No. 2 on<\/p>\n<p>                           09.05.2010 in Cr. Misc. No. 9460 of 2008.<\/p>\n<p id=\"p_2\">                                    Primary submission of the petitioner is<\/p>\n<p>                           that the bail was granted to the O.P. No. 2<\/p>\n<p>                           which     was    challenged        before        the       Hon&#8217;ble<\/p>\n<p>                           Supreme Court. The liberty was granted to the<\/p>\n<p>                           petitioner that he may apply for cancellation<\/p>\n<p>                           of bail before the High Court or any other<\/p>\n<p>                           appropriate forum in Special Leave to Appeal<\/p>\n<p>                           (Crl) No(s). 8223 of 2008.\n<\/p>\n<p id=\"p_3\">                                    The grievance of the petitioner is that<\/p>\n<p>                           the     Opposite       Party     No.    2     bears     criminal<\/p>\n<p>                           antecedent       and     despite       that    he      has   been<\/p>\n<p>                           granted bail. There was possibility that the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                2<\/span><\/p>\n<p>O.P. No. 2 may tamper with the prosecution<\/p>\n<p>witnesses.    Further   submission          is    that    the<\/p>\n<p>bail was granted due to wrong submission of<\/p>\n<p>the O.P. No. 2 that he bears fair antecedent.<\/p>\n<p id=\"p_4\">       While granting bail to Opposite Party<\/p>\n<p>No.2   Siya    Sharan    Yadav        on     09.05.2010,<\/p>\n<p>submissions   were    noted    and    this       submission<\/p>\n<p>has not been noted that the O.P. No. 2 is a<\/p>\n<p>man of fair antecedent. This is not a case of<\/p>\n<p>concealment   and    grounds    for    grant       of    bail<\/p>\n<p>stands on different footing than the grounds<\/p>\n<p>for cancellation of bail.\n<\/p>\n<p id=\"p_5\">       The bail was granted considering the<\/p>\n<p>fact that the occurrence was of 30th May, 2007<\/p>\n<p>and was reported on 05.06.2007. According to<\/p>\n<p>the informant, the informant knew about the<\/p>\n<p>occurrence    on    02.06.2007.       The    matter       was<\/p>\n<p>reported after three days and the delay was<\/p>\n<p>found to be unexplained. This was one of the<\/p>\n<p>grounds for grant of bail.\n<\/p>\n<p id=\"p_6\">       In this case there is no concealment of<\/p>\n<p>the fact, no fraud was committed on the part<\/p>\n<p>of the Opposite Party No. 2.\n<\/p>\n<p id=\"p_7\">       After hearing the learned Counsel for<\/p>\n<p>the petitioner, learned Counsel for the State<\/p>\n<p>and learned Counsel for Opposite Party No. 2,<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           3<\/span><\/p>\n<p>            the   order   of   granting     of   bail   needs   no<\/p>\n<p>            interference.
