Respondents No. 2 and 3 are facing trial under <a href=\"\/doc\/324254\/\" id=\"a_1\">Sections <\/p>\n<p>     7<\/a>,   <a href=\"\/doc\/642316\/\" id=\"a_1\">12<\/a>,   <a href=\"\/doc\/1101716\/\" id=\"a_2\">13(1)(d)<\/a>   and   <a href=\"\/doc\/1259316\/\" id=\"a_3\">13(2)<\/a>   of   the   Prevention   of   Corruption   Act <\/p>\n<p>     being Special Case No. 4 of 2005 before the learned Special Judge <\/p>\n<p>     for C. B. It is noticed that some evidence came to be recorded in <\/p>\n<p>     the said case and original accused No. 2 i.e. respondent No. 3 filed <\/p>\n<p>     an application at Exh. 90 before the learned Special Judge praying <\/p>\n<p>     that the present petitioner should be joined as accused on the basis <\/p>\n<p>     of evidence which was then before the learned Special Judge.  That <\/p>\n<p>     application   was   heard   by   the   learned   Special   Judge   on   merits.\n<\/p>\n<p id=\"p_4\">     Opportunity   was   given   to   the   present   applicant   to   advance   his <\/p>\n<p>     submission in connection with the prayer set out in Exh. 90.  The <\/p>\n<p>     learned   Special   Judge   at   Akola   by   his   order   dated   07\/12\/2007 <\/p>\n<p>     granted the request of joining the present applicant as accused No. <\/p>\n<p>     3   and   certain   other   orders   were   passed.   This   order   dated <\/p>\n<p>     07\/12\/2007 is challenged in this petition.\n<\/p>\n<p id=\"p_5\">     3.                  I have heard learned Advocates on both sides.   It was <\/p>\n<p>     sought to be argued in principle by the learned Advocate for the <\/p>\n<p>     applicant that provisions of <a href=\"\/doc\/435819\/\" id=\"a_4\">Section 319<\/a> of the Code of Criminal <\/p>\n<p>     Procedure  should  have  been  invoked by  the  prosecutor  by filing <\/p>\n<p>     application and thereafter the Court should have decided the said <\/p>\n<p>     matter.  According to the learned Advocate for the applicant, it will <\/p>\n<p>     not be open for a person who is shown as accused (in  a pending <\/p>\n<p>     case)  to make  an  application   that  a  particular   person  should  be <\/p>\n<p>     joined as an accused by using the provisions of Section 319 Cri. P.\n<\/p>\n<p id=\"p_6\">     C.   He, therefore, submitted that the order passed by the learned <\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                     ::: Downloaded on &#8211; 09\/06\/2013 15:13:01 :::<\/span><br \/>\n       crra3.08.odt                                                       <\/p>\n<p>                                                                                                                            3  \/  4 <\/p>\n<p>     Special Judge is patently incorrect, and therefore, it should be set <\/p>\n<p>     aside.\n<\/p>\n<p id=\"p_7\">     4.                  Learned Advocate Mr. Ahirkar appearing for the C. B. I.\n<\/p>\n<p id=\"p_8\">     submitted   that   the   discussion   mentioned   in   the   impugned   order <\/p>\n<p>     indicates that there is material to join the present applicant as an <\/p>\n<p>     accused, and therefore, the learned Special Judge was satisfied that <\/p>\n<p>     application should be granted.   He submitted that once the Court <\/p>\n<p>     comes  to  a conclusion  that  there  is  material  to join  a  particular <\/p>\n<p>     person as an accused, this Court should not interfere in the said <\/p>\n<p>     order.\n<\/p>\n<p id=\"p_9\">     5.                  At   this   juncture,   I   do   not   wish   to   express   any   view <\/p>\n<p>     whether on the basis of evidence recorded up till now the case is <\/p>\n<p>     made out against the applicant to join him as an accused.   I am <\/p>\n<p>     looking to this matter from limited angle as to who should make <\/p>\n<p>     application for joining a particular person as an accused and in my <\/p>\n<p>     view after having considered the scheme under Section 319 Cri. P.\n<\/p>\n<p id=\"p_10\">     C., one thing is clear that a person who is facing the trial cannot <\/p>\n<p>     make an application so as to see that a particular person is to be <\/p>\n<p>     joined as  an  accused.   It would  be  a  prerogative  of  the  learned <\/p>\n<p>     prosecutor to file   such an application. At this juncture, I do not <\/p>\n<p>     wish to express any view whether the Court could take steps under <\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                                                     ::: Downloaded on &#8211; 09\/06\/2013 15:13:01 :::<\/span><br \/>\n       crra3.08.odt                                                       <\/p>\n<p>                                                                                                                            4  \/  4 <\/p>\n<p>     Section 319 Cri. P. C. suo motu as the said point was not pressed <\/p>\n<p>     before this Court.  In view of the aforesaid, the application Exh. 90 <\/p>\n<p>     filed by original accused was not maintainable and on this count it <\/p>\n<p>     could not have been considered by the learned Special Judge and <\/p>\n<p>     hence the order passed by the learned Special Judge on the said <\/p>\n<p>     application, i.e. to say grant of such application will have to be set <\/p>\n<p>     aside and as such the revision will have to be granted.
