Nanavaty, learned Additional Public Prosecutor for the<br \/>\napplicant.\n<\/p>\n<p id=\"p_1\">2).\tThe<br \/>\napplicant State of Gujarat, through Food Inspector, Jamnagar has<br \/>\npreferred this appeal under <a href=\"\/doc\/1856707\/\" id=\"a_1\">Section 378(4)<\/a> of the Code of Criminal<br \/>\nProcedure challenging the judgment and order dated 11.11.2008 passed<br \/>\nby the Judicial Magistrate 1st<br \/>\nClass,  Jamnagar in Criminal Case No.468 of 2007 on the ground that<br \/>\nthe same is required to be quashed and set aside as is passed<br \/>\ncontrary to the provisions of law and without<br \/>\nappreciation of the facts and evidence on record. The appeal is<br \/>\naccompanied with the application for seeking leave to appeal.  The<br \/>\nCourt, therefore, permitted the learned A.P.P to make his submissions<br \/>\non the appeal also and after hearing extensively on the ground of<br \/>\nappeal, the Court is of the view that the leave itself is required to<br \/>\nbe refused for filing appeal, on the following grounds.\n<\/p>\n<p id=\"p_2\">3)\tFacts<br \/>\nin brief leading to file this application for leave to appeal and<br \/>\nappeal deserves to be set out as under.\n<\/p>\n<p id=\"p_3\">4).\tThe<br \/>\noriginal complainant-Food Inspector on 10.11.2006 visited the firm of<br \/>\nthe accused.  At that time accused no.1 was present, after<br \/>\nintroducing himself in presence of Panch and intimating him that he<br \/>\nhad came to collect the sample of commodity in which the accused was<br \/>\ndealing.  He purchased 400gms.  pure Ghee on payment of Rs.72.<br \/>\nThereafter, the glass bottles, cork, steel vessel, ladle etc. were<br \/>\ncleaned on the spot with the help of clean cloth and on being<br \/>\nsatisfied, the bottles were free from any color, odour,<br \/>\n the 400gms. pure Ghee was divided in equal portion and poured into<br \/>\nthree bottles and the bottles were sealed in accordance with law in<br \/>\npresence of the Panch. The memorandum of seal impression etc. were<br \/>\nprepared in accordance with law and the same was forwarded to the<br \/>\ncompetent authority.  The report received indicated that the sample<br \/>\nwas found to be adulterated with turmeric powder and, therefore, as<br \/>\nthe adulteration is punishable under Section 16 of the Act, the<br \/>\ncomplaint was lodged after obtaining the competent authority&#8217;s<br \/>\napproval for appropriate punishment under <a href=\"\/doc\/1316195\/\" id=\"a_1\">Section 7(1)<\/a> and <a href=\"\/doc\/1737367\/\" id=\"a_2\">7(5)<\/a>.  The<br \/>\nCourt after framing point for determination came to the conclusion<br \/>\nthat there was serious lacuna in the procedure of collecting the<br \/>\nsample of Ghee, which rendered the entire process contrary to the<br \/>\nprocedure which is approved for taking sample of pure Ghee.\n<\/p>\n<p id=\"p_4\">5).\n<\/p>\n<p id=\"p_5\"> The Court relied upon the decision of this Court rendered in case of<br \/>\nLaxmichand Bhailal Thakker Vs. State of Gujarat reported in 21 (2)<br \/>\nGLR 1528 held that as the sample of pure Ghee had not been collected<br \/>\nafter heating it in a proper temperature  and<br \/>\nmaking it homogeneous so as to represent the  entire quantity of<br \/>\nGhee, has rendered the process vulnerable<br \/>\nand, therefore, on such collection of sample, the conviction cannot<br \/>\nbe pronounced.  The Ld. A.P.P. could not cite any contrary decision<br \/>\nnor could he show the findings contrary to the material on record.<br \/>\nIn fact, the Court has recorded in its finding that the food<br \/>\ninspector i.e. complainant in his complaint has positively made<br \/>\nstatement with regard to non-sealing of the Ghee before taking the<br \/>\nsample though he did refer to steering of the Ghee, which may have<br \/>\nsome characteristic of making the Ghee homogeneous, but when the<br \/>\nCourt has laid down law in respect of collecting the sample and when<br \/>\nthere are judgments to this effect, which unequivocally go to show<br \/>\nthat a sample of pure Ghee is to be collected only after heating it<br \/>\nin a given temperature and steering it so as to make it homogeneous,<br \/>\nthe finding of the Court cannot be said to be so perverse as to call<br \/>\nfor any interference under <a href=\"\/doc\/1856707\/\" id=\"a_3\">Section 378(4)<\/a>  of the Code of Criminal<br \/>\nProcedure.  A leave, therefore, in my view not required to be<br \/>\ngranted.
