ABDUL REHIM, J\n                -------------------------------\n               WP(C) NO. 27344 OF 2010\n              -------------------------------------\n        Dated this the 20th day of December, 2010\n\n\n                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">     Challenge is against the recovery steps initiated for<\/p>\n<p>realising contributions due to the Kerala Motor Transport<\/p>\n<p>Workers Welfare Fund.          The respondent had filed a<\/p>\n<p>detailed statement answering the dispute raised with<\/p>\n<p>respect to correctness of the liability. Eventhough the<\/p>\n<p>petitioner had filed a reply affidavit there is nothing to<\/p>\n<p>indicate that the petitioner is not liable for payment of the<\/p>\n<p>amount demanded.\n<\/p>\n<p id=\"p_1\">     2.   However, this Court was inclined to grant an<\/p>\n<p>interim stay against further steps of recovery initiated on<\/p>\n<p>the basis of Ext.P5 notice, for a period of one month,<\/p>\n<p>subject to condition of the petitioner remitting a sum of<\/p>\n<p>Rs.40,000\/-. The above said interim order was issued on<\/p>\n<p>16.11.2010 stipulating such payment to be made within<\/p>\n<p>three weeks thereof.       Inspite of several adjournments<\/p>\n<p>thereafter, it is reported that, the petitioner has not<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                             2<\/span><br \/>\nWP(C) No. 27344\/2010<\/p>\n<p>complied with the condition. There is no representation for<\/p>\n<p>the petitioner when the case was taken up for consideration<\/p>\n<p>on today.\n<\/p>\n<p id=\"p_2\">     Under the above circumstances, the Writ Petition is<\/p>\n<p>dismissed.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                                  C.K.
