No. 3134 of 2008\n            -------------------------------------------------\n          Dated this the 19th day of August, 2008\n\n                               ORDER\n<\/pre>\n<p id=\"p_1\">      The petitioner faces indictment in a prosecution for<\/p>\n<p>offences punishable, inter alia, under Sec.3 of the PDPP Act.<\/p>\n<p>Investigation is complete. Final report has already been filed.<\/p>\n<p>Cognizance was taken as early as in 2003 as is evident from<\/p>\n<p>the number assigned to the case &#8211; C.C.No.999\/03.                The<\/p>\n<p>petitioner was shown as absconding.           He was never arrested.<\/p>\n<p>He has not appeared before the learned Magistrate. Reckoning<\/p>\n<p>the petitioner as an absconding accused, coercive processes<\/p>\n<p>have been issued against the petitioner by the learned<\/p>\n<p>Magistrate.    Such processes are chasing the petitioner now.<\/p>\n<p>The petitioner apprehends imminent arrest in execution of<\/p>\n<p>such processes.\n<\/p>\n<p id=\"p_1\">      2. According to the petitioner, he is absolutely innocent.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> Crl.M.C. No. 3134 of 2008 -: 2 :-<\/span><\/p>\n<p>His absence earlier was not wilful or deliberate. The petitioner,<\/p>\n<p>in these circumstances, wants to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail. The petitioner apprehends<\/p>\n<p>that his application for regular bail may not be considered by the<\/p>\n<p>learned Magistrate on merits, in accordance with law and<\/p>\n<p>expeditiously. It is, in these circumstances, that the petitioner<\/p>\n<p>has come to this Court for a direction to the learned Magistrate<\/p>\n<p>to release him on bail when he appears before the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p id=\"p_2\">       3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate    and   explain   to  the   learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate    would    not  consider   the   petitioner&#8217;s<\/p>\n<p>application for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in Alice George v. Deputy Superintendent of Police<\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p id=\"p_3\">      4.   In the result, this Crl.M.C. is dismissed; but with the<\/p>\n<p>observation that if the petitioner surrenders before the learned<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No. 3134 of 2008 -: 3 :-<\/span><\/p>\n<p>Magistrate and seeks bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p id=\"p_4\">     5. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                       (R.
