Secretary, Gram Panchayat Raj Marwa Pakar, Anchal Saraiya,\n   District Muzaffarpur.\n                                             ---------- Respondents\n                             -----------\n<\/pre>\n<p id=\"p_1\">2       01.10.2010              Having heard learned counsel for the<\/p>\n<p>                     petitioner        in        respect         of      the      following<\/p>\n<p>                     relief:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                          &#8220;1.     That this is an application by the<br \/>\n                                  abovenamed           petitioner        for    issuance<br \/>\n                                  of        an        appropriate          writ\/order\/<br \/>\n                                  direction           to    Respondent        no.3,    the<br \/>\n                                  District Magistrate, Muzaffarpur to<br \/>\n                                  investigate               into         irregularity\/<br \/>\n                                  allegations           (forgery)        committed      by<br \/>\n                                  Mukhiya        Gram       Panchayat      Raj,      Marwa<br \/>\n                                  Pakar, Anchal Saraiya (Muzaffarpur)<br \/>\n                                  in selection\/employment of Panchayat<br \/>\n                                  Shiksha Mitra for Primary School, in<br \/>\n                                  2005, under rule 14 as envisaged in<br \/>\n                                  Govt.      Resolution            no.     1748      dated<br \/>\n                                  2.9.2005            (annexure       1)       and    take<br \/>\n                                  immediate action in accordance with<br \/>\n                                  law and in consequence, consider the<br \/>\n                                  claim          of        the     petitioner         for<br \/>\n                                  selection\/employment                   as       Shiksha<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          2<\/span><\/p>\n<p>                    Mitra on merit under the provision<br \/>\n                    of rule.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_1\">      this Court is of the considered opinion that<\/p>\n<p>      after abolition of the post of Shiksha Mitra<\/p>\n<p>      with effect from 1.7.2006, the appointment of<\/p>\n<p>      the petitioner cannot be made on the post of<\/p>\n<p>      Shiksha Mitra.\n<\/p>\n<p id=\"p_2\">                The      procedure           for      appointment   of<\/p>\n<p>      Panchayat Shikshak being absolutely different<\/p>\n<p>      in    terms   of       2006       Rules,   if   the    petitioner<\/p>\n<p>      would make an application for the said post,<\/p>\n<p>      the    same   shall          be    considered    in   accordance<\/p>\n<p>      with    law     without           being    prejudiced    by   his<\/p>\n<p>      rejection in his selection of Shiksha Mitra.<\/p>\n<p id=\"p_3\">                With         the        aforementioned      observation<\/p>\n<p>      and direction, this application is disposed<\/p>\n<p>      of.\n<\/p>\n<p id=\"p_4\">\n<pre id=\"pre_1\">Rsh                                                (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Mukesh Kumar vs The State Of Bihar &amp;Amp; Ors on 1 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.2785 of 2007 Mukesh Kumar, son of Shree Rameshwar Singh, Village Marwa Pakar, P.O.
