Justice K.K.DENESAN\n\n Dated :22\/01\/2007\n\n O R D E R\n                                  K.K.DENESAN, J\n\n                          -------------------------------\n\n                           W.P.(C)NO.1863  of 2007\n\n                          -------------------------------\n\n                 Dated this the 22nd   day  of January, 2007\n\n\n\n\n                                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">       The   petitioner   is   now   working   as   Senior   Superintendent\/<\/p>\n<p>Performance Audit Supervisor at Nilambur on his transfer from Kollam<\/p>\n<p>district based on an order of promotion issued on 21.12.2006. He has<\/p>\n<p>made a request as per Ext.P3 addressed to the Director of Panchayats<\/p>\n<p>to   transfer   and   posting     in   one   of   the   Panchayats   in   Kollam   district<\/p>\n<p>highlighting that he suffers from certain serious ailments and that he is<\/p>\n<p>due to retire from service by the end of May 2007. He is a native of<\/p>\n<p>Chavara   and   it   would   be   desirable   that     if   he   is   permitted   to   work<\/p>\n<p>somewhere  near  Chavara, he  may get the care  and attention  by the<\/p>\n<p>members of his family.\n<\/p>\n<p id=\"p_1\">       2. Counsel for the petitioner submits that certain open vacancies<\/p>\n<p>are due to arise within a short period of time and this Court may direct<\/p>\n<p>Ext.P3 to be disposed of by the first respondent.\n<\/p>\n<p id=\"p_2\">       3. Heard the Government Pleader also.\n<\/p>\n<p id=\"p_3\">       4. In the circumstances, there shall be an order directing the first<\/p>\n<p>respondent to consider Ext.P3 taking into consideration the facts and<\/p>\n<p>circumstances   stated   therein   and   to   dispose   of   the   same,   as<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C)No.1863\/2007                                            2<\/span><\/p>\n<p>expeditiously as possible in any event within six weeks. I make it clear<\/p>\n<p>that   the   claims   of   other   employees,   similarly   situated,   also   shall   be<\/p>\n<p>considered   along   with   Ext.P3.
