     Under challenge in this appeal preferred by<\/p>\n
the claimant is the award of the Reference Court<\/p>\n
re-fixing value of lands in Cheranelloor village<\/p>\n
acquired for the purpose of four line connectivity<\/p>\n
from N.H.47 to Vallarpadom. The acquisition was<\/p>\n
pursuant to section 4(1) notification published on<\/p>\n
26\/10\/05. The Land Acquisition Officer included<\/p>\n
the property in category-11 and awarded land<\/p>\n
value at the rate of Rs.1,00,375\/- per Are. The<\/p>\n
Reference Court on the basis of evidence found<\/p>\n
that the property was eligible to be included in<\/p>\n

       category-10, a superior category for which the<\/p>\n
       Land Acquisition Officer had awarded value at the<\/p>\n
       rate of Rs.1,11,528\/- per Are. The appellant\/<\/p>\n
       claimant placed strong reliance on Ext.A7. The<\/p>\n
       evidence adduced by the appellant consisted of<\/p>\n
       Exts.A1 to A11, AWs.1 to 3 and R1 to R4.<\/p>\n
       Significantly, there was no counter oral evidence<\/p>\n
       on     the    side of  the  Government    or  the<\/p>\n
       Requisitioning Authority. Reports and sketches<\/p>\n
       submitted by the Advocate Commissioner on the<\/p>\n
       basis of local inspection were marked in evidence<\/p>\n
       as Exts.C1 to C2(a). The court below did not<\/p>\n
       become inclined to place specific reliance on any<\/p>\n
       of the documents produced by the appellant. The<\/p>\n
       court below, however, would make a guess of the<\/p>\n
       market value and re-fix the same at Rs.1,72,685\/-<\/p>\n

       per Are which incidentally was 50% of the market<\/p>\n
       value reflected in Ext.A2 one of the documents<\/p>\n
       produced by them.\n<\/p>\n
              2. In this appeal various grounds have been<\/p>\n
       raised assailing the impugned judgment and<\/p>\n
       Sri.P.S.Narayana Raja, the learned counsel for the<\/p>\n
       appellant addressed submissions before us based<\/p>\n
       on all those grounds. The submissions of Sri.Raja<\/p>\n
       were       forcefully resisted  by  Smt.Latha      T.<\/p>\n
       Thankappan, the learned senior Government<\/p>\n
       Pleader. Sri.Raja would give more thrust to his<\/p>\n
       argument that in L.A.A.163\/08 pertaining to<\/p>\n
       acquisition of land, the very same learned Judge<\/p>\n
       has awarded the rates granted to certain other<\/p>\n
       claimants who opted for DLPC package. According<\/p>\n
       to Sri.Raja, the appellants are also entitled for the<\/p>\n

       same rates. Smt. Latha would immediately retort<\/p>\n
       that judgment in L.A.A.163\/08 has not become<\/p>\n
       final and the same is being appealed against.<\/p>\n
       Sri.Raja would then submit that the appellants<\/p>\n
       have several relevant documents to be produced<\/p>\n
       before the court below and fervently requested<\/p>\n
       that an opportunity be afforded for producing all<\/p>\n
       those documents. We feel that in the facts and<\/p>\n
       circumstances attending on this case, there is<\/p>\n
       justification for affording such an opportunity to<\/p>\n
       the     appellant,  however,   only by  imposing<\/p>\n
       conditions.     Accordingly, we   set  aside  the<\/p>\n
       judgment and decree and remand LAR.11\/08 to<\/p>\n
       the third Additional Sub Court, Ernakulam subject<\/p>\n
       to the following conditions:-\n<\/p>\n
              1) If under the revised judgment to be<\/p>\n

       passed by the Reference Court pursuant to this<\/p>\n
       judgment if the appellant becomes entitled for<\/p>\n
       compensation at rates more than the rates<\/p>\n
       granted under the impugned judgment, such<\/p>\n
       enhanced compensation will not carry interest<\/p>\n
       other wise admissible under section 28<\/a> of the<\/p>\n
       Land Acquisition Act during the period from<\/p>\n
       23\/03\/09 till date of such revised judgment.<\/p>\n
              2) The court below will place reliance on post<\/p>\n
       notification documents (sale documents) only<\/p>\n
       when it becomes absolutely necessary and<\/p>\n
       relevant      pre-notification documents    are  not<\/p>\n
       available.\n<\/p>\n
              3) The appellant will produce all relevant<\/p>\n
       documents proposed to be relied on by him<\/p>\n
       before the court below on or before 31\/05\/10.<\/p>\n

              3. Since the remand is necessitated to a<\/p>\n
       certain extent due the fault of the appellant<\/p>\n
       himself, a sum of Rs.25,000\/- from out of the<\/p>\n
       initial 1\/3rd court fee remitted by him on the<\/p>\n
       appeal memo will not be refunded to the<\/p>\n
       appellant. Only the balance will be refunded to the<\/p>\n
       appellant. The parties will appear before the court<\/p>\n
       below on 05\/04\/10. The court below will complete<\/p>\n
       further enquiry and pass revised judgment at the<\/p>\n
       earliest, and at any rate, before 31\/07\/10.<\/p>\n
              Refund court fee remitted less Rs.25,000\/-.<\/p>\n
