D.B.<br \/>\nCorporation Limited, seeking quashing of the complaint at<br \/>\n Annexure-A , bearing Criminal Case No.111 of 2010,<br \/>\ndated 10.08.2009, filed before Judicial Magistrate First Class,<br \/>\nDeesa.\n<\/p>\n<p id=\"p_2\">3.\t\tThe<br \/>\nsaid complaint was filed by respondent No.2 before the learned<br \/>\nMagistrate, alleging the offences punishable under Sections 500, 501,<br \/>\n502 read with <a href=\"\/doc\/112749\/\" id=\"a_1\">Section 114<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_3\">4.\t\tIt<br \/>\nappears, in the Divya Bhaskar newspaper, dated 18.06.2009, under the<br \/>\nhead of  in extortion case in Deesa, father and son are sent to<br \/>\njail , a news item was published, suggesting that respondent No.2<br \/>\nand his son were involved in a criminal case of demanding extortion<br \/>\nmoney and the complainant had ultimately lodged the complaint before<br \/>\nthe police, against them. It was the case of respondent No.2 that the<br \/>\nsaid news item was defamatory and thereby the accused and,<br \/>\nparticularly, the petitioner committed the offences punishable under<br \/>\n<a href=\"\/doc\/1408202\/\" id=\"a_1\">Sections 500<\/a>, <a href=\"\/doc\/1820068\/\" id=\"a_2\">501<\/a>, <a href=\"\/doc\/1495647\/\" id=\"a_3\">502<\/a> read with <a href=\"\/doc\/112749\/\" id=\"a_4\">Section 114<\/a> of the Indian Penal<br \/>\nCode.\n<\/p>\n<p id=\"p_4\">5.\t\tIn<br \/>\nthe complaint, respondent No.2 has alleged that the said news item,<br \/>\nin the newspaper, carried defamatory news. The newspaper has wide<br \/>\ncirculation and publication of the news in the said newspaper has<br \/>\nresulted into damage to the reputation of the complainant and his<br \/>\nson.  The complainant was examined by the learned Magistrate on<br \/>\n06.10.2009, thereafter, the learned Magistrate, on 13.01.2010, was<br \/>\npleased to issue process under <a href=\"\/doc\/1408202\/\" id=\"a_5\">Sections 500<\/a>, <a href=\"\/doc\/1820068\/\" id=\"a_6\">501<\/a>, <a href=\"\/doc\/1495647\/\" id=\"a_7\">502<\/a> read with<br \/>\n<a href=\"\/doc\/112749\/\" id=\"a_8\">Section 114<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_5\">6.\t\tThe<br \/>\nlearned Counsel for the petitioner stated that the narration in the<br \/>\nnews item was exactly as the allegations made in the complaint<br \/>\nitself.  The complaint is lodged against present respondent No.2<br \/>\nbefore the Deesa Police Station. The news item only reproduced the<br \/>\ncontents of the complaint and the same would, therefore, not amount<br \/>\nto defamation. She relied on a decision of the learned Single Judge<br \/>\nof this Court in  (Shri) Chimanbhai Somabhai Patel &amp;<br \/>\nOthers Vs. Mithu Bava &amp; Another  reported in 1984 GLH<br \/>\n(U.J.) 107, wherein it was observed that publication of a news item,<br \/>\nwithout twisting the same, to highlight circumstances which might not<br \/>\nbe true, may amount to defamation. But, publication of an item of<br \/>\nnews, without twisting the same or without an ulterior motive, can<br \/>\nnever amount to defamation. A person, who is arrested in connection<br \/>\nwith the smuggling of silver would be well-advised, not to take his<br \/>\nreputation to be so high that it can be dented by such a news item,<br \/>\nbeing published in the newspaper.\n<\/p>\n<p id=\"p_6\">7.\t\tThe<br \/>\nrespondent No.2, appearing in person, vehemently contended that news<br \/>\nof his son being arrested, were false. Moreover, the newspaper did<br \/>\nnot publish the counter allegations of respondent No.2 of being<br \/>\nill-treated by the police authorities. He had also given prior notice<br \/>\nbefore lodging the complaint. He, therefore, prayed that no case is<br \/>\nmade out for quashing.\n<\/p>\n<p id=\"p_7\">\t\tIn<br \/>\nsupport of his submissions, he relied on following decisions:\n<\/p>\n<p id=\"p_8\">(1)\t\tIn<br \/>\nthe case of  Ram Babu Vs. State of Madhya Pradesh &amp;<br \/>\nOthers  reported in (2009)7 SCC 194, in which the Apex<br \/>\nCourt stressed on the need for a reasoned order, while quashing the<br \/>\ncomplaint and the summons issued by the Court.\n<\/p>\n<p id=\"p_9\">(2)\t\tIn<br \/>\n Bibhuti Bhusan Das Gupta and Another Vs. State of West<br \/>\nBengal  reported in AIR 1969 381, in which the Apex Court<br \/>\nobserved that even when the personal appearance of the accused is<br \/>\ndispensed with, examination of pleader in his absence, is not<br \/>\nsufficient compliance, except, where the accused is a company or the<br \/>\njuridical person.\n<\/p>\n<p id=\"p_10\">\t\tI<br \/>\ndo not see how the said decision would apply in the present case.\n<\/p>\n<p id=\"p_11\">(3)\t\tIn<br \/>\nthe case of  Kishor Kumar Gyanchandani Vs. G.D. Mehrotra &amp;<br \/>\nAnother  reported in AIR 2002 SC 483, in which the Apex<br \/>\nCourt observed that the power of the Magistrate, under <a href=\"\/doc\/1149595\/\" id=\"a_9\">Section 202<\/a> of<br \/>\nthe Criminal Procedure Code, is not lost merely because he accepted<br \/>\nthe final form submitted by the police, investigating the incident in<br \/>\nquestion, on the basis of an FIR.\n<\/p>\n<p id=\"p_12\">\t\tThis<br \/>\nquestion is not germane in the present proceedings.\n<\/p>\n<p id=\"p_13\">8.\t\tConsidering<br \/>\nthe submission made and perusing the documents on record, it appears<br \/>\nthat the news item, dated 18.06.2009, published by the petitioner is<br \/>\nsubstantially, if not entirely, based on a complaint dated<br \/>\n16.06.2009. In that view of the matter, question is whether the<br \/>\noffence of &#8216;defamation&#8217; would be made out. The term &#8216;defamation&#8217; is<br \/>\ndefined under <a href=\"\/doc\/1041742\/\" id=\"a_10\">Section 499<\/a> of the Indian Penal Code, as under:\n<\/p>\n<p id=\"p_14\">  499.<br \/>\nDefamation.-\tWhoever, by words either spoken or intended to be<br \/>\nread, or by signs or by visible representations, makes or publishes<br \/>\nany imputation concerning any person intending to harm, or knowing or<br \/>\nhaving reason to believe that such imputation will harm, the<br \/>\nreputation of such person, is said, except in the cases hereinafter<br \/>\nexpected, to defame that person.\n<\/p>\n<p id=\"p_15\">9.\t\tThere<br \/>\nare explanations and exceptions to the said provision, particularly,<br \/>\nthe fourth exception, reads as under:\n<\/p>\n<p id=\"p_16\"> Explanation\n<\/p>\n<p id=\"p_17\">4.-\tNo imputation is said to harm a person&#8217;s<br \/>\nreputation, unless that imputation directly or indirectly, in the<br \/>\nestimation of others, lowers the moral or intellectual character of<br \/>\nthat person, or lowers the character of that person in respect of his<br \/>\ncaste or of his calling, or lowers the credit of that person, or<br \/>\ncauses it to be believed that the body of that person is in a<br \/>\nloathsome state, or in state generally considered as disgraceful.\n<\/p>\n<p id=\"p_18\">10.\t\tIn<br \/>\nthe present case, when I find that newspaper report is substantially<br \/>\nbased on a complaint, lodged against respondent No.2, the newspaper<br \/>\ncannot be blamed for carrying any defamatory items. It is not as if<br \/>\nthe news paper reported an incident allegedly taken place.  Newspaper<br \/>\nonly published news of filing of a complaint against respondent No.2<br \/>\nand his son and narrated the allegations made, therein.  This was<br \/>\nalso the view expressed by the learned Single Judge of this Court in<br \/>\nthe case of  (Shri) Chimanbhai Somabhai Patel &amp;<br \/>\nOthers (Supra).\n<\/p>\n<p id=\"p_19\">11.\t\tAllegation<br \/>\nthat the newspaper published a false report of the son of respondent<br \/>\nNo.2 being arrested has to be examined on the basis of the impugned<br \/>\ncomplaint. It is the part of the complaint that such news were false<br \/>\nand defamatory.  This averment of respondent No.2, therefore, cannot<br \/>\nbe accepted.\n<\/p>\n<p id=\"p_20\">12.\t\tIn<br \/>\nthe result, I find that the complaint does not disclose the offences<br \/>\npunishable under <a href=\"\/doc\/1408202\/\" id=\"a_11\">Sections 500<\/a>, <a href=\"\/doc\/1820068\/\" id=\"a_12\">501<\/a>, <a href=\"\/doc\/1495647\/\" id=\"a_13\">502<\/a> read with <a href=\"\/doc\/112749\/\" id=\"a_14\">Section 114<\/a> of the<br \/>\nIndian Penal Code. Same is, therefore, QUASHED qua the<br \/>\npresent PETITIONER, alone.
