R.A. Singh, J.\n<\/pre>\n<p id=\"p_1\">        I have heard Shri Mahipal singh, learned counsel for the applicants, learned A.G.A.<br \/>\nfor O.P. NO.1 and perused the record. None has appeared for O.P. NO.2, Km. Amarjeet<br \/>\nKaur despite sufficient service of notice.\n<\/p>\n<p id=\"p_1\">        This application has been moved under <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> Cr.P.C. with a prayer to quash<br \/>\nthe summoning order dated 7.6.2008 passed by Ist Additional Chief Judicial Magistrate,<br \/>\nMeerut in complaint case no. 286\/9 of 2008, Km. Amarjeet Vs. Vinay Kumar and others<br \/>\nunder <a href=\"\/doc\/838469\/\" id=\"a_1\">section 452<\/a>,<a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a>,<a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_4\">506<\/a> I.P.C.\n<\/p>\n<p id=\"p_2\">        It appears from the record that an application under <a href=\"\/doc\/833310\/\" id=\"a_5\">section 156<\/a> (3) of <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>. was<br \/>\nmoved by Smt. Jasbeer Kaur, applicant no.2 against Avtar Singh, Balvindar Singh alias<br \/>\nLadi and Narendra Kumar alias Nikkoo with this allegation              that on 7.1.2008 the<br \/>\ninhabitants of her Mohalla informed her on telephone that the lock put on her room was<br \/>\nfound broken, at which she          immediately rushed to her house situated in Mohalla<br \/>\nSarvoday Nagar, Meerut and found the lock of her room broken and luggage in her room<br \/>\nin disorder as well as her some luggage were found missing, at which she inquired about<br \/>\nthe same from above persons who threatened to kill her. The complainant Smt. Jasbeer<br \/>\nKaur suspected that her belongings were stolen by the above persons. The complainant<br \/>\nthen filed a written report about the occurrence at police station, Civil Line, Meerut., but no<br \/>\naction was taken thereon. The said application u\/s 156 (3) <a href=\"\/doc\/445276\/\" id=\"a_7\">Cr.P.C<\/a>. was registered as<br \/>\ncomplaint case and the statement of the complainant under <a href=\"\/doc\/444619\/\" id=\"a_8\">section 200<\/a> Cr.P.C. and the<br \/>\nstatements of witnesses under <a href=\"\/doc\/1149595\/\" id=\"a_9\">section 202<\/a> Cr.P.C. were recorded.\n<\/p>\n<p id=\"p_3\">        Another complaint was lodged by O.P.No.2, Km. Amarjeet Kaur against Vinay<br \/>\nKumar, Smt. Jasbeer Kaur, Ram Sahai            and Kuldeep Singh        under <a href=\"\/doc\/838469\/\" id=\"a_10\">section     452<\/a>,<br \/>\n<a href=\"\/doc\/1011035\/\" id=\"a_11\">323<\/a>,<a href=\"\/doc\/555306\/\" id=\"a_12\">504<\/a>,<a href=\"\/doc\/180217\/\" id=\"a_13\">506<\/a> I.P.C. in the court of Additional Chief judicial Magistrate, Meerut with this<br \/>\nallegation that on 6.1.2008 she alongwith her family members was present in her house<br \/>\nand in the morning of 7.1.2008 at about 7.00 a.m. she found the lock put on the room of<br \/>\nSmt. Jasbeer Kaur broken, in respect of which Smt. Jasbeer Kaur was informed and then<br \/>\nSmt. Jasbeer Kaur alongwith Vinay Kumar, Kuldeep Singh and Ram Sahai arrived at her<br \/>\nroom and levelled     false allegations against her and her parents and thereafter above<br \/>\npersons entered into her house, belaboured her and her parents, abused and threaten to<br \/>\nkill them.\n<\/p>\n<p id=\"p_4\">        The learned Additional Chief Judicial Magistrate (Ist), Meerut took cognizance in<br \/>\n the complaint case no. 286\/08, Km. Amarjeet Kaur Vs. Vinay Kumar and others and<br \/>\nsummoned the applicants to face trial under <a href=\"\/doc\/838469\/\" id=\"a_14\">section 452<\/a>,<a href=\"\/doc\/1011035\/\" id=\"a_15\">323<\/a>,<a href=\"\/doc\/555306\/\" id=\"a_16\">504<\/a> and <a href=\"\/doc\/180217\/\" id=\"a_17\">506<\/a> I.P.C. vide<br \/>\nhis order order dated 7.6.2008, aggrieved        by which   these applicants   moved    this<br \/>\napplication under <a href=\"\/doc\/1679850\/\" id=\"a_18\">section 482<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_5\">       The learned counsel for the applicants challenging the above order dated 7.6.2008<br \/>\nhas contended that the court below        did not apply his mind and passed illegal     and<br \/>\narbitrary order because both parties are close relatives and civil suit regarding property<br \/>\nof late Harmendar Singh is still pending between them. It has also been submitted that<br \/>\nO.P. NO.2, Km. Amarjeet Kaur has filed said complaint case as a counter blast of the<br \/>\ncriminal case lodged by Smt. Jasbeer Kaur real Mausi of O.P. No.2, while O.P. NO.2<br \/>\nstated in her complaint that the applicant informed her about the lock being broken. The<br \/>\napplicant no.4, kuldeep singh had no concern with the dispute of the parties and he being<br \/>\nJeth of Smt. Jasbeer Kaur was also dragged in this criminal case.\n<\/p>\n<p id=\"p_6\">       On perusal of record, it has been found that          offences under <a href=\"\/doc\/838469\/\" id=\"a_19\">section 452<\/a>,<br \/>\n<a href=\"\/doc\/1011035\/\" id=\"a_20\">323<\/a>,<a href=\"\/doc\/555306\/\" id=\"a_21\">504<\/a>,<a href=\"\/doc\/180217\/\" id=\"a_22\">506<\/a> I.P.C. are primafacie made out against the applicants and the learned court<br \/>\nbelow on the basis of statements recorded under <a href=\"\/doc\/444619\/\" id=\"a_23\">section 200<\/a> and <a href=\"\/doc\/1149595\/\" id=\"a_24\">202<\/a> Cr.P.C.             has<br \/>\nsummoned the applicants to face the trial under above sections. Thus, no illegality or<br \/>\nirregularity is found in the impugned order passed by the Court below. There is no<br \/>\nsufficient ground to quash the summoning order dated 7.6.2008.\n<\/p>\n<p id=\"p_7\">       Consequently, this application moved under <a href=\"\/doc\/1679850\/\" id=\"a_25\">section 482<\/a> Cr.P.C. lacks merit and is<br \/>\ndismissed. Since date, time and place of occurrence are one and the same in both the<br \/>\ncases, hence both the cases may be tried by the same Court simultaneously.
