Kochar, Advocate, appearing for revisionists and learned<br \/>\nA.G.A. for the State.\n<\/p>\n<p id=\"p_1\">      The order dated 5.12.2009 passed by Additional Chief<br \/>\nJudicial Magistrate-II, Gautam Budh Nagar, in complaint case<br \/>\nno.2930 of 2009 Manoj Kumar Vs. P.K. Bhalla and others under<br \/>\n<a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_1\">323<\/a>, <a href=\"\/doc\/838469\/\" id=\"a_2\">452<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_4\">506<\/a> I.P.C. Police Station Sector 49<br \/>\nNOIDA, District Gautam Budh Nagar, is impugned in the instant<br \/>\nrevision.\n<\/p>\n<p id=\"p_2\">      Revisionists are officers of HDFC Ltd. Opposite party no.2<br \/>\napplied for housing loan, which was approved and Rs.50,00,000\/-<br \/>\n(Rupees fifty lacs) was disbursed in four instalments He made<br \/>\ndefault in repayment of loan. A money suit was instituted, which<br \/>\nwas decided in favour of HDFC Ltd. Officers of HDFC Ltd.<br \/>\ninitiated   recovery    proceedings   under    Securitisation   and<br \/>\nReconstruction of Financial Assets and <a href=\"\/doc\/198257891\/\" id=\"a_5\">Enforcement of Security<br \/>\nInterest Act<\/a>, 2002 (hereinafter referred to as the Act) and issued a<br \/>\ndemand notice under <a href=\"\/doc\/198257891\/\" id=\"a_6\">Section 13(2)<\/a> of the Act. Pursuant to an<br \/>\napplication moved before District Magistrate under <a href=\"\/doc\/198257891\/\" id=\"a_7\">Section 14<\/a> of<br \/>\nthe Act, police force was given for taking possession of the<br \/>\nmortgaged property.\n<\/p>\n<p id=\"p_3\">      Meanwhile, civil misc. writ petition no.46254 of 2006 was<br \/>\npreferred by opposite party no.2, which was disposed of by this<br \/>\nCourt vide order dated 25.8.2006 with certain direction and<br \/>\nconditions. The said conditions were not fulfilled.\n<\/p>\n<p id=\"p_4\">      After completing all the formalities, officers of HDFC Ltd.,<br \/>\nalong with police force and Nayab Tehsildar went for recovery. A<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                   2<\/span><\/p>\n<p>request was made by co-borrower Smt. Savita Mishra for 30 days&#8217;<br \/>\nfurther time to make the entire payment of balance loan. Money<br \/>\nhas not yet been deposited but an application under <a href=\"\/doc\/99487\/\" id=\"a_8\">Section<br \/>\n156(3)<\/a> Cr.P.C. was moved with malicious intention against<br \/>\nrevisionists and 16-17 unknown persons for offences under<br \/>\n<a href=\"\/doc\/1258372\/\" id=\"a_9\">Sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_10\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_11\">149<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_12\">323<\/a>, <a href=\"\/doc\/838469\/\" id=\"a_13\">452<\/a>, <a href=\"\/doc\/764237\/\" id=\"a_14\">394<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_15\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_16\">506<\/a> I.P.C., which<br \/>\nwas treated as a complaint case. Learned Magistrate after<br \/>\nrecording statement under <a href=\"\/doc\/444619\/\" id=\"a_17\">Sections 200<\/a> and <a href=\"\/doc\/1149595\/\" id=\"a_18\">202<\/a> Cr.P.C.<br \/>\nsummoned revisionists for the aforesaid offences vide order dated<br \/>\n5.12.2009, which is impugned in the instant revision.\n<\/p>\n<p id=\"p_5\">      Sri G.S. Chaturvedi Senior Advocate, has drawn my<br \/>\nattention to <a href=\"\/doc\/198257891\/\" id=\"a_19\">Section 32<\/a> of the Act, which relates to protection of<br \/>\naction taken in good faith. He has submitted that assuming any<br \/>\nact was committed while effecting attachment order in lieu of<br \/>\nrecovery of loan, revisionists are entitled for protection of action<br \/>\nin discharge of their official duty.\n<\/p>\n<p id=\"p_6\">      In view of the aforesaid submission, issue notice to<br \/>\nopposite party no.2 returnable at an early date.\n<\/p>\n<p id=\"p_7\">      Counter affidavit may be filed within three weeks from the<br \/>\ndate of receipt of notice. Learned A.G.A. may file counter<br \/>\naffidavit within four weeks from today. Rejoinder affidavit may<br \/>\nbe filed within three weeks thereafter.\n<\/p>\n<p id=\"p_8\">      List immediately on expiry of the aforesaid period.<br \/>\n      Till the next date of listing, operation of impugned order<br \/>\ndated 5.12.2009 passed by Additional Chief Judicial Magistrate-<br \/>\nII, Gautam Budh Nagar, in complaint case no.2930 of 2009<br \/>\nManoj Kumar Vs.
