Justice P.N.RAVINDRAN\n\n Dated :03\/06\/2010\n\n O R D E R\n         J.Chelameswar, CJ. &amp; P.N.Ravindran, J.\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Contempt Case(Civil) No. 602 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n               Dated this the 3rd day of June, 2010\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">J.Chelameswar, CJ.\n<\/p>\n<p id=\"p_1\">      By judgment dated 03.04.2009 in WP(C) No.6540 of<\/p>\n<p>2009, this Court recorded an undertaking given by the 1st<\/p>\n<p>respondent     therein      that     the     construction       work of<\/p>\n<p>Munsiff-Magistrate Court building at Sasthancotta in Kollam<\/p>\n<p>District would be completed on or before 25.10.2009.                The<\/p>\n<p>further factual backgrounds are not necessary for the present<\/p>\n<p>purpose.\n<\/p>\n<p id=\"p_2\">      2. Contending that such an undertaking before this Court<\/p>\n<p>has not yet been complied with, the writ petitioner filed this<\/p>\n<p>Contempt Case. During the pendency of this contempt case,<\/p>\n<p>I.A. No.7011 of 2010 for extension of time and C.M. Appl.<\/p>\n<p>No.2225 of 2010 for condonation of delay in filing the<\/p>\n<p>extension application have been filed by the 1st respondent in<\/p>\n<p>the writ petition.\n<\/p>\n<p id=\"p_3\">      3. The learned Government Pleader submitted that for<\/p>\n<p>the various reasons mentioned in the affidavit filed in support<\/p>\n<p>COC No.602 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -:2:-<\/span><\/p>\n<p>of IA No.7011 of 2010, the undertaking given before this Court to<\/p>\n<p>complete the construction work of the abovementioned court<\/p>\n<p>building could not be completed and prays that the time<\/p>\n<p>stipulated for the completion of the work be extended as prayed<\/p>\n<p>for. We have perused the belated application for extension of<\/p>\n<p>time and we also perused the application seeking condonation of<\/p>\n<p>delay. Having regard to the circumstances we deem it<\/p>\n<p>appropriate to condone the delay in filing the application for<\/p>\n<p>extension of time. We are also of the opinion that having regard<\/p>\n<p>to the reasons given by the respondents, the time stipulated for<\/p>\n<p>completing the construction work be extended as prayed for.<\/p>\n<p id=\"p_4\">      In view of the abovementioned orders, there is no need to<\/p>\n<p>proceed further with this Contempt Case.
