He also contended<br \/>\n\tthat the applicant will be available during investigation and trial<br \/>\n\tand will abide by the terms and conditions that may be imposed by<br \/>\n\tthis this court.\n<\/p>\n<p id=\"p_7\">\tLearned<br \/>\n\tAPP Mr. Pandya for respondent State has read over the papers and<br \/>\n\tdate of birth of prosecutrix and contended that the age of the<br \/>\n\tprosecutris was not less than sixteen years on the date of offence.\n<\/p>\n<p id=\"p_8\">In<br \/>\n\tthe facts and circumstances of the case, this Court is not entering<br \/>\n\tinto merits regarding consent or otherwise but this court is of the<br \/>\n\tview that this is a fit case for exercise of discretion in favour of<br \/>\n\tpetitioner for granting bail and, therefore, this application is<br \/>\n\trequired to be allowed.\n<\/p>\n<p id=\"p_9\">Hence,<br \/>\n\tthe applicant is ordered to be released on bail in connection with<br \/>\n\tCR No.I-104 of 2011 registered before Mehsana B Division Police<br \/>\n\tStation for the offence alleged against him in this application on<br \/>\n\this executing a bond of Rs.10,000\/- (Rupees ten thousand only) with<br \/>\n\tone solvent surety of the like amount to the satisfaction of the<br \/>\n\ttrial Court and subject to the conditions that he shall &#8211;\n<\/p>\n<p id=\"p_10\">a)\tnot<br \/>\ntake undue advantage of his liberty or\tabuse \this liberty;\n<\/p>\n<p id=\"p_11\">b)\tnot<br \/>\nto try to tamper or pressurise the prosecution \twitnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p id=\"p_12\">c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n<p id=\"p_13\">d)\tnot<br \/>\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n<p id=\"p_14\">e)\tnot<br \/>\nleave the State of Gujarat without prior\tpermission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p id=\"p_15\">f)\tfurnish<br \/>\nthe address of their residence to the\tInvestigating Officer\tand also<br \/>\nto the Court at the \ttime of execution of \tthe bond and shall<br \/>\nnot\tchange the residence without prior permission of\tthis Court;\n<\/p>\n<p id=\"p_16\">g)\tsurrender<br \/>\n\this passport, if any, to the lower\tCourt \twithin a week.\n<\/p>\n<p id=\"p_17\">(h)\tApplicant<br \/>\n\tshall not enter into area of B Division \tPolice Station, Mehsana<br \/>\n\tupto filing of charge \tsheet.\n<\/p>\n<p id=\"p_18\">7.\tIf<br \/>\n\tthe breach of any of the above conditions is committed, the<br \/>\n\tconcerned Court will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_19\">8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.
