Justice C.K.ABDUL REHIM\n\n Dated :12\/10\/2010\n\n O R D E R\n                         C.K.ABDUL REHIM, J\n                   ---------------------------\n                     W.P(C) No.30882 of 2010-I\n                   ----------------------------\n              Dated this the 12th day of October, 2010.\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Challenge in this writ petition is against Ext.P4 order of<\/p>\n<p>assessment finalised with respect to the year 2006-07. It is noticed<\/p>\n<p>that the petitioner has got an effective alternate remedy of statutory<\/p>\n<p>appeal against Ext.P4, as provided under the Kerala Value Added<\/p>\n<p>Tax Act (KVAT Act).      Hence it is not proper for this Court to<\/p>\n<p>entertain the writ petition. It is stated that on receipt of Ext.P4, the<\/p>\n<p>petitioner had submitted Ext.P6 petition seeking modification of the<\/p>\n<p>assessment. But it is noticed that once the assessment order is<\/p>\n<p>passed, the authority will become &#8216;functus officio&#8217; and he could not<\/p>\n<p>entertain any such petition.\n<\/p>\n<p id=\"p_1\">      2.    Having confronted with the above situation, learned<\/p>\n<p>counsel for the petitioner submitted that the petitioner will take<\/p>\n<p>immediate steps for filing statutory appeal against Ext.P4, before<\/p>\n<p>the appropriate authority.      On that basis the petitioner seeks<\/p>\n<p>indulgence of this Court to restrain the coercive steps of recovery<\/p>\n<p>which is initiated pursuant to Ext.P7 notice for a reasonable period.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C) No.30882 of 2010-I          2<\/span><\/p>\n<p id=\"p_2\">      3.    Having considered the facts and circumstances, I am of<\/p>\n<p>the opinion that the petitioner can be relegated to the appellate<\/p>\n<p>authority.
