Justice S.SIRI JAGAN\n\n Dated :27\/05\/2008\n\n O R D E R\n                             S.SIRI JAGAN, J\n                      = = = = = = = = = = = = = = = =\n                       W.P.(C).No. 15689 OF 2008\n                         = = = = = = = = = = = = =\n                    Dated this the 27th day of May, 2008.\n\n                             J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is aggrieved by notice issued to her son for<\/p>\n<p>eviction from properties belonging to the petitioner. Ext.P7 is the<\/p>\n<p>order issued to the petitioner&#8217;s son in this regard. The contention<\/p>\n<p>of the petitioner is that since the notice has been served on the<\/p>\n<p>petitioner&#8217;s son, the right of appeal, which is available to the<\/p>\n<p>petitioner, who is the owner of the property, has been effectively<\/p>\n<p>curtailed. The petitioner therefore seeks the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>            1.    To call for the records leading to Ext.P7 order<br \/>\n      and quash the same by the issuance of a writ of<br \/>\n      certiorari or any other writ, direction or order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            2.    To declare that the 5 cents of land in survey<br \/>\n      No. 414 of Kodungallur Taluk is in the exclusive<br \/>\n      possession and enjoyment of the petitioner under ext.P1<br \/>\n      document, is not liable to be interfered with in any<br \/>\n      manner.<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.   I have heard the Government Pleader and the<\/p>\n<p>standing counsel appearing for the 2nd respondent.<\/p>\n<p id=\"p_3\">      3.   If the petitioner is actually the owner of the property I<\/p>\n<p>am of opinion that simply because the order has been served on<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C).No. 15689 OF 2008         2<\/span><\/p>\n<p>her son, the petitioner cannot be prevented from filing an appeal<\/p>\n<p>against that order. Therefore I direct that if the petitioner files<\/p>\n<p>an appeal against Ext.P7 order, notwithstanding that the same is<\/p>\n<p>addressed to the petitioner&#8217;s son, the appellate authority shall<\/p>\n<p>entertain the same and pass appropriate orders on the same.
