He made an application under<br \/>\n\tSection 63 of the Bombay Tenancy and Agricultural Lands Act, 1948<br \/>\n\t(hereinafter referred to as &#8216;the Act&#8217;) to the respondent<br \/>\n\tNo.2-Collector for obtaining permission for selling the said land<br \/>\n\tpaiki 20 gunthas to the father of the petitioners, wherein it was<br \/>\n\tspecifically mentioned that the father of the petitioners was an<br \/>\n\tagriculturist and having experience of agriculture. Thereafter, the<br \/>\n\tCollector, Mehsana, vide order dated 15th April 1986<br \/>\n\tgranted the permission for selling the land as per the terms and<br \/>\n\tconditions under Rule 36  read with Section 63 of the Act and in<br \/>\n\tthat manner, the land in question was sold to the father of the<br \/>\n\tpetitioners. As per the transaction of sale, the Talati Cum Mantri<br \/>\n\tmade the entry of transaction in the record of rights on 07th<br \/>\n\tAugust 1986. However, after four years, the respondent No.2<br \/>\n\tpreferred Revision Application before the respondent No.1<br \/>\n\tchallenging the order dated 15th April 1986 passed by the<br \/>\n\trespondent-Collector (the then). During the pendency of the Revision<br \/>\n\tApplication, the father of the petitioners as well as respondent<br \/>\n\tNos.3 to 6 expired and therefore, their heirs and legal<br \/>\n\trepresentatives have been brought on record. Thereafter, the<br \/>\n\trespondent No.1 vide order dated 14th September 2000 has<br \/>\n\tbeen pleased to set aside the order dated 15th April<br \/>\n\t1986. Hence, present petition.\n<\/p>\n<p id=\"p_2\">Mr.Bharat<br \/>\n\tJani, learned advocate for the petitioners, has submitted that the<br \/>\n\trespondent No.1 has erred in holding that there is breach of<br \/>\n\tprovisions of The Fragmentation Act by dividing 20 gunthas land from<br \/>\n\tthe land bearing Survey No.320; that no reasons have been given by<br \/>\n\tthe respondent No.2 for preferring Revision Application at such a<br \/>\n\tbelated stage i.e. after a period of more four years; that the<br \/>\n\tvalidity of a transaction on the basis of provisions of Section 63<br \/>\n\tof the Act cannot be decided by the revenue authorities in RTS<br \/>\n\tproceedings; that the documentary evidence produced the petitioners<br \/>\n\thas not been taken into consideration and appreciated by the<br \/>\n\tRevisional Authority and that the petitioners are in adverse<br \/>\n\tpossession of the land in question since 1988. Hence, it is prayed<br \/>\n\tthat the impugned order may be quashed and set aside by upholding<br \/>\n\tthe order dated 15th April 1986 passed by the respondent<br \/>\n\tNo.2.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tlearned Assistant Government Pleader has submitted that the impugned<br \/>\n\torder passed by the respondent No.1 is just and proper and the<br \/>\n\tauthority has passed the order after appreciating the pros and cons<br \/>\n\tof the matter. There is no illegality much less any perversity in<br \/>\n\tthe findings recorded by the respondent No.1. Hence, present<br \/>\n\tpetition is required to be dismissed.\n<\/p>\n<p id=\"p_4\">Having<br \/>\n\tconsidered the contentions raised by the learned advocate for the<br \/>\n\tpetitioners, averments made in the petition, contents of the<br \/>\n\timpugned order and the documentary evidence produced on record, it<br \/>\n\ttranspires that the respondent No.2-Collector has referred to the<br \/>\n\tpapers received from the office of the Mamlatdar vide communication<br \/>\n\tdated 03rd April 1986. However, it is pertinent to note<br \/>\n\tthat the respondent No.2 has not appreciated the said documents and<br \/>\n\tother documents which are referred to in the said order dated 15th<br \/>\n\tApril 1986 in their true spirit and perspective. Apart from the<br \/>\n\tsame, the learned advocate for the petitioners has contended that<br \/>\n\tthe father of the petitioners purchased the land in question in the<br \/>\n\tyear 1986 and the Revision Application has been preferred after a<br \/>\n\tdelay of four years in the year 1990. Thus, by taking over all view<br \/>\n\tof the matter, the impugned order is required to be set aside and<br \/>\n\tthe matter is required to be remanded to the respondent<br \/>\n\tNo.2-Collector for deciding the matter after appreciating and<br \/>\n\tconsidering the aforesaid documents forwarded by the office of the<br \/>\n\tMamlatdar vide communication dated 03rd April 1986 as<br \/>\n\twell as the documents referred to in his order dated 15th<br \/>\n\tApril 1986.\n<\/p>\n<p id=\"p_5\">For<br \/>\n\tthe forgoing reasons, present petition is hereby partly allowed. The<br \/>\n\timpugned order dated 14th September 2000 passed by the<br \/>\n\trespondent No.1 in Revision Application preferred by the respondent<br \/>\n\tNo.2 is hereby quashed and set aside. The matter is remanded to the<br \/>\n\trespondent No.2-Collector for deciding the same afresh after taking<br \/>\n\tinto consideration the papers received from the office of the<br \/>\n\tMamlatdar vide communication dated 03rd April 1986 and<br \/>\n\tother relevant papers meeting with the lacunas shown by the<br \/>\n\trespondent No.1 in the impugned order. The respondent No.2-Collector<br \/>\n\tis directed to decide the matter within a period of four months from<br \/>\n\tthe date of receipt writ of present judgment. It is, however,<br \/>\n\tclarified that till the decision is not taken by the respondent<br \/>\n\tNo.2-Collector, the possession of the petitioners over the land in<br \/>\n\tquestion will not be disturbed.  Rule is made absolute to the<br \/>\n\taforesaid extent.
