\/p>\n<p id=\"p_6\">Whereas<br \/>\n\tMr.Bhut, learned counsel appearing for the respondents-claimants<br \/>\n\tsubmitted that he is leaving the matter to the Court, but Court may<br \/>\n\tdirect the appellant to deposit 50% of the amount and Court may also<br \/>\n\tdirect the appellant to pay the cost since it is on account of the<br \/>\n\tdefault on the part of the appellant, the Tribunal proceeded ex<br \/>\n\tparte and the present litigation before this Court.\n<\/p>\n<p id=\"p_7\">We<br \/>\n\tfind that the appellant was the main contesting party in the claim<br \/>\n\tpetition.  If we consider the reasons recorded in the judgement, it<br \/>\n\tprima facie appears that had the opportunity given to the insurance<br \/>\n\tcompany, the matter could have been further examined on the aspect<br \/>\n\tof income of the deceased.  Further, the insurance company was the<br \/>\n\tmain contesting respondent since the liability was to be borne by it<br \/>\n\tin place of the insured after the award.  Under the circumstances,<br \/>\n\twe are inclined to accept the explanation that the litigation was<br \/>\n\tbeing looked after by the Head Office by taking lenient view of the<br \/>\n\tmatter.  We are inclined to take such lenient view in view of the<br \/>\n\tpeculiar circumstance that the appellant has agreed to abide by any<br \/>\n\tcondition which may be imposed by this Court for deposit of the<br \/>\n\tamount as well as the cost to the original claimants.\n<\/p>\n<p id=\"p_8\">We<br \/>\n\tfind that even if the matter is to be remanded back to the Tribunal<br \/>\n\tfor adjudication, the appellant must deposit 25% of the awarded<br \/>\n\tamount with interest. The awarded amount would come to Rs.11 lakh<br \/>\n\tand more, hence the appellant shall deposit the amount of Rs.3 lakh<br \/>\n\twith the Tribunal.  Further, the appellant should also bear the cost<br \/>\n\tof the litigation of the original claimants and considering the<br \/>\n\tfacts and circumstances, such cost can be quantified at Rs.10,000\/-.\n<\/p>\n<p id=\"p_9\">Mr.\n<\/p>\n<p id=\"p_10\">\tBhut, learned counsel appearing for the respondents submitted that<br \/>\n\tthe Head Office of the appellant Company was not joined as party<br \/>\n\tbefore the Tribunal and the policy was issued by the Ahmedabad<br \/>\n\toffice and therefore, Ahmedabad office of the appellant company was<br \/>\n\trightly impleaded as party and therefore, it was submitted that this<br \/>\n\tCourt may not remand the matter.\n<\/p>\n<p id=\"p_11\">It<br \/>\n\tis true that one of the mode could be of joining Ahmedabad office as<br \/>\n\tparty, but as it has been submitted on behalf of the appellant that<br \/>\n\tthe Court cases and litigations were being looked after by Head<br \/>\n\tOffice and because of communication gap between Ahmedabad and Head<br \/>\n\tOffice, the matter could not be defended well in time, we find that<br \/>\n\tthe discretion can be exercised but that too after deposit of a<br \/>\n\treasonable amount and to further pay cost to the original claimants<br \/>\n\twho cannot be faulted by way of condonation of the default of the<br \/>\n\tappellant.\n<\/p>\n<p id=\"p_12\">Hence,<br \/>\n\tthe impugned judgement and award of the Tribunal is set aside on the<br \/>\n\tcondition that the appellant deposits the amount of Rs.3 lakh with<br \/>\n\tthe Tribunal within four weeks from today and pays the cost of<br \/>\n\tRs.10,000\/- to the claimants within the said period.  After the<br \/>\n\tamount is deposited and the cost is paid, main claim petition shall<br \/>\n\tstand restored to the Tribunal.  The Tribunal shall give an<br \/>\n\topportunity of leading evidence to the parties concerned and<br \/>\n\tthereafter, shall pass the appropriate orders afresh preferably<br \/>\n\twithin a period of six months from taking up of the matter for fresh<br \/>\n\tconsideration.  It is also observed that if the conditions are not<br \/>\n\tcomplied with, appeal shall stand dismissed.\n<\/p>\n<p id=\"p_13\">The<br \/>\n\tamount of Rs.25,000\/- which is already deposited pending the appeal<br \/>\n\tshall be given set off and the amount so deposited as per the<br \/>\n\tpresent judgement shall be subject to the final outcome of the order<br \/>\n\twhich may be passed by the Tribunal.\n<\/p>\n<p id=\"p_14\">Appeal<br \/>\n\tis allowed to the aforesaid extent.
