Justice V.GIRI\n\n Dated :22\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">02\/2008\n\n O R D E R\n                                  V.GIRI,J.\n\n                            -------------------------\n\n                       W.P ( C) No<\/a>. 2698  of 2008\n\n                           --------------------------\n\n                Dated this the 22nd  February, 2008\n\n\n                             J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner,   who   is   presently   working   as   Deputy<\/p>\n<p>Commissioner   in   the   Department   of   Commercial   Taxes,   is<\/p>\n<p>aggrieved   by   the   delay   on   the   part   of   the   Government   in<\/p>\n<p>effecting promotions to the post of Joint Commissioner ,  in spite<\/p>\n<p>of   vacancies   existing   in   that   post   from   1.7.2006.     Petitioner&#8217;s<\/p>\n<p>claim in that behalf was directed to be considered by this Court<\/p>\n<p>as per the order in I.A.14226 of 2007 in W.P(C)No.9989 of 2005.\n<\/p>\n<p id=\"p_1\">Government   considered   the   petitioner&#8217;s   case   and   rejected   it<\/p>\n<p>under Exhibit P5.  Government does not, at this stage, propose to<\/p>\n<p>fill   up   the   vacancy   by   way   of   provisional   promotion.     As     as<\/p>\n<p>regards regular promotion, the stand taken is that Government is<\/p>\n<p>not   in   a   position   to   finalise   the   seniority   list   of   Deputy<\/p>\n<p>Commissioner, which  is obviously  necessary to convene   a DPC<\/p>\n<p>and effect regular promotion.  Exhibit P5 has been challenged in<\/p>\n<p>this writ petition.\n<\/p>\n<p id=\"p_2\">W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<p id=\"p_3\">        2.       Petitioner has further challenged Exhibit P3 by which<\/p>\n<p>the 2nd  respondent who was occupying  the  post of Joint Labour<\/p>\n<p>Commissioner till 30th  June 2006 (whose retirement gave rise to<\/p>\n<p>the   vacancy   which   is   currently   existing)   has   been   appointed   as<\/p>\n<p>Consultant (Law) at the Centre for Taxation Studies.  Apparently,<\/p>\n<p>the   engagement   of   the   2nd  respondent   under   Exhibit   P3   was<\/p>\n<p>further  extended  by  a  period  of  one  year   from  the    1st   of  July,<\/p>\n<p>2007.     These   actions   are   challenged   by   the   petitioner   on   the<\/p>\n<p>premise   that   apparently   the   2nd  respondent,   post   retirement   is<\/p>\n<p>acting   as   defecato   Joint   Commissioner   and   that   there   is   no<\/p>\n<p>necessity to engage the services of a retired person.   It is only to<\/p>\n<p>help   the   2nd   respondent   that   the   Government   has   refused   to<\/p>\n<p>consider     even   provisional   promotion   to   the   post   of   Joint<\/p>\n<p>Commissioner, it is contended.\n<\/p>\n<p id=\"p_4\">        3.       A   statement   has   been   filed   by   the   Government<\/p>\n<p>refuting   these   aspects.     That   the   engagement   of   the   2nd<\/p>\n<p>respondent   was   effected   considering   his   legal   acumen   and<\/p>\n<p>proven   expertise   in   helping   the   Government     to   defend     tax<\/p>\n<p>matters.  This has nothing to do  with the filling or non-filling up<\/p>\n<p>of   the   post   of   Joint   Commissioner   (Law).     The   allegation<\/p>\n<p>regarding     any   undue   indulgence   being   shown   to   the   2nd<\/p>\n<p>W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                         3<\/span><\/p>\n<p>respondent   has also been refuted.\n<\/p>\n<p id=\"p_5\">        4.       A   counter   affidavit   has   been   filed   by   the   2nd<\/p>\n<p>respondent.  It is contended that  he was offered the engagement<\/p>\n<p>as Consultant  (Law) under Exhibit P3, not on his application  but<\/p>\n<p>after the Governing body of the Centre for Taxation Studies had<\/p>\n<p>taken   a   decision   at   the   highest   level,   to   utilize   his   services.\n<\/p>\n<p id=\"p_6\">Apparently, the Chief Minister and the Minister for  Finance are<\/p>\n<p>also members of the governing body.   He renders such services<\/p>\n<p>as   he   can,   going   by   the   considerable   experience   he   had<\/p>\n<p>accumulated over the years in  conducting matters on   behalf of<\/p>\n<p>the  Government  both before this Court and before the Supreme<\/p>\n<p>Court.  Neither Exhibit P3 nor Exhibit P4 has anything to do with<\/p>\n<p>the delay in finalization of the provisional seniority list of Deputy<\/p>\n<p>Commissioners and the delay in effecting promotions to the post<\/p>\n<p>of Joint Commissioner.\n<\/p>\n<p id=\"p_7\">        5.       I   heard   the   Learned   counsel   for   the   petitioner<\/p>\n<p>Mr.B.Gopakumar and the learned Government Pleader Mr.Bejoy<\/p>\n<p>Chandran and Sri. Mohammed Nias, learned counsel for the 2nd<\/p>\n<p>respondent.  In my view, there  is nothing which suggests  a link<\/p>\n<p>between the engagement of 2nd respondent as a Consultant (Law)<\/p>\n<p>in   the   Centre   for   Taxation   Studies,   as   per   Exhibits   P3   and   P4<\/p>\n<p>W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                         4<\/span><\/p>\n<p>with   the   delay  on  the   part  of  the  Government     in  finalizing  the<\/p>\n<p>seniority list of Deputy Commissioners.   Adequate reasons have<\/p>\n<p>been given by the Government in the statement filed by them   I<\/p>\n<p>am not able to find any illegality as such  in the decision taken to<\/p>\n<p>avail   the   services   of   the   2nd  respondent   as   a   Consultant   (Law).\n<\/p>\n<p id=\"p_8\">Once   the   services   are   decided   to   be   utilized,     there   is   nothing<\/p>\n<p>wrong   in   enabling   him   to   give   his   best,   in   serving   the<\/p>\n<p>Government as such.  Apparently, his legal acumen or  expertise<\/p>\n<p>in     handling   matters   on   behalf   of   the   Government   has   been<\/p>\n<p>considered as valuable by the Government.  This court would  be<\/p>\n<p>slow in  interfering  with the decision  as reflected in Exhibits P3<\/p>\n<p>and   P4,   unless   there   is   a   demonstrated   case   of   malafides   or<\/p>\n<p>statutory infraction, I am not able to detect any in this case.\n<\/p>\n<p id=\"p_9\">        6.       In so far as the petitioner&#8217;s claim for promotion to the<\/p>\n<p>post of Joint Commissioner is concerned, obviously she is entitled<\/p>\n<p>to   be   considered   for   promotion   to   the   said   post.     Petitioner<\/p>\n<p>contends   that   she   is   the   senior   most     amongst   the   Deputy<\/p>\n<p>Commissioners.     Therefore,   if   regular   promotions   are   effected<\/p>\n<p>there is absolutely no reason why she should not be promoted, it<\/p>\n<p>is contended.  The post of Joint Commissioner is a selection post<\/p>\n<p>and it  is  upto   the   Government  to  fill   up  the  same.    Apparently,<\/p>\n<p>W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                          5<\/span><\/p>\n<p>the delay in finalizing the seniority list of Deputy Commissioner<\/p>\n<p>is   due   to   pendency   of   certain   writ     petitions   before   this   Court,<\/p>\n<p>according to the Government.  Learned counsel for the petitioner<\/p>\n<p>Mr. Gopakumar points out that there is no order of restraint  by<\/p>\n<p>this   Court   against   the   finalization   of   the   seniority   list   and   the<\/p>\n<p>reason given by the Government in this regard does not seems to<\/p>\n<p>be   tenable.     But   the   decision   to   fill   up   the   post   which   is<\/p>\n<p>essentially   a   selection   post   is   ultimately   vested   with   the<\/p>\n<p>Government.     In   the   facts   and   circumstances   of   the   case,   I<\/p>\n<p>consider   it   appropriate   to   direct   the   Government   to   take   a<\/p>\n<p>decision   on   the   question   as   to   whether   the   existing   vacancy   in<\/p>\n<p>the post of Joint Commissioner  is to be filled  up.   This  shall  be<\/p>\n<p>done without reference to the pendency of writ petition No.9989<\/p>\n<p>of   2005.   At   any   rate,   if   the   Government   decides   that   orders   of<\/p>\n<p>promotion   could   be   made   only   after   getting   clarifications   from<\/p>\n<p>this Court, it is perfectly open to them to do so.   There does not<\/p>\n<p>seem   to   be   any   justification   in   not   taking   a   decision   in   that<\/p>\n<p>behalf.\n<\/p>\n<p id=\"p_10\">        7.       Learned counsel for the petitioner submits that even if<\/p>\n<p>the   Government   decides   to   defer   the   question   of   regular<\/p>\n<p>promotion there is nothing that stands in the way of provisional<\/p>\n<p>W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                            6<\/span><\/p>\n<p>promotion   being   effected   in   the   absence   of   select   list.     This   is<\/p>\n<p>especially   so   when   the   eligible   incumbents   are     impending<\/p>\n<p>retirement.  Petitioner is due to retire in 2009, it is submitted.\n<\/p>\n<p id=\"p_11\">        In the facts and circumstances of the case, the writ petition<\/p>\n<p>is disposed of in the following terms:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         i)       The 1st respondent shall take a decision as to whether<\/p>\n<p>                  the   existing   vacancy   of   Joint   Commissioner   in   the<\/p>\n<p>                  Department of Commercial Taxes is to be filled up on<\/p>\n<p>                  a  regular   basis   by     effecting   regular   promotion   from<\/p>\n<p>                  among the Deputy Commissioners.  This shall be done<\/p>\n<p>                  within   a   period   of   two   months   from   today.       Such<\/p>\n<p>                  decision   shall   be   taken   without   reference   to   the<\/p>\n<p>                  pendency of Writ Petition No.9989 of 2005.   If actual<\/p>\n<p>                  implementation of the orders require any clarification<\/p>\n<p>                  from this Court in W.P(C) 9989 of 2005, Government<\/p>\n<p>                  is at liberty to make appropriate motion in that behalf.<\/p><\/blockquote>\n<p id=\"p_12\">        ii)       If the Government decides   that regular promotion is<\/p>\n<p>                  not   feasible,   for   the   post   of   Joint   Commissioner,   it<\/p>\n<p>                  shall   consider   the   case   of   the   petitioner   and   other<\/p>\n<p>                  eligible  incumbents   for  provisional promotion to the<\/p>\n<p>W.P ( C) No. 2698  of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                           7<\/span><\/p>\n<p>                  said post.   While  doing so, Government shall  keep in<\/p>\n<p>                  mind   the   judgment   in   W.A   Nos.200   of   1986,   890   of<\/p>\n<p>                  2002 and 826 of 2003.\n<\/p>\n<p id=\"p_13\">        iii)       The filling up of the post of Joint Commissioner either<\/p>\n<p>                  on  a regular  basis or  on  a provisional  basis  is not  in<\/p>\n<p>                  any manner connected with the engagement of the 2nd<\/p>\n<p>                  respondent     as   a   Consultant,   as   already   mentioned<\/p>\n<p>                  above.
