Application is allowed.<\/p>\n<p>         Order (Annexure P17) is taken on record.<\/p>\n<p>Criminal Misc. No. M-1982 of 2009<\/p>\n<p>         On 22.1.2009, this Court had passed the following order:-<\/p>\n<blockquote id=\"blockquote_1\"><p>                              &#8220;Notice of motion.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                              On the asking of the Court Mr. Anter Singh<\/p>\n<p>                     Brar, learned Deputy Advocate General, Haryana,<\/p>\n<p>                     accepts notice on behalf of the State. A copy of<\/p>\n<p>                     petition has been supplied to him.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p><span class=\"hidden_text\" id=\"span_1\">                              Petitioner was named in case FIR No. 119<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-1982 of 2009 (O&amp;M)                              2<\/span><\/p>\n<p>                 dated 25.9.1996 registered at Police Station Division<\/p>\n<p>                 No. 6, Jalandhar, under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Section 279<\/a> &amp; <a href=\"\/doc\/1371604\/\" id=\"a_1\">304-A<\/a> IPC.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                           Counsel for the petitioner submits that<\/p>\n<p>                 petitioner was not involved in the accident. He<\/p>\n<p>                 further submits that petitioner was declared as<\/p>\n<p>                 Proclaimed Offender when he had left for Canada.<\/p>\n<p>                 Counsel for the petitioner has referred to order dated<\/p>\n<p>                 2.11.2008 passed by the Court of learned Judicial<\/p>\n<p>                 Magistrate Ist Class, wherein it has been stated that<\/p>\n<p>                 petitioner has left to Canada and service be effected<\/p>\n<p>                 through Embassy. Counsel for the petitioner has<\/p>\n<p>                 placed reliance upon judgment of Delhi High Court<\/p>\n<p>                 in <a href=\"\/doc\/1897035\/\" id=\"a_2\">Sunil Kumar v. State<\/a> 2002(1) Recent Criminal<\/p>\n<p>                 Reports 119 to say that petitioner has to be served<\/p>\n<p>                 through Ministry of External Affairs of Canada. It has<\/p>\n<p>                 been further stated that no service was effected<\/p>\n<p>                 upon the petitioner, therefore, order of declaring him<\/p>\n<p>                 Proclaimed Offender is bad in the eyes of law.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                           Counsel further submits that the petitioner<\/p>\n<p>                 is ready and willing to face his trial. Offence under<\/p>\n<p>                 <a href=\"\/doc\/1270101\/\" id=\"a_3\">Sections 279<\/a> &amp; <a href=\"\/doc\/1371604\/\" id=\"a_4\">304-A<\/a> IPC is bailable.          Counsel<\/p>\n<p>                 further submits that the petitioner is ready and willing<\/p>\n<p>                 to appear in the trial Court.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                           In view of this, the petitioner may appear<\/p>\n<p>                 before the trial Court on or before 31.1.2009. On his<\/p>\n<p>                 appearance he shall be released on bail.<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> Criminal Misc. No. M-1982 of 2009 (O&amp;M)                                   3<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                               Case to come up for further hearing on<\/p>\n<p>                    6.2.2009&#8243;.\n<\/p><\/blockquote>\n<p id=\"p_1\">          Mr. Anter Singh Brar, learned Deputy Advocate General,<\/p>\n<p>Punjab, on instructions from Dalwinder Singh, Head Constable, submits<\/p>\n<p>that supplementary challan was filed on 24.2.2009.<\/p>\n<p id=\"p_2\">          Counsel for the petitioner        has placed on record order<\/p>\n<p>(Annexure P17) to state that petitioner has appeared before the trial<\/p>\n<p>Court in compliance of order dated 22.1.2009.<\/p>\n<p id=\"p_3\">          Hence, the petitioner is allowed to remain on bail during the<\/p>\n<p>pendency of trial on furnishing of fresh bail bonds to the satisfaction of<\/p>\n<p>the trial Court.
