Application No.7343 of 2007<br \/>\nwhereby  the learned Single Judge upheld the order dated 24th March,<br \/>\n2007 passed by the Additional Sessions Judge-I, Muradabad whereby the<br \/>\nlearned Additional Sessions Judge had taken a cognizance against the<br \/>\naccused appellant under <a href=\"\/doc\/435819\/\" id=\"a_1\">Section 319<\/a> of the Criminal Procedure Code on<br \/>\nthe statement of Dharam Pal Singh (PW-1).\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">\t\t\t\t-2-<\/span><\/p>\n<p id=\"p_3\">\tThe brief facts which are necessary for the disposal of this appeal are<br \/>\nthat Dharam Pal Singh (PW-1) filed an FIR before the SHO, Kotwali,<br \/>\nThakurdwar, Moradabad alleging that after the meeting was over at the<br \/>\nPWD Guest House about 10.30 p.m. about 50-60 supporters of MLA<br \/>\nKanwar Sarvesh Kumar Chauhan who were carrying rifles, pistols, guns in<br \/>\ndozen vehicles came to the block premises amongst other namely, (i)<br \/>\nYogesh Kumar, son of Ram Pal Singh, resident of Ratupura, (ii) Yogendra<br \/>\nalias Bhura, resident of Humanyun Pur, (iii) Neeraj Chauhan, resident of<br \/>\nKheda Paschimi, (iv) Narendra, son of Lekhraj, resident of Ratupura, (v)<br \/>\nBalram Singh, resident of Faizulla Ganj, (vi) Balkar Singh, resident of<br \/>\nPega, (vii) Naresh Pal, son of Khanoi, resident of Phaleda, (viii) Zaibul,<br \/>\nresident of Wazidpur, (ix) Bijrendra Chauhan, son of Chatrag Singh,<br \/>\nresident of Majhradak etc. and some other persons who could be identified<br \/>\nif produced before us.  These people immediately after arrival, gave<br \/>\nwarnings and started giving dirty abuses and when we opposed these<br \/>\npeople, they started firing at us wildly in order to kill us and during the<br \/>\ncourse of <\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">\t\t\t -3-<\/span><br \/>\nabove firing, the driver Nem Singh, son of Shri Vishwambh Singh, resident<br \/>\nof Dada Ami Chandra, Bajpur died on the spot and Radhey Sham Yadav,<br \/>\nWakil Sahab Shamsher, Raju etc. sustained bullet injuries and taken to the<br \/>\nhospital for treatment.  Dead body of Nem Singh was lying at the crime<br \/>\nscene.  On the basis of this information, a case was registered against the<br \/>\npersons under <a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_2\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_3\">149<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_4\">302<\/a>\/<a href=\"\/doc\/455468\/\" id=\"a_5\">307<\/a>  of the Indian Penal Code.<br \/>\nThereafter the statement of Dharam Pal Singh was recorded under <a href=\"\/doc\/447673\/\" id=\"a_6\">Section<br \/>\n161<\/a> Cr.P.C. in which he had stated that when we were coming out from the<br \/>\nPWD Guest House after the meeting, mob of 50-60 supporters of MLA<br \/>\nSarvesh Kumar  came there with guns, pistols and  rifles and made a rash<br \/>\nfiring which resulted in the death of the driver.  After the investigation a<br \/>\nchallan was filed against the accused persons but no challan was filed<br \/>\nagainst Kanwar Survesh Kumar Singh Chauhan. After that the trial began<br \/>\nand statement of PW-1, Dharam Pal Singh was recorded and in that he<br \/>\ndisclosed in the Examination Chief  that on 11th June, 2004 at about 10.30<br \/>\na.m. when we were coming out from the PWD Guest House after the<br \/>\nmeeting, mob of 50-60 persons under the leadership of MLA Sarvesh<br \/>\nKumar Singh <\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">\t\t\t-4-<\/span><br \/>\nChauhan (accused) who were having rifles, guns, pistols in their hands<br \/>\nstarted firing in which the driver Nem Singh died on the spot.  On the<br \/>\nbasis of this statement made by PW-1 in the Examination Chief,<br \/>\nan application under <a href=\"\/doc\/1138947\/\" id=\"a_7\">Section 319<\/a> was made by the Public Prosecutor for<br \/>\ntaking cognizance against the accused Kanwar Sarvesh Kumar Singh<br \/>\nChauhan.  Learned Addditional Sessions Judge-I on the basis of  the FIR<br \/>\nand statement of PW-1 prima facie found involvment of Kanwar Sarvesh<br \/>\nKumar Singh Chauhan and accordingly he issued summons against<br \/>\nKanwar Sarvesh Kumar Singh Chauhan for taking cognizance of offence<br \/>\nagainst him and to face a trial.  The order dated 24th March, 2007 was<br \/>\nchallenged by Kanwar Sarvesh Kumar Singh Chauhan before the High<br \/>\nCourt and the High Court confirmed the order.  Hence the present appeal.<br \/>\n\tMr. S.K. Dubey, learned senior counsel appearing for the appellant has<br \/>\ntaken us to the FIR as well as the statement of Dharam Pal Singh recorded<br \/>\nunder <a href=\"\/doc\/48127346\/\" id=\"a_8\">Section 161<\/a> and statement recorded by Dharam Pal Singh in the<br \/>\ntrial as PW-1.  After going through the FIR and statement under <a href=\"\/doc\/48127346\/\" id=\"a_9\">Section<br \/>\n161<\/a>, it is apparent that the PW-1 who filed the FIR did not mention the<br \/>\nname of Kanwar Sarvesh Kumar Singh<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">\t\t\t-5-<\/span><br \/>\nChauhan as leading this unruly mob of 50-60 persons with fire arms.<br \/>\nNeither in the statement under <a href=\"\/doc\/48127346\/\" id=\"a_10\">Section 161<\/a> at any point of time, he alleged<br \/>\nthat the<br \/>\nmob was being led by Kanwar Sarvesh Kumar Singh Chauhan.  It is only<br \/>\nfor the first time that during the trial in Examination Chief he has alleged<br \/>\nthat Kanwar Sarvesh Kumar Singh Chauhan led this unruly mob.  It is<br \/>\ntrue that under Section 319 the Trial Court has a full discretion to take a<br \/>\ncognizance after it is found that there is a prima facie case against any of<br \/>\nthe accused who has not been charge sheeted by the police. But before<br \/>\nexercising its discretion the Trial Court has applied its mind properly.  We<br \/>\nhave gone through the FIR and the statement under <a href=\"\/doc\/48127346\/\" id=\"a_11\">Section 161<\/a> and we<br \/>\nfind that there is no mention that alleged accused took leading part in<br \/>\nheading unruly mob.  It is only for the first time in trial came out that<br \/>\nalleged accused took leading part. Therefore, it will be very hazardous in a<br \/>\nsituation like one to take the cognizance against the accused, when for the<br \/>\nfirst time, such a statement was made in the Court.  The cognizance can be<br \/>\ntaken but the Trial Court should also be very cautious in taking cognizance<br \/>\non such statement unless there is <\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">\t\t\t-6-<\/span><\/p>\n<p>some material to support the statement in the Trial Court.  The Court<br \/>\nshould not proceed  barely on the basis of the statement made for first time<br \/>\nin Court but should apply its mind cautiously looking to the attending<br \/>\ncircumstances of the case. In this case, we are satisfied that the Trial Court<br \/>\nhas not applied its mind properly and mechanically proceeded to issue<br \/>\nnotice to the cause on the statement of PW-1 who neither name the accused<br \/>\nin the FIR nor did he disclose this fact in his statement under <a href=\"\/doc\/447673\/\" id=\"a_12\">Section 161<\/a><br \/>\nCr.P.C. It was not proper for the Court to have proceeded on the basis of<br \/>\nthe statement of PW-1 disclosing the name of accused for first time without<br \/>\nverification from the attending circumstances.  The power under <a href=\"\/doc\/1138947\/\" id=\"a_13\">Section<br \/>\n319<\/a> has to be exercised very sparingly and in cautious manner.  If proper<br \/>\ncaution is not exercised then it may cause great miscarriage of justice.<br \/>\n\tHowever, in the present case apart from the fact that power was not<br \/>\nproperly exercised by learned Additional Sessions Judge,  all the accused<br \/>\nhave been acquitted in trial.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">\t\t\t   -7-<\/span><\/p>\n<p id=\"p_4\">\tConsequently, we allow this appeal, set aside the order passed by the<br \/>\nAdditional Sessions Judge-I, Muradabad dated 24th March, 2007 and the<br \/>\norder of the High Court dated 3rd April, 2007.\n<\/p>\n<p id=\"p_5\">\tThe appeal is accordingly, allowed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Kunwar Sarvesh Kumar vs State Of U.P on 8 April, 2008 Bench: A.K.Mathur, Altamas Kabir CASE NO.: Appeal (crl.) 621 of 2008 PETITIONER: KUNWAR SARVESH KUMAR RESPONDENT: STATE OF U.P.
