The details are as follows:<br \/>\nThe appellant wants attested copy of following documents:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>    1) Order copies.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>    2) All relevant papers communicated by DC\/ Sadar Pahar Ganj to the Central<br \/>\n        establishment department.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>    3) Any notification issued by the senior officer for modification of the order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>    4) Action taken or any action being taken by the DC\/ Sadar Pahar Ganj or any other<br \/>\n        official remarks on the order.\n<\/p><\/blockquote>\n<p id=\"p_2\">There is no reply from PIO.\n<\/p>\n<p id=\"p_3\">The First Appellate Authority ordered:\n<\/p>\n<p id=\"p_4\">The FAA disposed off the appeal and ordered in the order No. D-522 DC\/SPZ\/08, dated, &#8220;I<br \/>\nhave gone through appeal No.40 DC\/SPZ\/08 filed by Shri Harish Kumar on dated 16\/05\/2008<br \/>\nand relying on his statement that he has not received any information in respect of his ID<br \/>\napplication under <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. Therefore PIO\/AC\/SPZ is directed to supply the requisite<br \/>\ninformation with in 05 working days.&#8221;\n<\/p>\n<p id=\"p_5\">On receiving no information from the PIO, the appellant filed the second appeal.<br \/>\n Decision:\n<\/p>\n<p id=\"p_6\">The appeal is allowed.\n<\/p>\n<p id=\"p_7\">The complete information will be sent to the appellant before 25 December, 2008.<br \/>\nThe issue before the Commission is of not supplying the complete, required information<br \/>\nby the PIO within 30 days as required by the law.<br \/>\nIt also appears that the First appellate authority&#8217;s orders have not been implemented.<br \/>\nFrom the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of <a href=\"\/doc\/1831074\/\" id=\"a_1\">Section 7<\/a> by not replying<br \/>\nwithin 30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. He has further refused to obey the<br \/>\norders of his superior officer, which raises a reasonable doubt that the denial of information<br \/>\nmay also be malafide. The First Appellate Authority has clearly ordered the information to be<br \/>\ngiven. .\n<\/p>\n<p id=\"p_8\">It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_3\">Section 20<\/a> (1) .<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to the<br \/>\nCommission to show cause why penalty should not be levied on him.\n<\/p>\n<p id=\"p_9\">He will give his written submissions showing cause why penalty should not be imposed on<br \/>\nhim as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_4\">Section 20<\/a> (1) before 30 December, 2008.
