ABDUL REHIM, J\n                ------------------------------\n             WP(C) NO. 28322 OF 2010\n             -------------------------------------\n       Dated this the 14th day of October, 2010\n\n\n                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The petitioner availed two finanacial assistances<\/p>\n<p>from the respondent Bank, one being a cash credit facility<\/p>\n<p>for business purpose and other being a housing loan.<\/p>\n<p>Consequent to defaults committed in repayment of the<\/p>\n<p>loans, the respondents initiated proceedings under the<\/p>\n<p>Securitisation and Reconstruction of Financial Assets and<\/p>\n<p><a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>, 2002 <a href=\"\/doc\/52229129\/\" id=\"a_1\">(SARFAESI<\/p>\n<p>Act<\/a>) and immovable property which is the secured asset<\/p>\n<p>were proceeded against.        Ext.P1 is the notice issued<\/p>\n<p>under <a href=\"\/doc\/198257891\/\" id=\"a_2\">Section 13<\/a> (2) and Ext.P3 is the notice issued for<\/p>\n<p>taking over possession of the property [as per the steps<\/p>\n<p>contemplated under <a href=\"\/doc\/198257891\/\" id=\"a_3\">Section 13<\/a> (4)]. According to the<\/p>\n<p>petitioner, he had approached the Bank, expressing<\/p>\n<p>willingness to regularize the loan account by paying the<\/p>\n<p>defaulted amounts. But without acceding to such request<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                              2<\/span><br \/>\nWP(C) No. 28322\/2010<\/p>\n<p>coercive steps of dispossession is being pursued.      Hence<\/p>\n<p>this Writ Petition was filed.\n<\/p>\n<p id=\"p_1\">     2.     Learned counsel appearing for the respondent<\/p>\n<p>Bank, on the basis of instructions, submitted that there is no<\/p>\n<p>transactions in the cash credit facility since the last more<\/p>\n<p>than one year and the business in question remains defunct<\/p>\n<p>and no stock was available in the premises. It is stated that<\/p>\n<p>an amount of more than Rs.19.70 lakhs is due under that<\/p>\n<p>account. With respect to the housing loan, it is submitted<\/p>\n<p>that the petitioner is in default of payment of more than<\/p>\n<p>4.30 lakhs, and there was consecutive defaults in payment<\/p>\n<p>of the EMIs. However it is conceded by the respondents<\/p>\n<p>that if the petitioner clears payment of the defaulted<\/p>\n<p>amounts in the housing loan, he can be permitted to<\/p>\n<p>continue payment of the balance amounts as per original<\/p>\n<p>schedule. But with respect to the cash credit facility it is<\/p>\n<p>submitted that the petitioner cannot be permitted to<\/p>\n<p>continue, since the business is not functioning.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                              3<\/span><br \/>\nWP(C) No. 28322\/2010<\/p>\n<p id=\"p_2\">     3.     Having regard to the fact that the scheme of the<\/p>\n<p>statute provides effective remedies to the petitioner against<\/p>\n<p>steps taken under the <a href=\"\/doc\/52229129\/\" id=\"a_4\">SARFAESI Act<\/a>, I am not all inclined<\/p>\n<p>to interfere on merits of the contentions. However, I am of<\/p>\n<p>the view that indulgence can be shown in the matter of<\/p>\n<p>permitting the petitioner to regularize the housing loan<\/p>\n<p>account.     It is made clear that if the petitioner makes<\/p>\n<p>payment of the entire amount in default with respect to the<\/p>\n<p>housing loan account, within a period of one month from<\/p>\n<p>today, the respondents shall permit the petitioner to<\/p>\n<p>continue payment of future monthly instalments in<\/p>\n<p>accordance with original schedule.\n<\/p>\n<p id=\"p_3\">     4.     As far as the cash credit facility is concerned, I<\/p>\n<p>am of the opinion that the petitioner can be afforded with<\/p>\n<p>an opportunity to approach the appropriate authority under<\/p>\n<p>the respondents either to seek revival of the loan account or<\/p>\n<p>seeking waiver and instalment payments.           If any such<\/p>\n<p>approach is made by the petitioner, after regularizing the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                               4<\/span><br \/>\nWP(C) No. 28322\/2010<\/p>\n<p>housing loan account, the same shall be considered by the<\/p>\n<p>appropriate authority of the respondent Bank and a reply<\/p>\n<p>thereof shall be issued to the petitioner.<\/p>\n<p id=\"p_4\">     5.     Needless to say that further steps for realizing the<\/p>\n<p>amounts under the cash credit facility shall be pursued only<\/p>\n<p>after taking decision on the matter as directed above. It is<\/p>\n<p>made clear that on the event of default in complying with<\/p>\n<p>any of the conditions stipulated as above, the respondent<\/p>\n<p>will be free to proceed with further steps based on the<\/p>\n<p>notices already issued, and on such an event the petitioner<\/p>\n<p>will be precluded from raising any subsequent challenge<\/p>\n<p>against such proceedings.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                     C.K.
