Justice M.SASIDHARAN NAMBIAR\n\n Dated :27\/07\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             W.P.(C)No.17502 of 2009 Q\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">    Sixth accused, facing trial in S.C.No.655\/2003<\/p>\n<p>on the file of Additional Sessions Court (Fast<\/p>\n<p>Track Court-II), Thiruvananthapuram for offences<\/p>\n<p>under Sections 8(1) and 58 of Abkari Act, filed<\/p>\n<p>this petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of Constitution of<\/p>\n<p>India for a direction to the Additional Sessions<\/p>\n<p>Judge to dispose the case within a stipulated time.<\/p>\n<p>Case of the petitioner is that since 2003 the case<\/p>\n<p>is  pending   before   the  court   and   in   such<\/p>\n<p>circumstances, a direction is to be issued for<\/p>\n<p>speedy disposal of the case.\n<\/p>\n<p id=\"p_1\">    2.  A report was called from learned Additional<\/p>\n<p>Sessions Judge.   Report shows that out of eight<\/p>\n<p>accused  facing  trial,   accused  5   and  7   are<\/p>\n<p>absconding and as their presence could not be<\/p>\n<p>procured, the case as against them was split up on<\/p>\n<p>2.7.2009 and as accused 1, 4 and 6 were absent, the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 17502\/09               2<\/span><\/p>\n<p>case was posted for hearing to 13.7.2009. Learned<\/p>\n<p>Additional Sessions Judge submitted that case can<\/p>\n<p>be disposed within two months from the date of<\/p>\n<p>framing the charge.\n<\/p>\n<p id=\"p_2\">     2.
